Kate Mewhinney

Activities

Supervised students in the spring semester in the representation of sixty clients on a variety of civil matters, including litigation, estate planning, Medicaid planning, consumer law and other issues.

Served as a consultant to the Forsyth County Elder Abuse Task Force, made up of law enforcement and several agencies.

Re-certified as an elder law specialist by the National Elder Law Foundation, the only ABA-approved elder law certification.

Applied for recertification as an elder law specialist by the N.C. State Bar Board of Legal Specialization.

Selected by attorneys to serve as mediator in a contested guardianship matter in Wake County, resulting in successful resolution. Mewhinney is a Superior Court Mediator with special certification to handle estate and guardianship disputes.

Served on the Board of Directors of the Adam Foundation, which raises money for a range of LGBT-related issues.  The Adam Foundation, which is twenty-five years old, contributed $50,000 to several local non-profits in 2014 and also started the first LGBT-focused endowment fund with the Winston Salem Foundation.

Completed “Safe Zone” training administered by the university’s LGBTQ Center, on creating and maintaining a safe environment for LGBTQ students, staff and clients.

Gave presentation at the Sticht Center on Aging and Rehabilitation (Wake Forest Baptist Medical Center) to the Alzheimer’s Patients Family Caregivers Group, on legal issues related to dementia and caregiving.

Mark Rabil

Activities

Innocence & Justice Clinic (2013-14):  with remarkable assistance from I&J Fellows Kelly Lantz (’13) and Jay Kyler (’13), and outstanding clinic students in Fall and Spring  semesters, as well as Summer Session, reviewed over 300 claims of innocence from inmates – including travel with students to numerous prisons across the state, accepting several dozen for further investigation, including the filing of state and federal post-conviction motions for clients with claims of innocence.

Contemplative Pedagogy Community, Fall 2013-Spring 2014:  worked with other professors from the University in an effort to incorporate mindfulness practices into our teaching; sponsored by the University’s Teaching and Learning Center.

Expunction Clinic (2013-14):  in conjunction with Darryl Hunt, volunteer students from the law school’s Pro Bono Program, and attorneys from the Legal Aid Society, worked with people in the community who may be qualified for expunctions of their criminal records, or “certificates of relief” which allow convicted offenders to avoid some of the collateral consequences of certain non-violent, criminal convictions; meets twice a month at ESR in Winston-Salem.

April 9-12, 2014:  attended International Innocence Network Conference, Portland, Oregon.

Capital Case – Summer 2013:  with assistance from students in the Innocence & Justice Clinic, saved indigent client from El Salvador from death penalty, which was stricken from the first degree murder case on grounds of intellectual disability (formerly called “mental retardation”); worked with summer clinic students to organize and conduct focus group for this murder case in order to determine jury selection topics and case themes; students then assisted with first degree murder trial in which defense was false confession.

Coalition for Alternatives to the Death Penalty and The Episcopal Church of the Ascension sponsored “An Evening with Darryl Hunt and Mark Rabil,” at SALT Block Auditorium, Hickory, N.C., for a discussion on capital punishment and innocence cases.

May 27, 2014 – presentation, along with Darryl Hunt, to class on “Advocacy, Debate and the Law,” a class taught by Professors Chris Coughlin and Wilson Parker, along with faculty members from the Department of Communication, to undergraduate students interested in law school.

March 20, 2014:  spoke to Prof. Mark Gibney’s political science class at UNC-Asheville on innocence cases, capital punishment and the criminal justice system, in conjunction with Tarrah Callahan, Director, NCCADP, Darryl Hunt, and D.J. McIntee (’13).

March 11, 2014:  Presentation to Winston-Salem Dharma Group about “Mindful Lawyering.”

March 6, 2014:  West Forsyth High School – spoke to civics class about criminal justice system along with Darryl Hunt.

February 20, 2014:  along with Darryl Hunt, spoke to undergraduate students attending Seminar on Non-Violent Social Change facilitated by Civil Rights Leader Dr. Vincent Harding.

January 24, 2014:  presentation at North Carolina Advocates for Justice Capital Defense Seminar on Defending Central American Clients with Intellectual Disabilities, with extensive discussion of the 2013 murder trial of the El Salvadorean client.
