OFFICIAL RULES
1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2. Eligibility. The Rare Under 40 Awards Contest (the “Contest”) begins on September 14, 2015 at 12:01 a.m. Eastern Time (E.T.) and ends on November 4, 2015 at 11:59 p.m. E.T (“Contest Period”). Sponsor will be the official timekeeper for the Contest. Only individuals who are over the age of 18, or the age of majority in their jurisdictions, and under the age of 40 at the time of entry are eligible for consideration as official entrants and potential winners of this Contest. Void where prohibited. Employees of Cox Media Group, LLC d/b/a Fans 1st Media (“Sponsor”), and each of its respective parent/affiliated companies, subsidiaries, affiliates, advertising agencies, public relations agencies and prize suppliers (including any vendors providing services in connection with this Contest) (collectively, the “Sponsor Affiliates”), as well as employees, representatives, agents, directors, and officers of Sponsor or any Sponsor Affiliates, members of their immediate family (i.e., spouse, mother, father, mother-in-law, father-in-law, grandmother, grandfather, brother, sister, children, or grandchildren), regardless of where they live and persons domiciled with them are not eligible for consideration under this contest.. Professional actors and filmmakers, whether full-time or part-time, are allowed to compete so long as they do not belong to any professional organizations connected with the entertainment industry that would cause Sponsor to pay the entrant or any other person a fee or any other benefit for taking part in any Contest event.
3. Nominations. Anyone can submit a nomination for entry in the Contest starting on September 14, 2015 at 12:00 a.m. ET through October 31, 2015 at 11:59 p.m. ET (“Nomination Period”).
You may nominate as many individual persons under the age of 40 as you wish who you believe deserves recognition by going to http://rare.us/story/the-rare-under-40/ (the “Website”) and completing all of the required information and following all posted instruction. You may nominate yourself or others. By participating in the Contest, you agree to be bound by Sponsor’s Visitor Agreement and Privacy Policy (http://rare.us/visitor-agreement/) and (http://rare.us/privacy-policy/), which are hereby incorporated by reference.
As part of the registration process, you must upload your original video. Entries that are in compliance with these Official Rules could be posted to the Website as they are received, reviewed, and verified by Sponsor. You may enter the Contest as often as you like but a maximum of one (1) prize will be awarded per person.
Sponsor, in its sole discretion, will deem whether a nomination is in compliance with these official rules and all posted instructions, in determining when the nomination becomes an official Entry.
4. How to Enter: Sponsor, in its sole discretion, will determine which nominations comply with the official rules and all posted instructions, and, finding compliance and eligibility, will deem those nominations as official Entries into this Contest.
The use of multiple identities and/or accounts is prohibited, and any attempt to obtain more than the stated number of entries will void that participant’s entries and may result in participant’s disqualification. Incomplete, forged, altered, automated, mechanically-reproduced, lost, late, misdirected, garbled, or illegible entries, or entries that do not meet the size or formatting requirements specified above, will be disqualified. Sponsor will not be responsible for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender, Sponsor, or Sponsor’s Contest application service provider. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent, provided that such person satisfies all other Contest eligibility requirements. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account.
All entries become property of Sponsor and none will be returned. Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons who submit false or misleading entry information or who Sponsor determines to be tampering with or abusing any aspect of the Contest.
By participating in this Contest you unconditionally agree to these Official Rules, Sponsor’s Terms of Use and the Privacy Policy located in the footer of the Website. Failure to comply with the Official Rules, the Terms of Use, or Privacy Policy (as determined within the sole discretion of the Sponsor) may result in disqualification.
5. Entry Restrictions. Each entry (including any Photo or Video): (1) must be suitable for a general audience; (2) cannot contain any nudity, sexually explicit, disparaging, libelous or other inappropriate content (all as determined in the sole discretion of Sponsor); (3) cannot contain any commercial content that promotes any third party product(s) or service(s); (4) cannot contain any trademarks, copyrighted works or other intellectual property except for works and intellectual property that you own, or for which you have obtained royalty-free and unrestricted right for Sponsor to use in connection with this Contest (collectively, “Authorized Assets”). Any elements appearing in your entry must be entirely original, created by you, be in the public domain, or be an Authorized Asset. Use of any materials that are not original to you, not in the public domain, or that are not an Authorized Asset may result in disqualification. Sponsor reserves the right to disqualify any entry that violates the foregoing restrictions, as determined by Sponsor in its sole discretion.
