We’ve shared heaps of alleged deceitful modus stories on our website. Some of them had gone viral and were resolved. Hopefully, this another alleged towing modus story in will be resolved soon.

Another concerned Netizen shared his experience with an alleged illegal towing incident happened at his condominium in Panay Avenue, Quezon City.

According to him, he parked his car within his condominium area as he was going to drop off something real quick. He also mentioned that the building allows a 5-minute grace period at the drop-off area.

In verbatim:

I even made sure na walang parts ng car ang nasa Kalye, dahil natakot sa nawitness na incident earlier. As far as i know, nakalagay sa House rules ng Condo, 5 mins ang allowable(para hindi makaabala kung may magdrodrop off din.

But he got shocked when the condo’s security guard told him his car was being towed. So, Jhun Casay immediately asked the “towing people” why his car was being towed.

Wow, after witnessing a “kaasar” road incident, hindi ko akalain na ako mabibiktima rin.

Early this AM, habang nakapila ang car ko papasok sa Parking ng Victoria Tower sa Timog Ave., para magGym sa Golds Timog, nakarinig ako ng away. Yung Black na Vios sa likod ko hinihila ng Tow truck eh slightly moving kami at nasa loob yung driver, nagtatalo yung taga Towing at driver nung lumabas yung driver para harapin ang mga tao, biglang hinatak na yung car na partly nakaOpen pa at humahabol ung may ari. OMG cant imagine kung sa akin nangyari yun buti at ako na ang papasok sa basement parking.

Etoh na ang Siste, mga 4:30PM kanina, dumaan ako sa Condo Unit ko sa Panay Ave, to drop off some stuffs para sa unit ko kaya nagPark ako sa waiting area sa lobby, infront of The Beech Bar. I even made sure na walang parts ng car ang nasa Kalye, dahil natakot sa nawitness na incident earlier. As far as i know, nakalagay sa House rules ng Condo, 5 mins ang allowable(para hindi makaabala kung may magdrodrop off din.

I just placed inside my room my things and immediately went down. Pero pagbukas ko ng elevator sa Gfloor, nasalubong ko Guard ng Condo na nagmamadaling sinabi sa akin na tinatalian na daw yung car ko. Napatakbo kami ng Sister ko at nakita kung kinakabitan ng bakal ang likod ng Everest ko. Sinita ko yung guy at tinanong kung bakit ako itotow eh nasa condo premises naman ako wala sa kalye, ang sagot sa akin nung kasamang lalaki na gumagawa ng record, “Wag na kayong makipagUsap sumunod na lang kayo!” At inaabot sa akin yung papel na sinulat nya. Sabi ko “Gago ka ba? Bawal na magtanong eh kotse ko yang tinatali nyo at mukhang sisirain nyo pa dahil sa likod nyo hihilain eh nakahandbreak yan, hindi nyo mahatak sa harap noh dahil Private property na etoh? Sinong pwedeng kausapin dito? Yung matino! Hindi katulad mong bobo!”, tinuro lang yung lalaki na may uniform ng MMDA. Dun ko lang nakita na Apat pa lang towing trucks at 4 din kaming hinuhuli, pero yung tatlo sa likod ko ay sa Kalye ng Panay Ave nakaPark, infront of SaveMore(probably mga magrogrocery)

Nung nilapitan ko yung mama na nakaVest at may ID(i failed to get his name), kausap yung 3rd car (Black Honda CRV) nakatali na rin pero maraming sakay, I asked him “Boss sino pwedeng kausapin kung bakit hinahatak yung sasakyan ko?” Aba mas bobo at sira-ulo pala si Boss, “Eh wag nyo na ako kausapin at may inaareglo na ako”, sagot ko, “Anong inaareglo?, eh sino kakausapin ko?”

At dinedma na ako.

Binalikan ko yung nagtotow ng sasakyan ko, at sinipa yung kahoy na ginagamit na pangkalso, binuksan ko ang lahat ng pinto ng kotse ko para mapahinto sila. Nilapitan ako nung isang payat at sinabihan akong “Masyado kang matapang hah!” At that point namura ko sya, “P-I ka, ano ba pangalan mo, wala nga kayong mga ID eh! Tigilan nyo yan at may tatawagan akong Judge ng QC Cityhall.” Sumagot si payat na “P-I ka din, baka 2 na ang ikaso ko sayo!”, sabi ko “Ano may alam ka pang kaso eh mukhang wala ka namang pinagaralan!” At biglang tinangkang isarado pinto ng car ko, pero at that moment beast mode na talaga ako lalo na ng makita kung umaandar na palayo yung 2 car sa likod ko na nakakadina kanina at mukhang “Nagkaaregluhan” na, sila na talagang nagViolate ng parking rules ang nakalusot. Yung pang-apat na black Vios na walang may ari lang ang hinatak. At that point mukhang hahatakin na talaga yung car ko patalikod, pinikturan ko yung nagkakabit ng kadina, at nagpost pa ang kumag.

