Eligibility

There are different eligibility requirements depending on who you are and what project you are applying for. In general, to qualify for EMFF funds your project needs to support the overall aims of the EMFF which are to:

make the fisheries and aquaculture sectors more sustainable

conservation of the marine environment

support growth and jobs in coastal communities

Projects that don’t support the aims won’t be eligible for support. These themes are broad so if you are unsure contact the Marine Management Organisation (MMO) for details. For more details about eligibility, see the guidance notes for the application type that is relevant to your project.

If your project has already been supported with funds from another source (such as another public body), you may not be eligible for full EMFF funding support.

Proceed at your own Risk

You cannot start your project before you receive confirmation that we have received your application. You can start your project after you receive this confirmation, but this is at your own risk. If you application is not approved, any costs you pay will not be eligible to be claimed.

Certain applicants are not eligible to apply for funding under the EMFF scheme.

If you have committed and been convicted of a ‘serious infringement’ in the 12 months before you apply, you won’t be eligible for EMFF funds. A serious infringement of rules includes things like:

you don’t hold a valid licence

you haven’t used compliant fishing gear

you have broken conservation rules

you have obstructed an inspection or observation

If you have committed and been convicted of Fraud in the context of the EFF or EMFF schemes you will not be eligible for EMFF funding support. Fraud includes things that have enabled you to wrongfully receive funds from the EFF or EMFF schemes, examples of this are;

you have used or presented false, incorrect or incomplete statements or documents

you have not disclosed information where you are in breach of a specific obligation

you have used EFF/EMFF funds for purposes other than those for which they were originally granted

you have misused the benefits of your project

How to apply

Each application type has different guidance notes associated with it. Make sure you read the relevant guidance notes carefully before you start your application. There is also a general guidance note for the scheme.

You will be able to apply for EMFF funds by filling in an application form using the EMFF e-system. You can find copies of the guidance notes on this page. We have published these to help you decide whether you want to apply for EMFF funding. You should be aware that the guidance notes and any associated documents may be subject to change before the scheme opens, or at any time. If you cannot use the EMFF e-system, other formats of the application form will be available on request.

To use the EMFF e-system, you will need to register either as yourself or your organisation. There are many benefits to using the e-system to apply for the EMFF. These include:

reducing duplication as the system will save your details when you register, so you will not have to enter these every time you apply

the e-system will check that you have given all the required information to complete your application

keeping you better informed as you can check the progress of your application or claim on the e-system and keep track of all the applications you have submitted

all of the documents related to your application can be uploaded to the e-system, so they can be accessed easily

you will receive reminders by email prompting you to take actions such as submitting your claim

The application form will ask you to fill in information about the following:

yourself, your business and your vessel, if relevant

your project

how much your project will cost

the impact your project will have

how you plan to fund your project

You will need to submit quotations and/or tenders for the work you are applying for support for. Depending on your application and project type, you may also need to submit additional evidence such as a:

certificate of registry for your vessel

business case with more details on your project if this is needed

Proceed at your own Risk

Once you send us your application form with all the required evidence we will send you confirmation that we have received your application. You may begin work when you receive this confirmation but please note that this does not guarantee that you will get EMFF funding. We aim to consider your application in 40 working days. After this we will tell you whether we have approved it or not. Applications over £100k total cost are considered at regular Panel meetings and decisions of funding may take longer to be reached. Once you submit your EMFF funding application to the MMO, we will send you confirmation that your application has been received. We will then start to assess whether your project can receive funding. You can view or download a flowchart to see the whole process.

You cannot start your project before you receive confirmation that we have received your application. You can start your project after you receive this confirmation, but this is at your own risk. If you application is not approved, any costs you pay will not be eligible to be claimed. If you prefer to wait until your application has been assessed before starting work you can choose to do this.