You further represent and warrant to Sponsor and Sponsor Affiliates that you have obtained the express approval and permission from any person who may appear or be mentioned in any way in your entry, and Sponsor and Sponsor Affiliate’s use of your entry (including, without limitation, the Photo or Video) will not result in the infringement of any copyright, trademark, right of publicity, privacy or other legal right of any third party.
6. Winner Selection. From October 31, 2015 to November 4, 2015 (“Judging Period”), a Judging Panel, consisting of Rare.us. management team members, selected in Sponsor’s sole discretion, will judge eligible entries and determine the potential winners of this Contest, basing their decision on the following criteria (“Criteria”): (1) Inspiration depicted in the entry (50%); (2) Risks depicted in the entry (25%); and (3) Entry clarity composition (25%). The entrants with the highest cumulative scores will be designated potential winners. All decisions of the Judging Panel are final. All decisions as to fulfillment of the Criteria are final.
The number of winners chosen by the Judging Panel will depend on the quantity and quality of entries received during this Contest. The odds of winning will depend on the number of entries received.
Sponsor reserves the right to modify these Official Rules, including any of above dates (including but not limited to the Nomination Period, the Judging Period, and the date of selection of the potential winner), if Sponsor (in its sole discretion) deems such modification necessary to ensure fairness and/or preserve the spirit or goals of the Contest, where necessary.
7. Prize Description.
Grand Prizes: Subject to verification of eligibility and compliance with these Official Rules, all winners receive round trip economy class air fare for winner and one (1) guest from the major continental U.S. airport nearest winner’s home (as determined by Sponsor in its sole discretion), one (1) night double occupancy hotel accommodations (one (1) standard room only) at a hotel chosen by Sponsor in its sole discretion, and tickets for two (2) for admission to the Rare Under 40 Awards Dinner, scheduled to be held in the Spring of 2016 at a venue in Washington, D.C, which will be communicated to winners prior to the Rare Under 40 Awards Dinner in Sponsor’s sole discretion. Sponsor will determine airline, flight itinerary, and seating in its sole discretion. If winners cannot travel during the specified travel dates, then he or she will forfeit the entire Grand Prize.
Winners will also be featured on the Rare.us site and all press releases promoting the awards. Winners will receive a plaque commemorating their honor.
All expenses and incidental travel costs not expressly stated in the prize package description above, including costs of meals, parking, ground transportation, gratuities, transportation to and from airport, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes, and all other expenses not specified above, are the sole responsibility of Grand Prize winner. Prize may be subject to blackout periods, and other restrictions may apply. Travel is subject to the terms and conditions set forth in this Contest and those set forth by the Sponsor’s airline carrier of choice, as set forth in the passenger ticket contract. Grand Prize winner and guest are responsible for obtaining any insurance (including but not limited to, any travel or health insurance).
The ARV of the trip package may vary depending on location of major airport nearest to winner’s home, travel itinerary, and costs of air transportation at time of award. Winners will not receive the difference (if any) between actual and estimated retail value. If, in the sole judgment of Sponsor, air travel is not required due to a winner’s proximity to the prize location, ground transportation will be substituted for round trip air travel at Sponsor’s sole discretion.
Winners and travel companion are responsible for obtaining identification documents necessary for travel. Winners may be required to present a credit card at time of hotel check-in. Winner and travel companion must travel on identical itinerary. Unless a child a winner, guest must be at least eighteen (18) years of age as of the date of departure. If winner does not designate a guest in accordance with these Official Rules, no consideration will be provided to the winner for the value of the guest’s portion of the prize package. Winners must provide Sponsor with the name, address, and date of birth of his/her guest by January 31, 2016. If winner changes his/her guest after January 31, 2016 winner will be required to pay any flight transfer fees imposed by the airline carrier. No credit or cash will be given for any unused portion of the Grand Prize.
No refund or compensation will be paid in the event of the cancellation or delay of the Rare Under 40 Awards, or any portion thereof. Sponsor will not be liable if the Trip/Event, or any portion of it, is cancelled or delayed. Sponsor may, in its sole discretion, attempt to reschedule for a future trip/event. Trip/Event tickets are subject to certain terms and conditions as specified by issuer. The terms and conditions of the Trip/Event tickets may govern if the Trip/Event is cancelled due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Sponsor is not responsible for, and will not replace, lost, mutilated, or stolen Trip/Event tickets, vouchers, or certificates. Exact details, including seat locations, shall be determined in the sole discretion of Sponsor.
