Very few people realize that one of the prime innovators and brilliant legal minds of Criminal Defense, Immigration Law, and Deportation/Removal Defense Litigation is none other than Attorney Rahul Manchanda of Manchanda Law Office PLLC. Back in the early 2000s, Attorney Rahul Manchanda, like other immigration and criminal defense lawyers in the United States, were growing increasingly frustrated that in the wake of September 11, 2001, many of his clients were facing unprecedented arrests, incarcerations, and deportations from the United States, even for petty non-violent, non-drug related crimes such as shop-lifting or jumping a subway turnstile.

These types of mass arrests and incarcerations would often leave entire families fractured and broken apart, often forcing the prime family breadwinner to leave his home and be thrown into a foreign country, thousands of miles away, while his family was forced to fend for themselves. Most often, the criminal convictions would appear from decades prior, and the individual would be arrested or detained while returning back into the United States from overseas travel, or have his/her greencard stripped away from them during a routine traffic stop or when taking public transportation where IDs were required.

This was of course AFTER the affected individual had already paid his debt to society, had rebuilt his/her life, paid taxes, attended church or other religious institution, established a solid work schedule, and had otherwise rehabilitated themselves to become a productive and law-abiding member of American society.

These “casualties of war” included the families and children of the affected immigrant, often forced to grow up with no father or mother, and having their idyllic life broken apart into thousands of pieces by a cruel and unusual federal and state criminal and judicial apparatus with no hope for the future.

In 2002, eight years before the seminal US Supreme Court case of Padilla v. Commonwealth of Kentucky, 559 U.S. 356 (2010), wherein the United States Supreme Court decided that criminal defense attorneys must advise noncitizen clients about the deportation risks of a guilty plea, Attorney Rahul Manchanda and several of his criminal defense law associate attorneys developed a tried and proven method of challenging the underlying criminal conviction with a 440 Motion to Vacate the Criminal Conviction and to either remove, vacate, or amend the plea agreement because the immigrant was never properly advised (or even at all) of the devastating immigration consequences of taking a plea which could affect his/her immigration status.

Eventually the US Supreme Court caught up with Attorney Manchanda’s visionary legal innovations and Kentucky v Padilla extended the Supreme Court’s prior decisions on criminal defendants’ Sixth Amendment right to counsel to immigration consequences.

The duties of Counsel recognized in Padilla are broad. After Padilla, if the law is unambiguous, criminal defense attorneys must advise their criminal clients that deportation will result from a conviction. Also, if the immigration consequences of a conviction are unclear or uncertain, criminal defense attorneys must advise that deportation “may” result. Finally, attorneys must give their clients some advice about deportation: in other words criminal defense counsel cannot remain silent about immigration.

After Padilla, there has been significant litigation in the lower courts about whether attorneys are required to advise their criminal clients about other consequences of convictions. Millions of lives have been saved because legal practitioners and their criminal defense or immigration clients no longer have to blindly accept that they have an aggravated felony or crime of moral turpitude on their record, thus mandating deportation, but rather they can now challenge their convictions backed up by a US Supreme Court decision which fully understands and grasps their difficult situation.

Professor and Attorney Rahul Manchanda worked for one of the largest law firms in Manhattan where he focused on asbestos litigation. At Boston University, Attorney Rahul Manchanda received a Bachelors degree in Biology, distinguishing himself in the chemical and biological sciences and doing extensive research in organic chemistry in field and laboratory work relating to organic synthesis and isolation, Nuclear Magnetic Resonance, structure determination, and production of synthetic bio-active natural products.
