No. 1: Identify all potential claims and sources of recovery. “It is imperative in these types of cases that counsel identify all potential claims and sources of recovery — from the automobile driver that crashed into the bicyclist or pedestrian to the governmental entity responsible for maintaining traffic signals or painting street lines,” said Arter.

No. 2: Understand the dynamics of cycling. Arter also stresses that counsel in bike crash cases familiarize themselves with the dynamics of bicycling, including what is reasonable with regard to speed and hazard perception. “Cities often have particular ordinances regarding the proper riding of bicycles on city streets and thoroughfares,” said Arter. “Many cities have ordinances against bicyclists riding on the sidewalk and the bicyclist’s direction of travel. Bicycles should be ridden in the same direction of travel as motor vehicles.”

No. 3: Collect and preserve evidence. “Collecting and preserving evidence, including social media evidence, using experts and overcoming affirmative defenses, poses a unique challenge for counsel, but is crucial,” said Arter. “Practitioners must also understand effective approaches to negotiating with insurance companies in these cases.”