Neither Sponsor nor Sponsor Affiliates make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Contest or any prize. Prize details and availability are subject to change, in which case a prize of equal value may be substituted at Sponsor’s sole discretion. Prizes consist only of the items listed, are non-transferable, with no cash redemption or substitution except at Sponsor’s sole discretion. Federal, provincial or local taxes on prizes, if any and any other costs, fees or expenses not listed above are your sole responsibility.
8. Winner Notification and Acceptance. The potential grand prize winners will be notified by available phone number or mail/email address, as determined solely by Sponsor. To claim the Grand Prize, Sponsor may require the potential winner to complete, sign, and return Affidavit of Eligibility/Liability Release/Publicity Release forms, and other applicable documents, postmarked within ten (10) days of the date on the notification. If a potential winner cannot be contacted, fails to timely claim the prize, is disqualified, fails to timely execute and return any required forms, or if the prize notification is returned as undeliverable, an alternate potential winner will be selected from among the other eligible Finalists, as determined by the Panel. Under no circumstances will more than the advertised number of prizes be awarded.
In order to claim a prize, winners must respond to Sponsor’s notification within forty-eight (48) hours of notice or attempted notice.
Potential winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law), which must be notarized and returned within 5 days/hours of notification and a written commitment to attend the Rare Under 40 Awards in Washington, D.C. in April. Persons traveling as a guest of the winners must also sign any affidavit or release that Sponsor may require.
Sponsor’s inability to reach a potential winner after a reasonable (as solely determined by Sponsor) effort has been made, the failure of a potential winner to timely respond to a prize notification, the return of any prize notification as undeliverable. The inability of winner and his/her guest to travel within the time period specified by Sponsor, and/or a potential winner’s failure to comply with any term or condition of these Official Rules may, in Sponsor’s sole discretion, result in the potential winner’s disqualification and the selection of a substitute winner by based upon the judging criteria. Sponsor will select up to three (3) alternate potential winners, after which the prize will remain unawarded.
A PARTICIPANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL SPONSOR HAS COMPLETED ITS VERIFICATION OF PARTICIPANT’S ELIGIBILITY.
A winner may waive the right to receive a prize. Prizes are non-assignable and nontransferable and cannot be redeemed for cash. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability. Sponsor reserves the right to substitute prizes or components of prize packages with a prize or component of equal or greater value. Winner is solely responsible for reporting and payment of any taxes on a prize. Winner may be required to provide his/her valid Social Security Number to Sponsor for tax purposes and/or complete an IRS W-9 form in order to claim a prize. Winners are solely responsible for all federal, state and local taxes on prize value and, as applicable, will be issued an IRS Form 1099 based on the prize value determined by Sponsor. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor.
Prizes won by minors will be awarded to the winner’s parent or legal guardian, who must sign any affidavit or release required by Sponsor. If one of the winners is a minor, then his/her guest must be his/her parent or legal guardian. A legal guardian must provide written proof of guardianship.
9. Participation. By participating, participants agree to be bound by these Official Rules and the decisions of Sponsor and any Contest judges or administrators selected by Sponsor, which are final and binding in all respects. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention,tampering or other causes beyond the reasonable control of Sponsor which corrupt or impair the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date. Proof of sending or submission of an entry will not be deemed proof of receipt by Sponsor.
10. Authorization. BY ENTERING THE CONTEST, YOU REPRESENT AND WARRANT THAT (I) YOUR ENTRY IS ORIGINAL, WAS LEGALLY OBTAINED AND CREATED, AND DOES NOT INFRINGE THE INTELLECTUAL PROPERTY RIGHTS OR OTHER LEGAL, EQUITABLE, OR MORAL RIGHTS OF ANY THIRD PARTY; (II) YOU HAVE OBTAINED PERMISSION TO SUBMIT YOUR ENTRY FROM EVERYONE NAMED, DESCRIBED, OR APPEARING IN YOUR ENTRY AND FROM THE OWNERS OF ALL LOCATIONS APPEARING IN YOUR ENTRY, AND YOU CAN MAKE THOSE AUTHORIZATIONS AVAILABLE TO SPONSOR UPON REQUEST; (III) THE ENTRY YOU ARE SUBMITTING HAS NOT PREVIOUSLY BEEN PUBLISHED OR ACCEPTED FOR PUBLICATION AND IS NOT CURRENTLY UNDER CONSIDERATION FOR PUBLICATION; AND (IV) YOU WILL NOT DISSEMINATE OR OTHERWISE SUBMIT YOUR ENTRY TO ANY OTHER ENTITY FOR PUBLICATION.
