The U.S. Department of Housing and Urban Development (HUD) recently issued fair housing guidance this year to prohibit the use of arrest records for tenant screening. In order to help housing providers adhere to these new guidelines, tenant screening services needed to update the reports and to eliminate the use of arrest records.
Rentec Direct provides tenant screening reports to landlords and property managers nationwide. A tenant screening report can include a renter’s credit report, criminal record, and eviction history which can be legally reviewed by a landlord with the renter’s permission.
HUD enforces policies outlined in the Fair Housing Act which prohibits housing discrimination on the basis of race, color, religion, sex, disability, familial status or national origin. HUD recently examined how housing providers were using criminal history for rental applicants and were found to unfairly screen certain types of criminals or types of crimes and even deny housing to applicants based on arrest records but not convictions. In order to prevent this type of discriminatory effect and disparate treatment that leads to adverse housing action, HUD created these new policies.
