Terms and Conditions – SunSense UV Simulator
1.The Promoter is Ego Pharmaceuticals Pty Ltd (ABN 86 005 142 361). By taking part in the SunSense Competition (the “Promotion”), participants hereby warrant that all information submitted by them is true, accurate and complete.
2.Information on how to enter and prizes form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions. Entries must comply with these Terms and Conditions to be valid.
3.Entry is open to permanent residents of Australia, aged 18 years or older only (“Eligible Entrant”). Employees of the Promoter and their associated agencies and companies and their immediate families are ineligible to enter.
4.The promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing information to the Promoter and not to Facebook.
5.To be eligible to enter, entrants will be required to submit a photograph which adheres to the directions on the competition form (image must be of your entrants face) as well as shared on Facebook with Photo Entry. Entries can be added via sunsense.com.au
6.Entrants may enter multiple times.
7.The prizewinners will be determined through a game of chance, based on their photographic submission at the discretion of Ego Pharmaceuticals. Only valid entries received within the Promotional Period will be considered.
8.Incomplete, indecipherable or illegible entries will be deemed invalid. Entries that contain content that is defamatory, obscene, indecent, threatening to any person, place, business or group, abusive or hateful will be deemed invalid.
9.The Promotion commences at 12.01am AEST 8th November 2013 and closes at 11.59pm AEST 1st May 2014 (the “Promotional Period”).
10.The total prize pool of the Promotion is estimated at $450.
11.Three (3) Major Prizes will be awarded in the Promotion. Prize: 3 x SunSense gift hampers each valued at $150.
12.The winners will be judged at Andmine Pty Ltd, 424 St Kilda Road, Melbourne 3000 on January 31st, 2014; February 31st, 2014 and March 31st, 2014.
13.Prizewinners will be judged and selected 7 days following the close of the Promotion based on their submission (See point 7).
14.The winner of the Major Prizes will be determined as the best submission (See point 7) over the Promotional period.
15.All taxes (excluding GST) which may be payable as a consequence of receiving a prize are the sole responsibility of the winner. Additional expenses and all ancillary costs, including any further freight costs or costs associated with accessing the Promotional website are at the prizewinners’ expense.
16.The prizewinners will be notified by email and their name published on http://facebook.com/sunsense.com.au. It is a requirement that the winner of the prize must be 18 years of age or older to be awarded the prize. If the winner cannot be contacted or does not make himself or herself contactable in accordance with the terms of this Promotion, the Entrant will forfeit any prize.
17.The Promoter’s decision is final and binding and no correspondence will be entered into.
18.The Promoter reserves the right to moderate submissions. All submissions may be moderated. The Promoter reserves the right to disqualify any entrant that submits an image or response that is deemed inappropriate or offensive by the Promoter.
19.Entrants, and persons submitting an entry on behalf of an Entrant, warrant and agree that, without limitation: •they will not submit any material (including without limitation, the entry itself, their date of birth, images, answers to questions, posts or comments) (“Content”) that is obscene, sexually explicit, violent, offensive, inflammatory or defamatory. The Promoter does not accept or condone any entry or submission that: •contains any copyright content not belonging to the entrant;
•condones or promotes illegal activity;
•is derogatory to members of a particular race, nationality, sex, sexual orientation or religion or incites hatred of particular groups;
•is abusive, bullying, is cruel to animals;
•is spam;
•that in any way exposes private information, depicts violence, compromises any person’s safety, depicts cigarettes, alcohol, drugs or nudity; or
•is not suitable for children under 15, or otherwise unsuitable for publication;
•they will only submit Content which they have personally created or have the right to submit; their entry will not contain viruses or cause injury or harm to any person or entity;
•if the entry is on behalf of a person other than themselves, they have obtained that person’s consent to their entry into this Promotion, and where entering a child, they have the approval of all parents and/or legal guardians of the child;
•they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems;
•they have the full authority to grant to the Promoter the rights referred to in this document; and
•they will indemnify the Promoter against all costs and claims by third parties arising from a breach of the warranties contained in this document.
