The Contest Entry Dates: From 4/27/2014 through 5/26/2014 (the “Promotional Period”) CraftFoxes will promote, by means of TheCraftys.com website, the opportunity to submit entries for a chance to win one of ten (10) category prizes and one (1) grand prize, as detailed below.
How to enter: Upload project(s) using the form on the front page of TheCraftys.com website on or before midnight Eastern Standard Time on 5/26/2014.
Eligibility: The Contest is open only to U.S. legal residents with valid email addresses that are at least 13 years of age. Entrants under the age of 18 must obtain the consent of a parent or guardian in order to enter the Contest. The Contest is subject to all federal, state and local laws, rules and regulations, void where prohibited. Winner(s) need not be present to enter or win. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six (6) months, performed services for CraftFoxes or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest or supplying the prize(s), or their respective parents, subsidiaries, affiliates or successor companies, and immediate family and household members of such individuals, are not eligible to enter. “Immediate family members” means parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses. “Household members” means people who share the same residence at least three months in one calendar year.
Entries: All entries, must be uploaded to TheCraftys.com website during the Promotion Period to be a Valid Entry. You may enter more than once, but each entry must be submitted separately with a limit of one (1) entry per person/household/day regardless of method of entry. A “day” is defined as the twenty-four (24) hour period beginning at 12:00:01 a.m. EST on any individual calendar date during the Promotional Period and ending at 11:59:59 p.m. EST on that date. All entries must be received by 11:59 p.m. EST on 5/16/2014. Only entries received during the Contest Promotional Period and which are otherwise fully compliant with these Official Rules will be entered for a chance to win (“Valid Entries”). Multiple entries per day will result in the disqualification of all entries from said entrant. Entries not satisfying all the requirements of these Official Rules will be automatically disqualified. No mass or mechanically reproduced entries will be allowed. In the event of a dispute as to the identity of the entrant, entry will be deemed submitted by the holder of the email account provided, and associated with the CraftFoxes username, if applicable. Proof of being the authorized account holder may be required and the decision of the judging panel and Sponsor are final. Entries not containing a valid email address will be disqualified. Proof of sending an email or postal mail is not considered proof of delivery to or receipt by the Sponsor of such entry. Sponsor is not responsible for late, lost, or misdirected entries that are not received in a timely manner, or are lost due to computer or electronic malfunction or other error, or due to inaccessibility of the Internet or portions thereof.
Judging Criteria and Selection of Winners: Submissions will be judged by a panel of judges which may include but is not limited to Timothy Adam, Brett Bara, Simone Collins, Lasette Canady, Brie Dyas, Rachel Faucett, Mark Montano, Dory Carr-Harris, and Andrea Zimmerman, and according to the following judging criteria (the “Judging Criteria”):
(#1) Technical Expertise – Strong exhibition of a mastery of materials and tools. – 40%
(#2) Creative expression – Expressing a feeling, idea or narrative creatively. – 30%
(#3) Innovation: Illustrating new approaches to the craft – 30%
On or about June 7, the judging panel will select one (1) potential Grand Prize winner and ten (10) Category Prizewinners from all Valid Entries in accordance with the Judging Criteria. Sponsor and judges will determine, in their sole discretion, which entries are deemed Valid Entries, and their decisions and the result of the judging will be final in all respects. Odds of winning depend on the total number of Valid Entries timely received.
Category Prizes: Ten (10) category prizewinners will each receive $200 U.S. currency. There may be no other substitutions of prizes by winner(s). However, CraftFoxes, reserves the right to substitute similar prizes of equal or greater value in the event the above prize is unavailable for any reason. The winner, parent or legal guardian of winner(s) is solely responsible for all applicable federal, state and local taxes with respect to entire prize, as further outlined herein.
Grand Prize: One (1) Grand Prize winner will receive $1,000 U.S. currency. There may be no other substitutions of prizes by winner. However, CraftFoxes reserves the right to substitute similar prizes of equal or greater value in the event the above prize is unavailable for any reason. The winner, parent or legal guardian of winner is solely responsible for all applicable federal, state and local taxes with respect to entire prize, as further outlined herein.
Taxes: The value of the prize won by a participant of this Contest may be taxable as income to the winner. The winner, parent, or legal guardian, is solely responsible for any and all taxes or fees associated with the prize(s). Winners will be issued an IRS Form W-9 with the Releases and a subsequent IRS Form 1099. Upon receipt of a prize, the winner, parent, or legal guardian, is required to comply with any and all applicable federal, state and local laws, rules and regulations.
Notification of Winner(s): The potential prizewinner will be notified via e-mail. If a potential prizewinner does not reply within seven (7) days with acceptance to info@thecraftys.com, or if any prize notification is returned as undeliverable, if any potential winner rejects his/her prize notification, or in the event of non-compliance with these Official Rules, such prize will be forfeited and an alternative potential prizewinner may be selected based on the next highest score by the judges.