Hinamon ko ng suntukan yung isa na gustong isara mga pinto ko,at patuloy na tinatanong names nila.

Sagot sa akin “ikaw muna, ano pangalan mo?!” Pagbigay ko ng pangalan ko, sabay sabing “Mayabang ka, Doctor din ako!”

After that, nakontact ko na yung kaibigan kung Judge at kinausap na nakaLoud speaker. Pinakukuha pangalan nila at kung sino ang kasamang Police o tagaMMDA, mga kontratesta lang daw yang mga yan. Nung marinig nilang totoong may kausap akong judge, biglang sumenyas yung mamang NakaVest na mukhang kumolekta ng “Tong” sa 2 pinakawalang sasakyan, biglang nagmamadali nilang tinanggal yung kadina ng sasakyan ko, yung Mayabang na duwag na hinamon ko ng suntukan, biglang tumatakbong papasok sa truck nya, nung tinawag ko at sinabing bukas sikat ka sa FB. Aba nagDirty Finger pa.

Haissst paging MMDA Director, QC Mayor Herbert Bautista, pakiayos naman po ang kalakalan ng towing activitist sa QC. I know na gusto ninyong ayusin ang traffic, pero please get rid of these crocks!

PROPER TOWING PROCEDURES

If you’re a follower of the TV series, South Beach Tow, you’d probably be scared as they are tougher and straightforward with the procedure. They are transparent and only give you two options: (1) $150 on the spot or (2) $250 if you claim it at the tow yard. No more, no less.

So, for the benefit of everyone, let me share the information about towing procedures in the Philippines. According to the Philippine Star that indicated MMDA Resolution No. 02-33 dated August 29, 2002, named: Approving and Adopting the Revised MMDA Guidelines for Towing and Impounding Operations in Metro Manila.”

It says there that “stalled” and illegally parked vehicles” are to be towed and impounded accordingly. And by “stalled” they mean any motor vehicle and/or their attachment, which for any cause, is unable to proceed under its own motive power and is on a public road, street or thoroughfare and dilapidated/junked vehicle in Metro Manila. While “Illegally parked vehicles” is defined as vehicles parked in prohibited areas by law or city ordinances designated by the MMDA and other Local Government Units or LGUs.

Furthermore, the resolution stated the following points:

The towing company should be listed as legal and registered with MMDA annually

MMDA, on the other hand, will issue numbered stickers to tow trucks

The towing company or agency shall be held responsible for losses/damages incurred while towing the vehicle/s.

Attended illegally parked vehicles shall not be towed but the driver shall be immediately issued a TVR

Unattended illegally parked vehicle shall be towed and issued a TVR immediately upon arrival at the impounding area

Flat-tired vehicle must be moved to the emergency lane on its own, if not, it will be towed. In either case, TVR will be issued.

Changing of flat tires on the roadway is not allowed.

Stalled or illegally parked vehicle as a result of an empty fuel tank, may be towed to the nearest gasoline station, however, the towing fee should be paid to the tow truck in accordance with the number of kilometers from the point of origin to the gasoline station and a TVR shall be issued to the driver.

“Illegally parked vehicles that are already clamped to the tow truck shall not be subject for intercession by the owner of the vehicle or by the representatives of the company’s two truck.

If the vehicle is unattended, the tow truck driver shall blow the truck’s horn five (5) times twice in a row with a space of 1 minute in between. If the owner does not respond, the vehicle shall be towed.

If the tow truck has no authority to operate, towing service in Metro Manila, the towing incident shall be considered an unlawful or illegal act, and the tow truck operator shall be charged for colorum operation. The traffic enforcer shall issue a TVR to the tow truck operator through the driver for such violation and shall impound said tow truck.

Apparently, Jhun told me via Facebook chat, he said that his friend from the MMDA has confirmed that the towing truck isn’t accredited.

Kinuntact na ako ng friend ko from MMDA. Hindi sila involved sa towing activity na eto, kasi incharged sila sa Christmas lane at kung sa kanila daw po eto, dapat MMDA tow truck ang gamit at may mga personnel ng MMDA kasama witj proper IDs in this case wala pong identifications.
