We’re giving three lucky people the chance to win return Economy flights for two with Qantas to anywhere in our domestic or international network, along with A$2,500 spending money.

Flights depart from each winner’s closest Qantas-serviced Australian capital city.

There will be 3 prizes. Each prize is:

(a) two return Qantas Economy class tickets, (one for the winner and one for their nominated travelling companion) from each winner’s closest Qantas-serviced capital city airport in Australia to any destination on the Qantas Domestic or International

network (flight associated taxes, fees and carrier charges are included), flying on Qantas code services; and

(b) AU$2,500 of spending money, which will be provided by electronic funds transfer (EFT) to a bank account number nominated by the winner or cheque, at the election

of the winner. If choosing to receive the spending money by EFT, the winner must nominate an account denominated in Australian dollars and held with an Australian financial institution and it is the winner’s responsibility to ensure the BSB and account

number provided are complete and accurate.

The total maximum value of each prize is $12,854 and the maximum value of the total prize pool is AU$38,562 based on the recommended retail value as at 15 November 2013.

Qantas ‘Spirit’ Promotion Competition Terms and Conditions

1. Information on how to enter the promotion forms part of these terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.

2. The promoter is Qantas Airways Limited (ABN 16 009 661 901) of 10 Bourke Road, Mascot, NSW 2020 (telephone number 0295784184) (Promoter).

Duration

3. All references to time are to local time in Sydney, Australia, on the date stated. The promotion commences at 12.01am on 06 December 2013 and closes at 11.59pm on 10 January 2014 (Promotion Period).

Eligibility to enter

4. Entry into the promotion is open only to Australian residents only, excluding a) directors, management, agents, employees (and their immediate families) of the Promoter or Mike Da Silva and Associates (Aust) Pty Ltd ABN 50 003 894 022 (MDSA) and each of their related bodies corporate and b) registered travel companions of employees of the Promoter and its related bodies corporate (Eligible Entrants). If an entrant is under 18 years of age they must first obtain their parent or guardian’s permission prior to entering the promotion.

Entry into the promotion

5. To enter, Eligible Entrants must, during the Promotion Period: (a) Go to qantas.com/spirit; and

(b) provide their details by completing the registration form on this website; and (c) submit their entry.

Maximum of one entry per Eligible Entrant. Multiple entries are not permitted. The time of entry will be deemed to be the time the entry is received by the Promoter. Eligible Entrants acknowledge that all content posted on Facebook must be in accordance with Facebook terms (http://www.facebook.com/terms.php).

network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.

Drawing of entries

7. The draw will take place at 10:00am on 13 January 2014 at the offices of MDSA at 15 Grosvenor Street, Neutral Bay, NSW 2089 and will be conducted by MDSA. The winner will be determined by an automated random draw of all eligible entries. The first three valid entries drawn will be the winners. The results of the draw are final and no correspondence will be entered into.

8. If the prize winner is under the age of 18, before they can claim their prize they must obtain consent from their parent or legal guardian to do so, and must be accompanied during their prize travel by an Australian resident over the age of 18.

9. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Notification of the winner

10. The winners will be notified in writing by email (using the details provided on the entry form at the time of entry) within 2 business days after the draw and their names will be published in The Australian newspaper on 20 January 2014. Each winner is responsible for ensuring that his/her contact details provided via the entry form at the time of entry are accurate and up to date. The Promoter takes no responsibility for inaccurate or incomplete details.

The prize

13. All travel to be completed before 21 December 2014 otherwise the entire prize is forfeited. Bookings must be made at least 8 weeks in advance of departure, unless otherwise permitted by the Promoter in its discretion.Prize travel is subject to availability at the time of booking and capacity controls. Availability may be limited particularly around peak times such as school holidays. Each winner is encouraged to book as early as possible to increase the likelihood of availability of prize travel. Flight schedules are subject to change without notice. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. There can be no changes made to travel arrangements once tickets have been issued.

14. Each winner is required to redeem both tickets (for the winner and their nominated travel companion) at the same time, for the same flights, traveling to and from the same locations. If the winner is unable to use both tickets at the same time they will forfeit the additional ticket and no compensation will be given in lieu.

15. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. The prize is not transferable to another person (unless agreed to by the Promoter) or exchangeable for other goods and services and cannot be redeemed for cash. Any element of a prize that is unused will be forfeited.

16. Unless otherwise stated, the prize does not include accommodation, flights travel insurance, passports, visas, meals, taxes not included in the price of the ticket, ground transportation, gratuities, merchandise or any other costs not stated. Compliance with any health or other government requirements is the responsibility of each prize winner and their nominated travel companion. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. Prize travel is subject to Qantas’ General Conditions of Carriage.

17. Winners and their travel companions will not accrue Qantas Points on any part of the prize. An upgrade cannot be purchased on airfares with cash or Qantas Points.

18. If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

19. The Promoter reserves the right to refuse to allow a winner and/or a winner’s nominated travel companions to take part in any or all aspects of a prize, if the Promoter determines, in its absolute discretion, that the person is not in the mental or physical condition necessary to be able to safely participate in the prize.

Right of the Promoter to redraw

20. In the event of any entrant being unable to satisfy these terms and conditions or forfeiting or not claiming a prize by 9.00am on 28 April 2014, the Promoter may conduct such further draws on 28 April 2014 at the same time and place as the original draw as are necessary in order to distribute any prizes unclaimed by that date subject however to any written directions given under applicable law. A prize awarded in the unclaimed prize draw must be booked and travelled as set out in clause 13, otherwise the entire prize is forfeited. Any second chance draw prize winner will be notified in writing by email (using the details provided via the entry form on qantas.com/spirit at the time of entry) within 2 business days following the draw and their name published in The Australian newspapers on 02 May 2014. Each winner is responsible for ensuring that his/her contact details provided via the entry form on www.qantas.com/spirit at the time of entry is accurate and up to date. The Promoter takes no responsibility for inaccurate or incomplete details.

Limitation of liability and variation of terms

21. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.

22. The exclusion of liability in clause 21 does not apply to limit or exclude liability:

a) for personal injury or death suffered or sustained in connection with the supply of

goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; and the Promoter’s Conditions of Carriage and general booking conditions (and any exclusions contained therein) apply despite any statement to the contrary in these terms and conditions; or

b) to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).

23. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.

Entry details and privacy

24. Entry details remain the property of the Promoter. The name of winners may be used for promotional purposes by the Promoter, unless a winner otherwise notifies the Promoter at the time of accepting a prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes, (including to MDSA and any applicable statutory authorities). Without limiting the foregoing, entrants’ personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy Statement, a copy of which is available at available at qantas.com/privacy.

Tax implications

25. The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.