First checks of your application

We will look at your application to make sure that the:

required sections of the application have been completed and enough information has been provided that we can make a decision

application passes the general eligibility checks

application passes the financial eligibility checks

If your application doesn’t have all the required information we will contact you in order to get more information from you. The sooner you can get back to us the better so we can continue assessing your application.

Assessing your application

We will then decide whether to give you funding under the EMFF scheme, using specific selection criteria. This will either be done by the MMO or by a specific selection panel in some circumstances.

In England, if the value of your project is less than £100,000, the European Grants team will assess your application. If the value is higher than £100,000, the selection panel will assess your application.

Your application for funding will be assessed against a set of objectives which have been agreed with the EMFF Programme Monitoring Committee (PMC) which is made up of representatives from the fisheries, aquaculture and NGO sectors amongst others.

This assessment will establish how your application for funding support the overall aims of the UK EMFF programme. Further details on the specific areas your application will be assessed against can be found within the

Once your application has been assessed we will contact you to tell you our decision. If it is approved, you will then need to accept the offer of funding and submit a claim in order to receive EMFF funds.

Make a claim under the European Maritime and Fisheries Fund.

Once your application has been approved, you will receive an offer letter. This letter will tell you:

the amount of money you have been awarded and where the money is coming from

the schedule of works agreed and the supplier responsible

how the project is funded (who is providing funds and how much)

a breakdown of the expenses approved (for example, equipment purchase and salaries)

any targets your project will need to achieve in order to receive the money

the date your project will need to be completed by

the date your claim(s) will need to be submitted by (taken from your application)

any other terms and conditions associated with the offer

what you need to do next

You will need to accept this offer of EMFF funds before you can make a claim. We will also include a form for you to provide us with your bank details to enable you to receive payment for your claim.

Match Funding

The value of land, buildings or assets cannot be used as match funding.

Future revenue from projects or other businesses cannot be used as match funding.

Items or services where there are no actual costs incurred cannot be used as match funding; these are in kind match funding, see below for details of this type of match funding.

Cash, loans or grants from other sources being used for match funding must be in place before applying to the European Maritime and Fisheries Fund. Applicants are advised they may be asked for proof this is in place before a decision is made.

In Kind costs

In Kind costs are those where no actual costs have been incurred.

For example, an organisation allowing a member of staff to work on an EMFF funded project for 1 day per week, but while paying the person is not an In Kind cost. Alternatively, the same person volunteering outside of work hours, for which they are not paid, is an In Kind Cost.

As no actual costs are being incurred, In Kind costs cannot receive a financial contribution from the EMFF scheme. However, In Kind costs may be an important part of delivering a project.

When applying for funding, In Kind costs should not be included in the actual costs associated with the project but should be detailed within either the application form or the business case to explain why these are important.

In Kind costs should not exceed 10% of the total budget for a project

Project Management

In general Project Management costs should not exceed 10% of the total project costs.

It is acknowledged that revenue projects can incur higher project management costs in some circumstances and that capital projects are normally expected to incur lower project management costs.

In either case if you wish to incur more than 10% Project Management costs on your project you must provide a detailed rationale of the need for the increased costs with your project submission. Any requests for Project Management costs above 10% of the total project costs will be carefully assessed by the MMO and therefore consideration should be given to ensuring that costs of this nature provide the best possible value for money for the public funding.

Before you apply

You must not start work on your project before you’ve applied for the EMFF grant and received a letter from the MMO that confirms your application has been received.

If your application is successful, you will need to be able to pay for your project costs up front - you can then claim the costs back.

If you start work before receiving your acknowledgement letter, your project will be automatically ineligible for a grant. In exceptional circumstances, you can claim back costs of up to 10% of the total eligible project costs at the funding rate applied, provided the fund actions are directly related to the project and the provision of professional services that assist the application to proceed, for example architects plans. The MMO will decide if you’re eligible to reclaim these costs.

Expressing your interest

and send it to the MMO if you want them to check if your initial project idea is feasible.

You don’t have to do this, if you prefer you can make a full application for funding without initial advice.

