Eligibility: Participation in this Sweepstakes is open only to legal U.S. citizens18 years of age or older who own and reside in a single family home (not in a condominium or apartment complex) in the Chicagoland metropolitan area (defined as Cook, DuPage, Kane, Kendall, Lake, McHenry, and Will counties in Illinois; Porter and Lake counties in Indiana) (the “Sweepstakes Area”) as of December 5, 2014. Employees and their immediate family members (spouse, parents, siblings, and children) of WGN Radio, Aprilaire, their parent companies, subsidiaries, affiliates and advertising agencies are not eligible to win. Entrants who have won any prize valued over $600 from WGN Radio within the last two years (counted from the date of finalist selection) are not eligible. Void where prohibited and outside the Sweepstakes Area.
To Enter: The “Just Text Me” Sweepstakes (the “Sweepstakes”) begins at 7:00 am CT on December 6, 2014 and ends at 9:30 am CT on January 31, 2015 (the “Sweepstakes Period”). The Sweepstakes Period will be divided into two monthly entry periods, the December Period (selection dates for Finalists (defined below) on December 6, 13, 20, and 27, 2014) and the January Period (selection dates for Finalists on January 3, 10, 17, 24, and 31, 2015). During the Sweepstakes Period, WGN Radio listeners will be invited to submit their questions about do-it-yourself home improvement projects to be read by Lou Manfredini on-air (the “Question”). There are two ways to submit a Question: 1) text your question to 312.981.7200; or 2) submit your Question along with your name, home address, and home telephone number by filling out the entry form at wgnradio.com/contests. Standard message and data rates apply to text method entries. Check with your carrier for details. Text method entrants must use a valid telephone number. Only one entry per person, telephone number, email address, and household will be permitted per week, regardless of method of entry. Entries in excess of those limits will be disqualified. For purposes of the Sweepstakes, each “week” ends at 9:30 am CT each Saturday morning during the Sweepstakes Period and the next “week” starts immediately thereafter.
Entrants must use their own name. If any dispute arises concerning the identity of an entrant, the owner of the telephone account identified in the text will be deemed the entrant for text message entries, and the owner of the email account identified in the email will be deemed the entrant for email entries. Sponsors are not responsible for lost, incomplete, damaged, illegible, late, or misdirected entries, or for errors in mechanical transmission, technical difficulties or inability to transmit Internet or text message entries.
Question Submission Requirements:
Must be the original creation of the entrant;
Must be in English;
Must be nor more than 25 words;
Must not contain material that is inappropriate, indecent, lewd, pornographic, obscene, hateful, tortious, defamatory, slanderous or libelous; and
Must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age.
By entering, each entrant represents and warrants that the submitted Question is in compliance with all of the foregoing requirements. By entering, each entrant understands and agrees that the Question may be read on air on WGN Radio and posted on the WGN Radio website. By entering, each entrant grants to the Sponsors and their licensees a world-wide, perpetual, non-revocable, royalty-free, sub-licensable license to publish his/her Question as well as derivative works based thereon on WGN Radio, on Sponsors’ websites, in Sponsors’ apps, on social media, and through any and all other media, now known or hereafter devised, in any manner related to the Sweepstakes, without prior notice, approval or compensation. Entrant represents and warrants that Sponsors’ use of the Questions as provided for herein will not violate the rights of any third party. Entrants otherwise will retain all rights to their respective Questions. Each entrant agrees to indemnify, defend and hold Sponsors harmless against any and all liabilities, losses, damages, claims, debts, investigations, fines, penalties, costs, expenses and settlements (including attorneys’ fees and costs of litigation, settlement, judgment, interest and penalties) arising out of or related to a breach of any of the foregoing representations and warranties. Sponsors reserve the right to reject any entry that, in their sole and absolute discretion, is determined not to meet the above specifications.
Finalist Selection and Notification: Every Saturday at 9:35 am CT during the Sweepstakes Period, WGN Radio staff will review all Questions received by 9:30 am that day and select up to five finalist entries (each, a “Finalist”) to be read on-air based on the feasibility of the Question (i.e., is it a question that Lou can answer) and human-interest appeal. WGN Radio may attempt to notify each Finalist by phone, after all entries are reviewed every Saturday. Entries not selected as a Finalist will not carry over to subsequent weekly Finalist selections. There is no prize for being a Finalist.
Winner Selection and Notification: After the close of the December Period, WGN Radio staff will randomly select one entry from the Finalists pool for that period and declare that individual a potential grand prize winner. Odds of being selected as the winner from among December Period Finalists are 1 in 20. After the close of the January Period, WGN Radio staff will randomly select one entry from the Finalists pool for that period and declare that individual a potential grand prize winner. Odds of being selected as the winner from among January Period Finalists are 1 in 25. Sponsors will attempt to contact the potential winners by telephone. The name of the potential winning entrant may be announced on-air during the Mr. Fix-it with Lou Manfredini show (Saturdays, 7am-10 am). If a winner is unreachable or fails to respond to Sponsors’ initial notification attempt within three days or if winner is found to be ineligible or otherwise not in compliance with the Official Rules, Sponsors reserve the right to award the prize to an alternate winner selected at random from among remaining eligible, non-winning Finalists for that period. If Sponsors cannot verify winner, Sponsors reserve the right not to award the prize. All results are unofficial until winner is verified.
