Geoff Morrell, BP’s spokesperson, recently opined in multiple southern newspapers that law firms are filing oil spill claims under BP’s business economic loss program not only for their clients, but also for their own accounts. Oh, the horror!
Pray tell Mr. Morrell, are law firms not businesses like any other? If affected by the spill, are they not as deserving as any other professional service company that was devastated by BP’s Deepwater Horizon Blowout? What about doctors, veterinarians, architects, dentists and engineers? Are those “real” businesses entitled to file claims for economic loss whilst law firms are not?
Let’s see, how could a law firm have possibly been harmed by BP’s spill? Well, when tourism stopped, development and construction stopped. Thus construction lawyers saw a significant hit to their earnings. Real estate lawyers had no closings to oversee as who wants to buy beachfront property in the midst of the largest marine disaster the world has ever seen? Land use attorneys had no zoning hearings to attend as developers fled the area. Thankfully, with fewer tourists in town there were fewer auto accidents, DUI’s and bar fights for lawyers specializing in those practice areas.
While I know from the public’s perspective there is no love lost for attorneys, BP’s attempt to exploit that sentiment is logically flawed. If BP didn’t want law firms to participate as any other business, the company could have added lawyers and attorneys to its exclusion list.
To BP’s credit, the list (below) is quite long and detailed. The company clearly put substantial effort into deciding who to exclude. Some examples of excluded entities found on BP’s exhaustive list include bingo parlors, bookies, snowmobile racetracks, pawnshops, contact lens insurance companies, fractionating natural gas liquid businesses, and some type of company that specializes in – and I’m not making this up – “drilling rat holes and mouse holes at oil and gas fields.”
Are we really to believe that BP forgot to include an industry as basic as law on that list?