The MMO will then assess your project and tell you if you can apply and how you should do so. If the MMO invites you to complete a full application, this doesn’t guarantee that you’ll get a grant.

Documents you need to send

As well as your application form and any specific documents mentioned in the form guidance, you’ll need to send:

accounts or a cash flow forecast for your business, or the business you’re applying to fund

any permissions, consents or licences that your project would need to go ahead

quotes, catalogue listings or proof of formal tender for products or services you plan to purchase with the EMFF money evidence of how you’ll fund the rest of your project, for example a loan agreement or savings account statement. A business case only required for projects over £25,000.00)

Accounts and cash flow forecast

You need to send copies of your organisation’s accounts for the last 3 financial years.

If your organisation is 1 or 2 years old you can send the accounts for those years.

If your organisation is less than a year old, make a cash flow forecast for a minimum of 5 years - follow the guidance for the grant you’re applying for.

If your organisation is currently making a loss, this does not necessarily mean that the application cannot be considered. However, you will need to explain carefully in your business case or application the steps being taken to make the organisation financially viable, including the contribution the project is expected to make to this.

Permissions, consents and licences

If your project needs specific permissions, consents and licences to go ahead, you must send proof that you have them to the MMO.

Quotes

For all goods and services that you intend to claim for as part of your project, you need to send whichever of the following you have:

quotes that a supplier of the product or service sent to you - the number of quotes you need to send depends on the value of the product or service

photocopies or print-outs of catalogue listings for the product or service. We will accept catalogue quotes for small items sourced from online catalogues or websites and evidence of the price can be provided as a dated web page. The web page must include all the details necessary for the MMO to consider the quote; this includes item details and specification, price, date and full supplier details of company name, full address, contact number, name of staff member providing the quote and business number

email quotes - Email quotes can be accepted however either the body of the quote or the attachment must follow the general quote guidance and contain the company name and address, date, name of the individual within the company supplying the quote, company number etc. Quotes that don’t meet the requirements set out will be rejected by the MMO

documents that prove you’ve issued a formal tender to register your interest in buying the item or service, scoring and decision making details

These documents are used to show that you’re getting the best value for money in your project.

Public and private procurement (quotes requirements)

For all goods and services that you intend to apply for as part of your project, you need to send whichever of the following you have:

quotes that a supplier of the product or service sent to you - the number of quotes you need to send depends on the value of the product or service. See below.

photocopies or print-outs of catalogue or website listings for products. We will accept photocopies or print-outs of catalogue or website listings for products. The required numbers of photocopies or printouts must be provided according to the value of the product, see below;

the photocopies or print-outs must contain the specification of the item which can be compared across the evidence supplied. They must contain a price and all should either inclusive or exclusive of VAT as applicable.

the photocopies or print-outs must be from accessible catalogues or website that can be easily verified.

Private applicants

Individual Items With a Value (excluding VAT) of:

A detailed specification of the works to be undertaken, 2. Evidence of the scoring used to select the company, 3. A suitable rationale for the decision to select the chosen company.

Email quotes - Email quotes can be accepted however either the body of the quote or the attachment must follow the general quote guidance and contain the company name and address, date, name of the individual within the company supplying the quote, company number etc. Quotes that don’t meet the requirements set out will be rejected by MMO.

Documents that prove you’ve issued a formal tender, scoring and decision making details.
All quotes provided must come from independent companies and may be verified by MMO.

The quotes and tenders you send must:
* come from suppliers that trade independently of each other and don’t share any ownership
* be from the last 3 months and be valid
* be comparable in terms of the quality, size, quantity, and type of product, if you’re using multiple quotes to show you’ll get value for money when buying a product

Don’t send quotes or tenders that come from suppliers you’re related to or that your business is linked to.

Quotes supplied must include:

a detailed and itemised breakdown of costs

supplier’s address, phone number and a contact name

supplier’s VAT number, if they’re VAT registered and they included VAT on the quote

supplier’s company registration number, if they’re a limited company

If you applying for costs as part of your project they must be in line with MMO rules. Contact MMO for details.

