WILTON, Conn. (WTNH) — A Wilton family has sued the town and the board of education for the alleged sexual assault by a former elementary school teacher aide.

According to the family’s lawyer, Eric von Kohorn,a former aide at the Miller-Driscoll Elementary School, sexually assault the family’s child in a school bathroom during the 2012-2013 school year.

The lawsuit claims that von Kohorn allegedly “inappropriately touched, sexually assaulted and battered” the four year old preschool student in January 2013, which caused bodily injury.

The lawsuit claims the family informed the school principal, Dr. Fred Rapczynski of the injuries, and that he allegedly failed to report the allegation to DCF within the required 12 hours, instead waiting to report it four days later.

The complaint also claims that Dr. Rapcynski allegedly submitted a signed report to DCF indicating von Kohorn admitted taking the girl to the bathroom, but then separately informed the girl’s parents that his investigation concluded just the opposite: that von Kohorn had never taken the girl to the bathroom at all.

Court records indicate von Kohorn was sentenced to two years in prison and 10 years probation after pleading guilty to possession of child pornography.
