Course Description:

California’s Fair Employment and Housing Act- referred to as the “FEHA”- provides that as a matter of public policy, “the freedom to worship as one believes is a basic human right and that “the accommodation of religious pluralism is an important and necessary part of our society.”

In recent years, the California Department of Fair Employment and Housing and the federal Equal Employment Opportunity Commission have reported a significant rise in religious discrimination cases. Both agencies are bringing their own cases against employers, as well. In fact, just last year, in a case brought by the EEOC against Abercrombie and Fitch Stores, Inc., the United States Supreme Court found that the retail giant discriminated against an applicant on the basis of her religion-even though she had never even requested an accommodation.

Statutes which prohibit religious discrimination are being amended to account for religious plurality at work. On January 1, 2013, California implemented the Workplace Religious Freedom Act, which prohibits discrimination on the basis of religion (or religious creed) and requires accommodation of employees’ religious practices and observances. On April 1, 2016, California implemented new regulations to the FEHA which include amendments to California’s religious discrimination and accommodations rules.

In her HR Magazine article, “Matter of Faith” Dori Meinert reported that according to a survey of more than 2,000 employees interviewed in September 2013 by the New York City-based Tanenbaum Center for Interreligious Understanding, more than a third of U.S. workers reported observing or being subjected to religious bias at work,. As the U.S. workforce grows more diverse, HR professionals should expect an even greater level of conflict over employees’ religious differences in the next decade, according to Joyce Dubensky, chief executive officer of the Tanenbaum Center.

Course Objective:

This course will assist employers avoid liability for religious discrimination, harassment, retaliation and failure to accommodate actions brought by applicants and employee and/or governmental agencies.
Having completed this course, the participant will be able navigate religion-related issues and better avoid employer liability.
We will review the:

California Fair Employment and Housing Act;
California's Workplace Religious Freedom Act; and
Title VII of the Civil Rights Act of 1964
