Well... I met with my attorney who spend the last week working with the AUSA on my plea. Finally got the AUSA to agree to a joint recommendation of the minimum sentence, 54 months. Under the agreement, we were not allowed to argue for lower. They would not argue for more. We would agree to complete restitution and forfeiture.

I had originally been scheduled to appear before a notoriously conservative judge, who recently upheld conservative abortion bans, supported Kansas gerrymandered re-districting and consistently sided with big corporations.

Then, a miracle, due to scheduling, I was re -assigned to a liberal judge for sentencing who has a reputation as being a compassionate judge.

Then, another schedule conflict, and I was back to my original judge.

Today was the day. My attorney came dangerously close to violating our agreement. He said he knew could argue for less, but that he was "bitter" about it. He asked the judge how a multiple time offender for firearm pocession could get less time?

I gave an overly emotional account of my feelings. I explaned how this was UNLIKE anything I had ever done, in my 41 years. I offered NO EXCUSES, NO JUSTIFICATIONS... just my sincere apology and remorse.

I got 36 months.

My attorney, said in 37 years of working with this judge, he had never seen her go below guidelines. The judge also recommended RDAP. My PSI has alcohol abuse listed in it.

IF, and its a big IF, I can get into RDAP, I could be out in under 2 years. It was a good day.