11. Publicity and Marketing. BY ENTERING THE CONTEST, YOU AGREE THAT SPONSOR AND ITS SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) HAVE THE ABSOLUTE RIGHT AND PERMISSION TO PUBLISH YOUR ENTRY ON THE WEBSITE AND TO BROADCAST, PUBLISH, OR OTHERWISE USE (IN ANY OTHER CHANNEL OR MEDIUM) YOUR ENTRY, INCLUDING THE PHOTO, YOUR BUSINESS NAME, BIOGRAPHICAL AND OTHER INFORMATION PROVIDED AS PART OF YOUR ENTRY FOR ANY COMMERCIAL, PUBLICITY, OR PROMOTIONAL PURPOSE WITHOUT LIMITATION, REVIEW OR APPROVAL, OR COMPENSATION TO YOU. BY ENTERING, YOU GRANT THE RELEASED PARTIES AN EXCLUSIVE, ROYALTY-FREE AND IRREVOCABLE LICENSE AND RIGHT (BUT NOT THE OBLIGATION) TO TELECAST, BROADCAST, COPY, EDIT, ADAPT, MODIFY, REPRODUCE, PUBLISH, CREATE DERIVATIVE WORKS OF, DISTRIBUTE, USE, OR OTHERWISE PUBLICLY DISPLAY ANY OR ALL OF YOUR ENTRIES, OR ANY PORTION THEREOF (INCLUDING ANY VIDEOS, PHOTOS OR OTHER CONTENT SUBMITTED OR PROVIDED TO SPONSOR), IN ANY MANNER OR MEDIUM THROUGHOUT THE WORLD IN PERPETUITY, FOR COMMERCIAL, PUBLICITY, OR PROMOTIONAL PURPOSES, AND TO LICENSE OTHERS TO DO SO, WITHOUT LIMITATION, REVIEW OR APPROVAL, OR COMPENSATION TO YOU.
12. NO LIABILITY & INDEMNIFICATION: Sponsor and Sponsor Affiliates are not responsible for and entrants release each from any failures of any kind (whether caused by computer, technical, or human error) which may either limit the entrant’s ability to submit an entry, claim a prize, or otherwise participate in this Contest, or Sponsor’s ability to include all eligible entries, notify potential winners, or otherwise execute this Contest in the manner intended. Entrants further release and agree to indemnify Sponsor and Sponsor Affiliates from any and all liability, claims or actions of any kind whatsoever arising from injuries, damages, or losses to persons or property (including, without limitation, real property and personal property) which may be sustained in connection with this Contest including, but not limited to: (a) your participation in this Contest; (b) the receipt, ownership or use of any prize awarded; and (c) your breach of any of the terms in these Official Rules.
13. OTHER TERMS: Decisions of Sponsor and/or the Panel on all matters related to the Contest are final. Sponsor reserves the right to cancel or modify the Contest for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the Contest, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Contest as determined by Sponsor, in its sole discretion, where necessary. Sponsor reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in these Official Rules. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL & CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES FROM ANY INDIVIDUAL MAKING ANY SUCH ATTEMPTS TO THE FULL EXTENT PERMITTED BY LAW.
14. RIGHT TO DISQUALIFY: Sponsor reserves the right to disqualify or prohibit your participation in this Contest if fraud or tampering is suspected; if you fail to comply with any requirement of participation or with any provision in these Official Rules; if the nature of your business and/or your behavior or communication at any point is disruptive, may or does cause damage or to any person, property, or to the reputation of Sponsor, or is otherwise not in accordance with all applicable laws and generally accepted social practices, all as determined in Sponsor’s sole discretion.
15 SPONSOR and WINNER LIST: The Rare Under 40 Awards is sponsored by Cox Media Group, LLC d/b/a/ Fans 1st Media. The decisions of Sponsor regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials or announcements relating to the Contest.