These documents will all be used to show that you’re getting the best value for money in your project.

Applicants must ensure that the companies requested to quote for items or services for their project know that their quote is being submitted as part of an application of funding to the EMFF scheme and MMO.

A declaration completed by the company quoting must be obtained by you and supplied with your application. The declaration can be found on the MMO website or contact MMO for a copy.

All quotes provided must come from independent companies and will be verified by MMO. MMO reserves the right to seek independent advice on the validity and value for money of quotes and tenders supplied. MMO may contact your suppliers directly.

Public applicants

Different rules apply to different applicants when obtaining quotes for projects. The rules for public applicants such as public authorities and government organisations and the rule for private applicants such as private businesses are below.

For public applicants public procurement rules must be followed.

Public applicants - Externally procured services and items

The procurement of goods and services that are acquired externally must follow the procurement rules of the organisation applying and evidence of those procurement rules must be provided with the application.

An example of evidence required in support of a procurement policy is referenced below however organisational requirements will differ;

EU procurement rules apply

[17] must be in line with organisational policy and evidence will need to be provided to support this when a claim for payment is made.

In certain circumstances there may be only one supplier that can provide the goods or services, this could be because;

it is the only provider who has the necessary skills or equipment to undertake the work,

ihe provider owns the exclusive rights required to deliver the goods or service.
If this is the case then it is a Single Tender Action (STA) or equivalent and it is necessary for evidence to be supplied;

in the example of the organisational procurement policy, for all STA’s over £1,000 pre-procurement approval must be provided in the form of a completed Pre Procurement Approval Form (PPAF) or equivalent which evidences the supporting justification for the STA and must be approved by the business area and the Head of Procurement or equivalent prior to any purchase of the goods or services.

if your organisation does not follow a similar formalised process then evidence of project objectives, a breakdown of the costs, an outline of any value for money considerations, reasons for not procuring in the usual way and any relevant supporting documentation must be provided.

Public Applicants - Internally procured goods and services.

If the goods and services are being supplied to the project internally, by an applicant’s own organisation then formal procurement is not applicable. However to ensure value for money is considered we would need to see the following information;

a rationale for using internal staff/services - this should include but is not limited to; evidence of the skills and experience of the individual and their suitability for the role undertaken, evidence of the unique suitability of the vessel/equipment for the role,

evidence that the project has satisfied a value for money assessment where possible.

Quotes in Foreign Currencies

When you submit a quote which is in a foreign currency you must calculate the exchange rate at the time the application is submitted, you can use this website to convert your amounts

You must tell us the exchange rate you have used and the pound sterling amount you have calculated.

You must do this for each quote you send us in any foreign currency.

Where there are exchange rate fluctuations between submitting an application for funding and an offer of funding being made the MMO will use the most favourable exchange rate for you. When you claim your funding you will be reimbursed for the actual amount you have paid based on the exchange rate at that time. The foreign currency costs should not exceed the amounts stated on the original quote.

Suppliers

You must make all of your suppliers aware that they are quoting for an EMFF grant application. This responsibility for this lies with you and verification checks will be made by the MMO.

Leasing of items or equipment

The costs of leasing, where leasing rather than buying, makes value for money sense even if it won’t meet Durability of Operations (this is the rule that items purchased with European Funding must be retained and not modified by you as the applicant for a minimum of 5 years after acceptance of offer) can be considered eligible for funding in some circumstances. Items can include but is not limited to plant for site works; porta-cabins for temporary work spaces and other equipment only needed for a limited time but is required for the delivery of the project.

Where leases are part of your project appropriate numbers of quotes must be supplied to ensure value for money is considered. You must also provide a rationale with your application explaining why the use of leased items is better value for money than purchase. Leases on land or buildings – If you have leased land or buildings within your project for example; if your project is the fitting out of a leased building into a processing unit. The land or building must have a lease remaining of at least 10 years from the time you apply for funding. If your land or building does not have at least 10 years lease remaining at the time of applying you should contact MMO for advice.

