New ET1 and ET3 Forms Published
Following the introduction of a fee-charging regime for Employment Tribunal and Employment Appeals Tribunals, HM Courts and Tribunals Service have introduced new forms to be used from 29 July 2013:
ET1
This form is used to make a claim to the above Tribunals and must be accompanied by the coversheet which will enable Tribunal staff to determine whether the correct fee has been paid / is appropriate.
ET3
This form is used to respond to a claim that has been made to the above Tribunals.
Note that previous versions of the forms are still regarded as ‘prescribed forms’ and will not be rejected.
Comment
The Presidential Practice Direction – Presentation of Claims has also been published, detailing the methods by which a completed form can be submitted (under Rule 8 in the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013):
Online using HM’s Courts and Tribunal Service
By post to the Employment Tribunal Central Office in Leicester
In person at one of the regional Offices
The Direction is clear that, from 29 July 2013, any application without the appropriate fee (or remission application) will be rejected (Rule 8).