Affidavit of Eligibility and Release: Prizes are not transferable and not assignable.
Each potential prizewinner must sign and return an Affidavit of Eligibility and Release of Liability, which includes requirement to provide a street address (no P.O. Boxes) located within the United States (excluding Puerto Rico and Rhode Island) and a Social Security Number (collectively the “Releases”) within seven (7) business days of notification. Sponsor reserves the right, at its sole discretion, to disqualify winners based on a background check. Sponsor reserves the right to conduct a background check, including but not limited to criminal history, on any winners. To the extent required by law, winners authorize this check. If any prospective potential winner is found to be ineligible for any reason, an alternate potential winner may be selected at Sponsor’s sole discretion. In the event of non-compliance with these requirements, these Official Rules (including execution of the Releases) or if any Releases or other documentation are returned as undeliverable, the prize may be forfeited and an alternative potential prizewinner may be selected if feasible. All winners are subject to verification and compliance with these Official Rules. Except where prohibited by law, the potential prizewinner’s acceptance of a prize constitutes permission for Sponsor to use the prizewinner’s name, photograph, likeness, statements, biographical information, voice, and address (city and state only), as edited, altered or modified in any way by the Sponsor or its designee(s) in the Sponsor’s sole discretion, as well as any additional photographic images, video images, portraits, interviews or other materials relating to winner and arising from winner’s participation in this Contest in any and all media now known or hereafter devised, throughout the world in perpetuity, for advertising the Contest or any other purposes, without limitation and without additional review, notification, compensation, or approval. No potential winner will be an official winner until his/her eligibility has been formally verified by Sponsor and Releases have been returned to Sponsor. Please allow approximately six (6) to eight (8) weeks from the date of completion of the winner verification process to receive your prize.
Improper Conduct: Each entry must be suitable for display and publication in all forms of media, including but not limited to the internet, the World Wide Web, print, radio, and network, cable or satellite television broadcast. Accordingly, entries may not contain, as determined by the Sponsor, in its sole discretion, any content that: (i) is sexually explicit or suggestive (e.g., nudity or pornography); violent or derogatory; profane; (ii) promotes any activities that may appear unsafe or dangerous; (iii) is obscene or offensive, including but not limited to words or symbols that might be considered offensive to individuals of any race, ethnicity, religion, sexual orientation or socioeconomic group; (iv) contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others; contains any personal identification; (v) contains copyrighted materials owned by others (including songs, photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media); (vi) contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead; (vii) communicates messages or images inconsistent with the positive images and/or good will to which Sponsor associates; or (viii) violates any law. Sponsor reserves the right to make determinations of suitability in its sole and absolute discretion, and to disqualify any entries it determines to be inappropriate for any of the reasons listed above, or for any other reason. Further, Sponsor, in its sole discretion, may disqualify you from participation in the use of any or all portions of the Contest, and refuse to award a prize, if you engage in any conduct Sponsor deems to be improper, unfair or otherwise adverse to the operation of the Contest or detrimental to other entrants of the Contest, or to Sponsor. Such improper conduct, includes, without limitation, falsifying personal information required during registration or prize claim, violating any term or condition stated herein, accumulating entries through automated techniques, or allowing others to use your personal information for the purpose of accumulating entries, or intentionally trying to defraud, reverse engineer, disassemble or otherwise tamper with the computer programs or wireless technology in connection with this Contest. You agree that Sponsor may void any part of any prize that you may have won or require the return of any part of any prize that you may have won as a result of such improper conduct. You further acknowledges that any forfeiture of any prize or return of any prize in no way prevents Sponsor from pursuing other avenues of recourse such as criminal or civil proceedings in connection with such conduct. WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING REASONABLE ATTORNEYS’ FEES) OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Conditions of Entry: Sponsor, and its respective parents, affiliates, subsidiaries, divisions, individuals or entities responsible for the development, printing, distribution and implementation of this Contest (collectively, “Released Parties”) are not responsible for, and you hereby forever waive any rights to any claim in connection with: (i) lost, late, misdirected, incomplete, incorrect, inaccurate, damaged, illegible or postage due entries; (ii) hardware or software errors; faulty computer, telephone, cable, satellite, network, cellular towers, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled, scrambled, delayed or faulty data transmission entries; failure of any e-mail transmissions to be sent or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or the Web Site; unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Contest, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Contest; or (iii) any injury or damage to your computer or any other person’s computer or other device related to or resulting from entering or otherwise participating in the Contest or downloading materials from or use of a Web Site. Released Parties are also not responsible for any other errors in connection with the Contest, including, without limitation, errors or problems in connection with the administration of the Contest, the processing of entries, the announcement of the winners, or typographical, printing or other errors in these Official Rules or in any Contest-related materials.
