The petitioner included with the petition an expert report which was 287 pages long with 1,278 paragraphs. The expert report itself cites to a 1,003 page, single-spaced, claim chart in landscape format. The claim chart then cites to the prior art references relied upon for the allegations of claim invalidity. The Board concluded that the references in the petition amounted to an incorporation by reference of arguments in the declaration. The petition itself did not included sufficient information to demonstrate that the claimed subject matter was shown in the cited references. Therefore, the petition was denied.
