A 49-year-old man was injured in a hit-and-run accident while he was on the job for the New York State Department of Public Service. According to a recent News10.com report, the incident occurred in Kingsbury as the victim was walking on State Route 196 and was struck by a vehicle that did not stop.
Police said that a pickup truck heading west hit the worker near State Route 32. Based on the news article, one of the mirrors of the passing truck hit the man’s head with such a force that he was thrown onto the roadway. He suffered injuries to his head and shoulders. The victim was flown to a nearby hospital where he was listed in stable condition.
The pickup truck and the hit-and-run driver have since been identified by officials who had reviewed video footage from local businesses near the site of the accident. The driver has been held and charged with misdemeanor leaving the scene of a personal injury auto accident. Our prayers and best wishes go out to the victim here for a quick recovery. We also applaud the efforts of the police for quickly apprehending the driver.
Failing to Stop is Illegal
It is illegal under New York law to flee the scene of a car accident. A driver who is involved in a collision is required to stop immediately, wait for officials to arrive, report the incident and exchange information (driver’s license, insurance, etc.) with the other parties. The New York Statute 600 requires “Any person operating a motor vehicle who, knowing or having cause to know that personal injury has been caused to another person, due to an incident involving the motor vehicle operated by such person shall, before leaving the place where the said personal injury occurred, stop, and exchange license, insurance and contact information.”
In hit-and-run cases, it is the accident victims and their families who struggle emotionally and financially and are left facing medical expenses, hospitalization costs and loss of income, etc. In this particular case, the at-fault driver has been located and held. The injured worker can seek compensation for his losses by filing a personal injury lawsuit against the at-fault driver. Further, if the driver is determined to have been on the job and/or operating a company vehicle at the time of the collision, then, his employer may also be held liable.
The victim here was injured while on the job, so he can also file a claim through his employer’s workers’ compensation insurance, which will cover medical expenses and a portion of the lost wages. Also, the injured person can file a third party personal injury case, in which much more money may be recovered.
How to Protect Your Rights
Hit-and-run accident victims would be well advised to immediately contact a knowledgeable New York hit-and-run lawyer who can help them protect their legal rights. Victims should:
• Get medical attention and the required treatment as soon as possible.
• File a police report and obtain a signed copy for their records.
• Note any information about the hit-and-run driver and vehicle’s description such as vehicle color, make, model and the license plate number.
• Get contact information for any witnesses.
• Report the incident to their auto insurance company.
Injured victims or their families can seek compensation through the uninsured motorist clause of their auto insurance policy if the driver has not been identified. Victims can also seek compensation through a quasi-state agency if there is no motor vehicle in their household. Even if the at-fault motorist is not located or identified, an experienced personal injury lawyer can help victims and families recover significant monetary compensation for damages including, but not limited to, medical expenses, lost wages and benefits, hospitalization, permanent injuries, disability, past and future pain and suffering, etc.
