Liberty Counsel: Kim Davis Requests Relief Against Gov. Beshear Pending Appeal
Clerk Gains National Attention Defending Religious Freedom

Cincinnati, OH – Today, on behalf of Rowan County, Kentucky Clerk Kim Davis, Liberty Counsel filed a request for an order providing relief pending appeal against Gov. Steven Beshear at the Sixth Circuit Court of Appeal. This is an emergency request for the Governor to accommodate Kim’s religious conviction, which would free her from jail. “Today is a holiday where most people are spending time with family and friends. But for Kim Davis this is day five of her incarceration. While she is content no matter her circumstances because of her deep faith and Jesus, she should be free,” said Mat Staver, Founder and Chairman of Liberty Counsel.

Today’s filing addresses Gov. Beshear’s inaction and refusal to consider easy accommodations for Kim Davis. The motion requests an injunction pending appeal for an exemption from the Governor’s mandate that all county clerks issue marriage licenses. The Governor’s edict directed Kentucky County Clerks like Kim Davis to authorize same-sex marriage licenses bearing their own name.

“Coercing Mrs. Davis to authorize and personally approve same-sex marriage in violation of her religious convictions and conscience is wrong,” said Staver.

Staver continued, “From the outset of this case, Kim Davis has proposed numerous simple options to protect her sincerely-held religious beliefs. These less-restrictive solutions are readily available, and easily accomplished by the Governor and the state agency responsible for designing the revised marriage form at issue in this litigation. The Governor’s refusal to take elementary steps to protect religious liberties has now landed Kim Davis in jail. As a prisoner of her conscience, Davis continues to request a simple accommodation and exemption from the Governor.”

Later today or tomorrow morning, Liberty Counsel will also file the legal arguments at the Sixth Circuit Court of Appeals regarding the Contempt Order. Yesterday that Contempt Order was appealed. The appeal was to the verbal order as Judge Bunning has not yet issued a written Contempt Order.

Kim Davis Is Rosa Parks

Judicial tyrants in black robes have been stripping civil liberties from Christians for decades. But what was once a gentle and almost imperceptible erosion has turned now into a full-scale avalanche. The latest victim to be buried under a pile of legalistic debris is Kim Davis.

She is the county clerk in Rowan County, Kentucky, who has refused, for reasons of conscience and Christian principle, to issue licenses for sodomy-based marriages. She is not only morally right, she is legally and constitutionally right, since there is no law that compels her or even authorizes her to issue such licenses. (There is a Supreme Court ruling, to be sure, but that ruling is nothing more than a sheer, naked exercise of raw judicial power which ignores the Constitution altogether.)

So as I write, Kim Davis is in jail. She has been imprisoned in America for the crime of being a Christian.

Rosa Parks was jailed in 1955 for the crime of being black. She spent but one day in jail, yet her refusal to go the back of the bus, in brazen and bold civil defiance of an actual law, lit the match of the civil rights movement.

Kim Davis is our Rosa Parks. Now it must be noted that Mrs. Davis, is not, like Mrs. Parks, being punished for civil disobedience, but rather for an act of brazen and bold civil obedience. In Mrs. Davis’ favor is the simple and manifest truth that she is fulfilling the oath she took to uphold the Constitution of the United States and the Constitution of the state of Kentucky.

The Constitution of the United States is utterly silent on the subject of marriage and homosexuality, which means under the 10th Amendment of the Founders’ Constitution the issue is left for the states to decide. And the state of Kentucky decided the issue by elevating protection for man-woman marriage to its state constitution in 2004 with 75% of the vote. Mrs. Davis is just doing the job she took an oath to do, by refusing to issue licenses which, under Kentucky law and the federal Constitution, she has no legal authority to grant.

So Kim Davis languishes in jail in our day as Rosa Parks did in hers.

To change the analogy, she is our Daniella in the lion’s den. She is an authentic American hero. I watched video of homosexual activists storming her office this week, belligerently screaming slogans at Kim Davis as she stood alone behind the counter against this hateful mob. She never once raised her voice, but was unfailingly calm, self-controlled, and courteous, and uttered no vitriol or threats in return. If you’re looking for a living, breathing example of obedience to Christ’s admonition to turn the other cheek and love your enemies, look no further than Kim Davis.

Now the question is whether the body of Christ will join her defenders or her accusers. We’ve had Christian leaders for years telling us we need people of courage and boldness to step up and take a stand for the truth and the gospel in the face of hatred and persecution. Well, Kim Davis has responded to your challenge. Will you stand with her, by her, and for her, or abandon her in your silence?

Every GOP candidate for president, all 17 of them, need to be put on record. Do you support or condemn Kris Davis? American voters need to know. Will you, as a candidate for president, join Gov. Mike Huckabee, Sen. Ted Cruz, Gov. Bobby Jindal and Sen. Rand Paul in open support of her, or will you, like Carly Fiorina, Chris Christie, and Lindsey Graham, push her off the platform and under the train?

Every pastor in every pulpit in America should honor her by name this weekend and lead his congregation in prayer for her. If we pray for Saeed Abedini, imprisoned in a Muslim country for his Christian faith, we certainly must pray for Kim Davis, imprisoned in a Christian country for her Christian faith.

So, church, we have a hero to defend. Will we do it? We’ll find out on Sunday.

Clerk Gains National Attention Defending Religious Freedom

Rowan County clerk, Kim Davis, has attracted national attention over the issue of same sex marriage. But for Kim, the matter is regarding religious freedom.

Mat Staver: Matt, this Kim Davis is a lady who has worked in the Kentucky county, Rowan county clerk’s office of for 27 years. In 2014 she became elected as the chief clerk of the county. She lives in that county. She has only lived in that county.

She loves the people. Loves her job. She never envisioned herself being involved in this national spotlight over the matter of marriage. But on June 26th, all of that changed, when the Supreme Court, five lawyers on the Supreme Court issued the opinion with regards to marriage. So now she has been in the spotlight, and there is the focus on her about issuing a same sex marriage license.

For Kim Davis she says it’s never been about individual people. It’s never been a gay or lesbian issue in her word. She says it’s only about her religious freedom. It’s about her being able to stay true to her Lord, to the Bible, and to her conscience. And that’s what the issue is.

And when you look at some of the facts in this case, you realize that this agenda is not just about having same-sex marriage, it’s about crushing religious freedom. Kim’s case really focuses that particular point.

Matt Barber: Yea Mat, we hate to be proven right with something like this where we have said over the years that’s what this whole agenda is all about, this homosexualist agenda, this so-called marriage equality agenda.

It has nothing to do with two men or two women being able to get married, something that of course is inherently impossible, that defies the very definition of what marriage is and has always been. But rather, it is an attempt to strong-arm, particularly Christians, into capitulation and into celebration of the homosexual lifestyle.

Kim Davis here is merely saying “I hold the First Amendment sacrosanct, my First Amendment liberties have not changed since these five extremist attorneys came down with this silly opinion that is not rooted in law or the Constitution, or history or anything else.

She says, “No…when I took my oath it was to the Constitution and to the constitution of Kentucky,” which, incidentally not a word has changed and the legislature hasn’t passed a law legalizing so-called gay marriage in Kentucky.
