Introduction of marriage certification:

The marriage act was introduction as a revolutionary act in India in the year 1954 to forbid the violence imposed over women in ancient period. The marriage certificate serves as essential documents that establish a relationship between couples. This certification became mandatory in 2006 as per the verdict of Supreme Court. The certification for marriage has become ensure you with the right that you have been married and in critical conditions are considered as the voice for mercy.

Documentation required for marriage:

The process involved in the registration of marriage appears to be a simple one depending upon the acts with which you are registered. In India, registration is offered under two different acts i.e. the Hindu Marriage Act or the Special Marriage Act. These two acts are quite different from one another. If we focus over the special marriage act makes your marriage registered & official, while the age limit is 21 for both sides. Moreover, hindu marriage acts allow you only to register the marriage and not make it official as well as also minimum age for groom is 21 and bride need be of minimum 18 years. This act is applicable for those who have stayed at one place for at least 6 month time period before marriage.  Thus the documentations required are as followed:

Application form and Affidavit - This application form is mandatory in both acts and need to be signed by both husband and wife. Affidavit by both husband and wife need to be stated in court. This affidavit needs to comprise the info such as location, place and date of marriage, date of birth, marital status at the time of marriage and nationality. Marriage proof – Since, hindu marriage act takes place after your marriage rituals have been performed so one need to bring with them is marriage Invitation card of marriage ceremony. In case of official marriage based on ritual and Indian tradition a marriage certificate issued by the priest is also required. But it is not required if you are applying for before marriage under the provision of special marriage act.

Age proof – Class 10th mark sheet or birth certificate will work as it is would be having your birth date inscribed over it and would be great if a photo is a present in it for you identification such as passport.

Address proof -   You need to provide a governmental issued address proof that may be Passport, Driving Licence, Voter ID card, Aadhar card that has been verified by government. This document must comprise of the applicant name too. This documentation is required to be carried by the three witnesses also to proof their identification.

Ration card - In case of Hindu marriage act ration card proof to be a best documentary evidence for husband and wife who have approached for marriage certificate to the sub divisional magistrate. But in case you are the native of Delhi and you have registered for a special marriage act you need to possess the documentary evidence that has lasted for more than 30 days for e.g.  Ration card or other certification signed by concerned SHO. Photograph - For special marriage act you need to offer two different and unique photographs of marriage night in which they are dressed as bride and groom and performing the rituals of marriage ceremony. Whereas, special marriage act requires almost 3 passport size photographs of both the parties if you are applying for registration before marriage and one more joint photograph if you are applying after marriage.

Recipt – For hindu marriage act a recipt of Rs 100 whereas, for special marriage act Rs. 150 need to be attached. This fee needs to be deposited with the district office cashier along with application form.

Special cases – In case of divorces or widow marriage the attested copy need to be attested for e.g. divorce order sheet of separation and death certificate of spouse need to be submitted in the court.  And, if any one of the parties belong to other caste, than a conversion certificate need to be added.

Lastly, one should always need to keep in mind, that all the certificate need to be attested by Gazetted Officer.
