The Complaint alleges that Plaintiff and other truck drivers working for the company in California performed the manual task of transporting goods for Bhandal Bros and were allegedly paid on a piece-rate basis and allegedly only paid for their non-production time. The Complaint asserts that the truck drivers were not paid minimum wages because of Bhandal Bros alleged failure to record all time worked, including time spent working while not actually driving the truck.

The class action Complaint filed against Bhandal Bros by the San Francisco labor law attorneys at Blumenthal, Nordrehaug & Bhowmik also alleges that the trucking company failed to have a policy which provided a full off-duty, thirty minute uninterrupted meal break to their truck drivers. The company's alleged failure to provide the legally required meal and rest breaks is evidenced by their business records which contain no evidence of these breaks the Complaint claims.
