BACKGROUND

UN-Habitat has been actively supporting Kosovo institutions and municipalities in the fields of governance, spatial planning and capacity building since 1999. The Municipal Spatial Planning Support Programme (MuSPP) is in its third phase, covering the period November 2011 - October 2014. The support programme is financed by the Swedish Development Cooperation, and is being implemented in twelve Kosovo municipalities through local MuSPP field offices and with the head office located in Pristina. UN-Habitat staff in the local offices works together with their municipal counterparts and other officials on various planning and capital projects, supported by head office staff. MuSPP is also providing support to the Ministry of Environment and Spatial Planning (MESP), the Association of Kosovo Municipalities (AKM) and other central level institutions.

The overall development objective of MuSPP3 is to contribute to the sustainable development of Kosovo cities, municipalities and neighbourhoods through participatory methods that improve the living conditions of all residents of the partner municipalities and help reduce poverty.

Addressing environmental concerns is one of the important priorities in Kosovo on its orientation towards European integration process. The Government of Kosovo has approved in October 2013 the National Strategy and Action Plan on Waste Management. These documents recognise that the pollution caused by improper waste management is one of the greatest environmental challenges in Kosovo. Several MuSPP3 partner municipalities have identified solid waste management as one of the most critical issues they are currently facing in the environmental field, and two municipalities have requested MuSPP for specific support on this matter, namely by updating their Local Waste Management Plans in face of the recent National Strategy and Action Plan on Waste.

PURPOSE OF THE ASSIGNMENT

These ToR are meant for the improvement of the environmental planning situation at the municipal level and in line with the EU Waste Framework Directive, or Directive 2008/98/EC, and with Kosovo’s Law No.04/L-060 on Waste. Article 10 of Kosovo’s legislation on Waste specifies the need for a Local Solid Waste Management Plan (hereinafter referred to as LSWMP) to be issued by the municipalities.

The purpose of the consultancy is two-fold, as follows:

• To provide the municipalities of Hani i Elezit/Elez Han and Junik with an updated LSWMP for improvement of collection, transfer (as needed), recycling, composting and disposal of municipal refuse . The study shall review and evaluate the solid waste management needs, including composting programs, of the abovementioned municipalities, prioritise existing problems and determine the most feasible means of improvement;
• Train and involve central and municipal government staff responsible for oversight, technical assistance, policy support, and regulatory guidance of solid waste management, so that they would fully understand the solid waste management planning process. This would include technology transfer to local staff working as counter-parts, so that they would be competent to upgrade and implement the plans in the future. The development of a clear methodology and a solid waste management planning framework for improvement of collection, transport/transfer, recycling, composting, disposal and resource recovery that may be replicated or used as a reference in other Kosovo municipalities is a crucial step in the achievement of this objective.

The consultant shall, in carrying out these tasks, refer to and consult the relevant legislation and Administrative Instructions.

SCOPE OF WORKS

The scope of work is designed to address the two objectives for the consultancy, as described above. Under the overall supervision of the Chief Technical Adviser and in close cooperation with the assigned working groups, the MuSPP team, and with the support of the Junior Environmental Officer, the Environmental Consultant for LSWMP will be responsible for the consultancy’s key components described below:

• Review and assess the existing legal, regulatory, and organization framework for solid waste management within the study areas, including the framework at the local and central government levels. This includes the review and assessment of the existing LSWMP (progress in implementation, means dedicated for implementation & monitoring, etc.).
• Update the LSWMP for the municipalities of Hani i Elezit/Elez Han and Junik, based on the most cost-effective and environmentally appropriate technology choices. The LSWMP is a local planning document that enables the implementation of both the national waste strategy and the national waste management plan at the local level. More specifically, a LSWM plan aims to deliver:

