1. PROMOTERS : Glanbia Performance Nutrition Pty Limited (ABN 59 161 129 264) T/A Optimum Nutrition (“ON”) and Fitness First Australia Pty Limited (ABN 65 094 778 622) (FF) are each aPromoter and collectively the Promoters. For the avoidance of doubt, the terms “Promoter”and “Promoters” are used interchangeably in these Conditions of Entry anda reference to “Promoter”in these Conditions of Entry may be to either ON or FF or both. This Promotion is not sponsored, endorsed, administered by, or associated with Facebook.
2. ELIGIBILITY: ‘Win The Health & Fitness Prize Pack of a Lifetime’ competition (Promotion) is open to legal residents physically residing in Australia, who are 18 years of age or older at time of entry, members of Facebook and agree to accept these Conditions of Entry. Employees of the Promoters and their parent companies, affiliates, and advertising, promotion and Internet agencies contracted by ON and their immediate family members (including spouses, parents, siblings, children and their respective spouses) and/or those living in the same household of each are not eligible. In order to be eligible, entrants must comply with these Conditions of Entry and must meet the Promoter’s participation and fulfilment requirements.
3. TO ENTER: During the period commencing at [10:00 a.m. AEDT Tuesday 3 March 2014] and ending at11:59 p.m. AEDT 23 March 2014, visit https://www.facebook.com/pages/Optimum-Nutrition-Australia and follow the on-screen entry instructions. Entrants must click ‘Like’ on ON’s Facebook page to be eligible. Entrants must answer the following Test of Skill Questions: • In 25 words or less, tell us which ON Platinum product does or could help you achieve your fitness objectives? • In 25 words or less, Fitness First would like to know how has fitness helped you go further in life? An entry must include an answer to both the Test of Skill Questions to be included in the Promotion, subject to eligibility requirements. Each entrant that is eligible to participate in the Promotion and submits an answer to both of the Test of Skill Questions in accordance with this Condition 3 submits anEligible Entry into the Promotion. Each entrant that has submitted an Eligible Entry is an Eligible Entrant. Limit one entry per person. If an entrant submits multiple entries, the earliest entry will be accepted and all others will be discarded. The Promoter, in its sole discretion, reserves the right to disqualify any entrant. False, deceptive or incomplete entries shall render an entrant ineligible. Participation in the Promotion is free and there is NO PURCHASE NECESSARY to participate. However, the response to Test of Skill Question number 1 (one) MUST include reference to an existing ON branded product from the Platinum line.
4. WINNER SELECTION: The Promotion is a game of skill and winners will be the Eligible Entrants that submit the most creative and inspiring answers to the Test of Skill Questions. Winners are chosen from the Eligible Entries and are determined in accordance with the following process: a) For each Eligible Entry, the Promoter will review the answers to both Test of Skill Questions (the answers in each Eligible Entry are collectively referred to as the Response). b) The entrant that has submitted the Eligible Entry which contains the most creative and inspiring Response is the Prospective Grand Winner. c) The two entrants that have submitted the Eligible Entries which contain the most creative and inspiring Responses out of all the remaining Eligible Entries will be the Prospective Runners Up. d) Each of the entrants referred to above is a Prospective Winner until they satisfy the following conditions as well as all other relevant requirements set out in these Conditions of Entry, upon which they will become a Winner and will receive a prize: i. The Promoter will announce the three Prospective Winners on 24 March 2014 on ON’s Facebook page. The three Prospective Winners will later be notified via email and/or telephone. Failure to respond to the notification within 48 hours may result in disqualification and an alternate Prospective Winner being selected. ii. Prospective Winners must provide proof of age, residential address in Australia and, in the case of the Prospective Grand Winner, availability to travel within 7 days to Melbourne (flights and accommodation will be provided by ON). iii. As a condition of receiving a prize, Prospective Winners may be required to complete and sign an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form and, where permitted by law, a publicity release. iv. Prospective Winners agree that the Promoters have the right to substitute any prize at their sole discretion. v. If any document is returned to Promoter as undeliverable or if a Prospective Winner fails to complete and return documents within 14 days of notification or a Prospective Winner declines the prize or fails to meet eligibility requirements, the Promoters reserve the right to disqualify this Prospective Winner. In this case, the prize will either be forfeited or awarded to an alternate Prospective Winner. e) If a Prospective Winner does not satisfy the above conditions or any other relevant requirements and an alternative: i. Prospective Grand Winner is required, the entrant that submitted the most creative and inspiring Response of the two Prospective Runners Up will become the Prospective Grand Winner and an alternate Prospective Runner Up will be chosen in accordance with the below sub-paragraph (ii); and/or ii. Prospective Runner Up is required, the entrant that submitted the most creative and inspiring Response of all the remaining Eligible Entries will become the Prospective Runner Up. The process in this paragraph (e) will be repeated as many times as required until the Promoters are satisfied that all of the Winners meet the requirements set out in these Conditions of Entry. 