Release: By participating in the Contest, each entrant agrees to release, defend, indemnify and hold harmless Released Parties from and against any and all claims, demands, expenses, losses and liabilities of any nature whatsoever caused or contributed to by: (i) entering or participating in the Contest (including any claims of third parties alleging infringement, rights of publicity, rights of privacy or defamation or other intellectual property rights); and (ii) the acceptance, use or misuse of any prize. By participating in the Contest entrant irrevocably assigns and transfers to Sponsor any and all rights, title and interest in the submission, including, without limitation, all copyrights, and forever waive all moral rights in the submission, any rights of privacy, intellectual property rights, and any other legal or moral rights that might preclude the Sponsor’s use, alteration or modification of the submission or require the entrant’s permission to use it for any purpose, and agrees to never sue or assert any claim against the Sponsor or any entity acting pursuant to Sponsor’s direction for any use, alteration of such submission, including but not limited to the unconditional and perpetual right and permission to use the entrant’s name, address (city and state), image, voice, likeness, statements, biographical material and entry/submission, including, but not limited to any video, still image, likeness, photos, names, or other material contained in such entry/submission, as submitted or as edited, altered or modified in any way by the Sponsor or its designee(s) in the Sponsor’s sole discretion as well as any additional photographic images, video images, portraits, interviews or other materials relating to the entrant and arising from his/her participation in this Contest in any and all media now known or hereafter devised, throughout the world in perpetuity, for advertising, Contest or any other purposes, without limitation and without additional review, notification, compensation, or approval from the entrant (unless prohibited by law). Entrant further agrees to release, indemnify and hold harmless Sponsor and its affiliates and subsidiaries from any and all claims that any commercial, advertising, presentation, web content or any other material subsequently produced, presented and/or prepared by or on behalf of Sponsor infringes on the rights of entrant’s work as contained in any submitted entry.
Contest Errors and Unforeseen Circumstances: Sponsor assumes no liability and is not responsible for, and you hereby forever waive any rights to any claim in connection with, errors and/or ambiguity: (a) in the Contest; (b) in any related advertising or promotions of this Contest; or (c) in these Official Rules. In the event of any ambiguity(s) or error(s) in these Official Rules, Sponsor reserves the right to modify these Official Rules for clarification purposes or to correct any such error(s) without materially affecting the terms and conditions of the Contest. Sponsor reserves the right to withdraw and terminate, or modify, the administration of the Contest if it becomes technically corrupted, if a computer virus or system malfunction impairs its ability to conduct the Contest, or if the online entry method otherwise becomes impossible, impractical, infeasible for any other reason. Further, Sponsor has the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate this Contest at any time without notice or further obligation. Sponsor reserves the right to announce any Contest rules changes over the air, in print or posters. Sponsor is not responsible for the inability of the winner to accept the prize for any reason. No purchase necessary to enter or win.
Governing Law: This Contest is governed by and interpreted under the laws of the State of New York, U.S.A. without regard to its conflicts of laws provisions. By participating, you agree that any and all disputes arising out of or relating in any way to this Contest will be litigated only in courts sitting in New York, NY, U.S.A. The New York courts (State and Federal) have sole jurisdiction of any controversies regarding the Contest and the laws of the State of New York govern the Contest. You waive any and all objections to jurisdiction and venue in these courts and hereby submit to the jurisdiction of these courts.
Limitation of Liability: IN NO EVENT WILL THE CONTEST ENTITIES, THEIR RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES, DIVISIONS, INDIVIDUALS, AGENCIES, OR ENTITIES RESPONSIBLE FOR THE DEVELOPMENT, PRINTING, DISTRIBUTION OR IMPLIMENTATION OF THIS SWEEPTSAKES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE CONTEST, THE PRIZES, OR THE USE OR MISUSE OF ANY MATERIAL FROM THE CONTEST. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. Warranty: By entering, each entrant warrants and represents (i) that the entrant owns all rights to the submission he/she is entering in this Contest and (ii) that his/her submission(s): (a) is original to the entrant and has been legally obtained and created, (b) does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party, or violate applicable laws, rules regulations, or network standards; and (c) has not been entered in or won any previous contests or awards. By submitting an entry/submission, entrant warrants and represents that he/she consents to the submission and use of the entry/submission in this Contest and to its use as otherwise set forth herein.
Privacy Policy: Sponsor shares your concerns about the privacy of your personal information. Information collected in connection with this Contest will be used in accordance with Sponsor’s privacy policy and these Official Rules. By entering this Contest, you agree to receive marketing materials, communications and other materials from the Sponsor and any promotional partners whose products and services Sponsor feels might interest you at a future date. In the event of any discrepancy between the privacy policy and these Official Rules, the privacy policy controls and governs.