Prizes: Grand Prize Winner (2 total): Each grand prize winner (the December Period winner and the January Period winner) will receive an Aprilaire whole-home humidifier solution. Whole-home humidifier solution includes installation and labor to be completed by no later than January 31, 2016.
Exact model of Aprilaire whole-home humidifier solution will be determined by an Aprilaire representative in the sole discretion of the representative. In the event an Aprilaire whole-home humidifier solution is not compatible with the grand prize winner’s home, the winner will receive a $500 credit to Aprilaire to be used toward the purchase of Aprilaire products. Winners are responsible for paying for any labor and materials outside of the whole-humidifier solution installation and must be at their request and mutually agreed upon by Aprilaire. Approximate retail value (“ARV”) of the prize package is $500.00. Actual value will vary based on the exact model of the humidifier solution, but, if actual value is less than the stated ARV, difference in prize value will not be awarded.
The winner is solely responsible for any applicable federal, state and local taxes in connection with winner’s prize as well as any other expenses not specifically provided for herein. The winner may be required to complete and submit an IRS Form W9 prior to receiving the prize. WGN Radio and Aprilaire maintain the right to choose the final project selection. Winner will also be required to make home available and accessible to humidifier installation personnel as reasonably required by Aprilaire or its representative and to sign any documents Aprilaire or its representative may require to perform installation. The installation must occur at a home within the Sweepstakes Area. Certain restrictions may apply; prize recipients will receive notice of any such limits at the time they receive prize notification. Prizes are non-transferable, non-negotiable and not redeemable for cash, credit or merchandise. No prize substitutions except at WGN Radio’s sole discretion. Properly claimed prizes will be awarded, but in no event will Sponsors award more prizes than are provided for in these Official Rules.
Internet: If for any reason the Internet-related portion of this Sweepstakes is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause, which corrupts, interrupts or threatens the administration, security or integrity of the Sweepstakes, WGN Radio reserves the right, in its sole discretion, to terminate or suspend the Sweepstakes or any portion thereof. If Sponsor terminates the Sweepstakes, Sponsors will select Finalists for that week from among all eligible, non-suspect entries received as of the termination and will select the grand prize winner for that period from among all Finalists for that period. If Sponsors terminate or suspend the Sweepstakes, Sponsors will post notice of their action on the WGN Radio website and announce the action on the Mr. Fix-It with Lou Manfredini show. Any attempt to damage or undermine the fair and legitimate operation of the Sweepstakes will result in disqualification.
Conditions of Entry: Except where prohibited by law, by entering, each entrant grants permission, without further compensation, to WGN Radio and Aprilaire, and their agents and licensees, to use the entrant’s name, voice, photograph, likeness, biographical material, all information submitted in the entry email, and any video/images filmed during site visits and projects themselves for broadcast and promotional purposes in connection with the Sweepstakes, in any media. By entering, each entrant agrees to release Sponsors from any claim, loss, liability, damage or injury of any kind arising from the entrant’s participation in the Sweepstakes or receipt or use of a prize. Entrants agree to be bound by these Official Rules, and by entering, agree that all decisions regarding eligibility, the administration of this Sweepstakes, and the award of Sweepstakes prizes made by Sponsors shall be final and binding. This Sweepstakes shall be governed and enforced pursuant to Illinois law, excluding choice of law provisions. Except where prohibited, each entrant and winner accepting a prize agrees that any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Sweepstakes or any prize awarded will be resolved individually, without resort to any form of class action and filed only in the state courts situated in Illinois. Entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action. Entrant and winner further agree that any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees, and under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Neither the failure of Sponsors to insist upon or enforce strict performance of any provision of these Official Rules nor the failure, delay or omission by Sponsors in exercising any right with respect to any term of these Official Rules, will be construed as a waiver or relinquishment to any extent of Sponsors’ right to assert or rely upon any such provision or right in that or any other instance.
Other Conditions: Winners may be required to sign and return an Affidavit of Eligibility and Release, and, if so, it must be returned to Sponsors within one week of the date Sponsors send it to winner. Failure to return such document will result in that winner being disqualified, and Sponsors may randomly draw another winner from among all remaining Finalists for that period. Aprilaire is solely responsible for performance of the whole-home humidifier solution project and any guarantees of performance, materials or workmanship.
WGN Radio reserves the right to delay Sweepstakes announcements, postpone or reschedule all or some of the Sweepstakes events, and/or modify Sweepstakes deadlines if breaking news, sports coverage or other unanticipated events prevent the Selection Period from occurring as scheduled. If such changes occur, they will be posted on the wgnradio.com website. Sponsors reserve the right, in their sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar entry methods will void all such entries and entrant will be disqualified. Any attempt by any entrant to submit entries using multiple/different identities or any other methods will void all such entries, and that entrant will be disqualified. ANY ATTEMPT TO DAMAGE OR UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS SWEEPSTAKES WILL RESULT IN DISQUALIFICATION FROM THE SWEEPSTAKES.
Winners List: For a Winners’ List or a copy of the Official Rules, send a self-addressed stamped envelope labeled “Mr. Fix-it’s Just Text Me Sweepstakes” to 435 N. Michigan Ave. Chicago, IL 60611. Requests for Winners’ List must be received by March 31, 2015.