20.Entrants, and persons submitting an entry on behalf of an Entrant, agree: •they are fully responsible for the content of the entries which they submit. The Promoter may, in its sole discretion, determine whether an entry will be posted, or remain posted on its website. Notwithstanding any decision by the Promoter to post material on its website, the terms and warranties set out in these Conditions of Entry continue to apply;
•that upon submission, they license and grant to the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, communicate, publish and display the Content for any purpose in any media, without compensation, restriction on use, or liability and the owner of any copyright in the Content consents to any use of their Content which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth);
•to waive, and hereby do waive, any legal or equitable rights or remedies they have or may have against the Promoter with respect to the entries they submit and their use of the Promotion Website, and agree to indemnify and hold the Promoter, its officers, agents and affiliates harmless to the fullest extent allowed by law regarding all matters related to their use of the site;
•to report abuse, harassment, inappropriate content or privacy complaints by customerservice@egopharm.com. The Promoter reserves the right to remove any content from the Promotion Website without prior notice in its sole discretion, including if properly notified that such material infringes on another’s intellectual property rights.
21.By posting a photo in our competition you hereby grant to Ego Pharmaceuticals a non-exclusive, royalty-free, worldwide, revocable, non-transferable, perpetual licence to use, modify, delete from, add to, publicly display and/or reproduce, your photo, including without limitation in any online media formats and through any social media channels, pages or accounts. You can revoke this licence at any time by contacting us in writing via customerservice@egopharm.com and informing us that you no longer want us to use your photo.
22.Without limitation, Entrants will not be entitled to any additional modelling fees, talent fees or other payment in respect of the use of the Information and Images by the Promoter. The Promoter shall have sole discretion in relation to the use of the Information and Images for its marketing, advertising and promotional campaigns. The Promoter also has the unlimited, perpetual right to use such information and images for internal non-commercial purposes.
23.The Promoter reserves the right to request verification of age, identity, residential address of winners at the nominated prize delivery address and/or proof of entry validity and other information relevant to entry into or participation in this Promotion. Verification is at the Promoter’s discretion, whose decision is final. The Promoter reserves the right to disqualify any individual who is involved in any way with interfering or tampering with the conduct of the Promotion.
24.Prizes are not transferable and are not redeemable for cash. The Promoter’s decision is final and binding – no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if forged, manipulated or tampered with in any way.
25.If necessary, the Promoter may choose another winner if prize goes unclaimed for 2 months in order to distribute any unclaimed prizes. All non-winning entries will be included in the unclaimed prizewinner selection. In the event of any winners in the unclaimed prize selection, the winners will be notified by phone and their names published on http://facebook.com/sunsense.com.au.
26.Prize values are correct at time of Promotion launch but no responsibility is accepted for any variation in the value of any prizes.
27.The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify the Promotion.
28.The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law. The Promoter is not responsible for: •any problems or technical malfunction of any computer, online systems, servers, service providers;
•any software failure or any email failure
•any entry not received due to technical problems with the internet, telephone lines or any website including but not limited to Facebook;
•any injury or damage to an entrant’s computer or mobile telephone;
relating to or resulting from participation in the Promotion.
29.Any cost associated with accessing the promotional website is the Entrant’s responsibility and is dependent on the Internet service provider used.
30.Details from entries will be collected and used for the purposes of conducting this Promotion (which may include disclosure to third parties for the purpose of processing and conducting the Promotion) and for Promotional purposes surrounding this Promotion. By entering this Promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future Promotional purposes without any further reference or payment to the entrant. Entrants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting the Promoter on 03 9586 8800 during office hours. All details contained in each entry are protected by Australian privacy laws.
31.To the extent permitted by law, the Promoter, its employees, and agents shall not be liable for any claims, damages, injuries, costs, and expenses suffered, sustained or incurred (including but not limited to indirect or consequential loss) as a result of, or arising out of, or in any way connected with this competition and/or its prizes or any act or omission (whether negligent or not) of the Promoter, its employees and agents.
32.If for any reason the Promotion is not capable of running as planned (including, but not limited to, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity, reputation or proper conduct of this Promotion) and, to the extent permitted by law, the Promoter reserves the right to vary the rules of any competition or any rewards offered or cancel any competition if it is no longer able to run the competition due to reasons beyond its control. The Promoter will not be liable for any loss or damage to any party arising from any variation or cancellation.
33.. If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
34.The laws of Australia apply to this Promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