5. PRIZES: The Grand Winner will receive a twelve (12) month Platinum membership* available at any Fitness First club in Australia (value AUD 1,350), a pack of random ON products**, depending on availability (value AUD 1,000), the opportunity to meet a join a train session with the ON International athletes Steve Cook and Anna Startrodubtseva to be held on April 3rd at one of the clubs in Fitness First in Melbourne CBD and a return flight to Melbourne and one night accommodation in Melbourne***. The Runners Up will each receive a pack of Platinum Products of ON (Platinum PRE - & Platinum HydroWhey Stack) (Each of the Runners Up prizes is valued at AUD 200.) Prizes will be sent within 10 days of the date of notification, subject to the Promoters being satisfied that the requirements set out in these Conditions of Entry are met. Total prize value for the Promotion is: AUD 2,750. *If the Grand Winner is not a member of FF at the time they receive the Grand Prize, they must activate their membership by 24 June 2014. If the Grand Winner is a member of FF at the time they receive the Grand Prize, they will have the 12 month complimentary period added to the end of their current membership term. Standard terms and conditions of membership apply. Prize is not transferable. **The Promoter reserves the exclusive right to substitute any prize with another prize of equal or greater value. All federal, state and local taxes are the sole responsibility of the Winner. LIMIT ONE PRIZE PER PERSON. ***In case the Grand Winner lives in the state of Victoria, a return flight ticket to Melbourne and one night accommodation in Melbourne does not apply. The Grand Winner will not be reimbursed the value of the flights and accommodation, nor will it receive an alternative prize.
6. DISCLAIMER AND RELEASE OF LIABILITY: By entering the Promotion, entrant agrees to
(a) release the Promoters and Facebook, their respective directors, officers, employees and assigns and their agents from all liability, loss or damage arising out of or relating to the prizes and their acceptance and use/misuse of the prize;
(b) to be bound by these Conditions of Entry and comply with all the requirements of the Promoters; and
(c) that the Promoters may use the entrant’s name, likeness, personal information and statements made by the entrant to the Promoter, including their answers to the Test of Skill Questions, for advertising and promotional purposes in all media worldwide without additional compensation. Subject to Australian Consumer Law, neither of the Promoters makes any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including without limitation quality, merchantability and fitness for a particular purpose.
7. GENERAL CONDITIONS: The Promoter is not responsible for any typographical or other error in the printing of any materials relating to the Promotion or in the announcement of the prize/s. The Promoter is not responsible for incomplete, lost, late, damaged, illegible or misdirected e-mail or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmissions or any combination thereof. The Promoter is not liable for damage to any computer system resulting from participation in or accessing or downloading information in connection with this Promotion. CAUTION: SHOULD AN ENTRANT MAKE ANY ATTEMPT TO DELIBERATELY DAMAGE THE PROMOTERS’ WEBSITES OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION, THE PROMOTERS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. The Promoter reserves the right, in its sole discretion, to cancel or suspend this Promotion should a virus, bug, or other causes beyond the control of the Promoter corrupt the administration, security or proper operation of the Promotion. In the event of termination, a notice will be posted on-line and all prizes will be held from among all eligible entries received prior to the time of termination. The Promoter reserves the right to modify the Promotion or disqualify entrant if fraud, misconduct or technical failures destroy the integrity of the Promotion, as determined by the Promoter in its sole discretion. 1. PRIVACY: The Promoters respect your personal information (“PI”). All PI collected by the Promoters will be dealt with by each Promoter under its privacy policy. Any person is entitled to contact the Promoter and request access to any PI the Promoter holds about them, at any time.