Leases

Assessment

The MMO will contact you within 5 working days of receiving your application to confirm that they’ve got it.

They’ll write to you within 40 working days to tell you if your application has been successful or not, provided they don’t need any further information.

If your application is approved

If your project is approved, the MMO will send you an offer letter which states the:

conditions you must follow when completing your project - if you don’t meet these the MMO can withdraw or change the offer

amount of money you’ve been awarded - in some cases you won’t be awarded the total amount you applied for

Respond to your grant offer

If you decide to accept the offer of funding and its conditions, send a signed copy of your offer letter to the MMO.

You should also make a copy of the offer letter and keep it.

Publicity

The European Commission and the MMO will publish brief details of all successful projects, including your name or your organisation’s name as applicable, a description of the project and broad details of any grants awarded; this is called the Transparency Initiative.

In addition projects must acknowledge they have received European funding to the public. Projects must display;

(a) The Union emblem in accordance with the technical characteristics are available on the EC website

(b) A reference to the Fund or Funds supporting the operation. This is most likely to be the European Maritime and Fisheries Fund (EMFF) however it’s possible you have received funding from other European Funds in which case a reference the ‘ESI Funds’ meets requirements

c) Providing on the beneficiary’s website, where such a website exists, a short description of the operation, proportionate to the level of support, including its aims and results, and highlighting the financial support from the Union;

(d) Placing, for operations not falling under point c above, at least one poster with information about the project (minimum size A3), including the financial support from the Union, at a location readily visible to the public, such as the entrance area of a building.

and;

No later than three months after completion of the project, you must put up a permanent plaque or billboard of significant size at a location readily visible to the public for each project that fulfils the following criteria:

The total public funding for the project exceeds EUR 500 000 (based on the exchange rate at the time of application);

The project consists of the purchase of a physical object or of the financing of infrastructure or of construction operations.

The plaque or billboard shall state the name of the project as well as the EU logo, MMO logo and the phrase ‘Investing in sustainable fisheries’.

If you are required to put up a plaque or billboard as above and you do not you will be deemed to have not fulfilled the terms and conditions of the grant awarded to you and funding may be recovered.

Durability of operations

To ensure the effectiveness, fairness and sustainable impact of the intervention of the EMFF scheme, provisions guaranteeing that investments in businesses and infrastructures are long-lasting and prevent European Funding from being used to undue advantage should be in place.

Therefore items purchased using public funding from the EMFF Scheme must be owned and used for their original purpose for a minimum of five years, except where State aid rules provide for a different period or the items are leased, see the Leasing of items or equipment section for more advice.

In the case of a project comprising investment in infrastructure or productive investment, and where the applicant is not a Micro, small or medium enterprise (SME), an applicant will be required to repay the funding contribution from the EMFF if, within 10 years of the final payment to the project, the project or its activity is subject to relocation outside of the European Union.

Some or all of the funding for projects that do not meet the Durability of Operations above will be recovered.

If your application is declined

If the MMO declines your application, you will be sent a letter that explains why. You can appeal this decision through the MMO if you think that:

it was based on a factual error

it was legally wrong

the MMO made an error in processing your application

You have 28 days after the date of the decline letter to ask the MMO to review their decision. An Independent appeal officer will consider your application in full against the selection criteria. The appeal will either pass which means the original decision is overturned or fail and the original decision is upheld.

We will notify you of the outcome of your appeal within 6 weeks of receiving it.

If your appeal is successful and the original decision is overturned you will be issued with either an offer of funds letter or a partial offer letter.

If your appeal is unsuccessful the appeal decision is final and no further correspondence will be entered into. However you can reapply and your new application will be considered without prejudice.

What happens after you receive your EMFF funds
