A 66-year-old Nebraska woman doesn’t have almighty power to sue all homosexuals in the United States, a federal judge has ruled.
Judge John Gerrard dismissed Sylvia Driskell’s lawsuit on Wednesday, where she was seeking to have the court decide if homosexuality is a sin.

Gerrard said Driskell lacked subject matter jurisdiction and cannot sue a class of unidentified defendants. Driskell did not set forth a factual or legal basis for a federal claim.
“The United States Federal Courts were created to resolve actual cases and controversies arising under the Constitution and the laws of the United States,” Judge Gerrard said. “A federal court is not a forum for debate or discourse on theological matters.”
Driskell was suing under Section 1983 of Title 42 of the U.S. Code, which is place so citizens can sue their state and local officials for violating their constitutional rights.
Gerrard did not allow Driskell a chance to amend the complaint.