2.1 Conformity with the National Waste Strategy and the National Waste Management Plan and its objectives, contributing to waste management policy implementation and national objectives achievement;
2.2 Updated local waste data: updated description of the waste stream and responsibility on it, the volume to be managed and waste characteristics, etc;
2.3 An assessment of existing waste collection schemes, equipments and personnel involved, and disposal and recovery installations, defining the baseline of existing waste management services and activities;
2.4 Waste management options: in order to enable waste collection and treatment in accordance with national objectives and local context;
2.5 Quality of the service: determine the ways and instruments to guarantee the quality of services, such as key performance indicators, procedures, human/financial resources, skills, rules, etc;
2.6 Institutional, organizational and regulatory framework: recommends measures and instruments for the improvement of organisation components, public and private contribution and responsibilities for waste collection, transport, disposal, recycling, treatment, etc;
2.7 Financial needs and investments: defining and describing financial needs and investments that are necessary for the implementation and sustainable delivery of waste management services and processes;
2.8 Financial sources for investments and a local strategy for cost recovery.

3. Develop a strategy for public participation, capacity building and overall environmental awareness during the process of drafting/revising the plans. This should include at least two workshops, to be conducted in cooperation between the central level and the municipalities of Hani i Elezit/Elez Han and Junik, targeting the core working groups and other staff and stakeholders responsible for waste management, environment, planning and other relevant fields. The workshops should help to identify needs, objectives, main issues and implementation strategies for the waste management planning process. The aim is to promote capacity building within national and international best practices, discussing the particular Kosovo conditions in these regards, and presenting findings and recommendations.

Any change of these ToR has to be consulted and agreed with MuSPP, based on the situation during the process. The consultant will closely cooperate with MuSPP staff, project leaders and relevant municipal staff for coordination of tasks, and for knowledge-sharing and capacity building.

All documentation and communication should be in English.

WORKPLAN / ACTIVITIES

The start of the consultancy is scheduled for May 2014 and the Final Report must be delivered by July 2014. The Consultant shall prepare for the work at the home office and will undertake 2 missions to Kosovo to conduct the LSWMP and use the process for capacity building of national staff and also to present and discuss the results of his work with both municipalities.

FINAL DELIVERABLES:

During the assignment, the consultant will deliver two mission reports and the following documents:

• Written comments to both municipal development plans and existing LSWMP;
• Presentations of findings, comments and selected cases studies;
• Draft version of the LSWMPs for Hani i Elezit and Junik;
• Final version of both LSWMPs for Hani i Elezit and Junik.

The exact timing of the deliveries will be determined during the course of the assignments.

• Functional Competencies: Knowledge of methodology and environmental engineering experience within the development sector, including experience in areas such as waste management, ecological development, training and impact evaluations. Understanding of the principles underpinning waste management. Demonstrates strong quantitative skills and the ability to carry out high quality research, including statistical analysis. Possesses ability to think strategically and formulate a long term program addressing Waste Management based on sources and types solid waste (Composition of Municipal solid wastes and Generation rates). Ability to review and evaluate and provide suitable and strong analytical feedback.

QUALIFICATIONS

Education: Advanced degree in environmental engineering, ecological engineering or related fields; Specialized training in the area of waste management.

Experience and other requirements: At least 8-10 years of working experience, and considerable knowledge of environmental planning and the ability to communicate results of research findings and undertake on the job training and seminars. Previous projects or researches related to the field of waste management and environmental planning, particularly with reference to EU requirements in this field; Ability to work in a team and to undertake initiative to ensure smooth relations and open communication within the team and with partners; Good analytical, solution defining and creative skills; Previous experience from the South East Europe region would be an added value; It is essential that the candidate be able to meet deadlines for reporting and all project work.

Language: Fluency in speaking and writing in English.

The financial proposal shall specify a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables (i.e. whether payments fall in installments or upon completion of the entire contract). Payments are based upon output, i.e. upon delivery of the services specified in the TOR. In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of this lump sum amount (including travel, per diems, and number of anticipated working days).

Travel

All envisaged travel costs must be included in the financial proposal. This includes all travel to join duty station/repatriation travel. In general only travel costs will be accepted that do not exceed those of an economy class ticket. Should the IC wish to travel on a higher class he/she should do so using their own 
Resources. In the case of unforeseeable travel, payment of travel costs including tickets, lodging and terminal expenses should be agreed upon, between the respective business unit and Individual Consultant, prior to travel and will be reimbursed.

Evaluation:

Individual consultants will be evaluated based on the following methodology: Cumulative Analysis: When using this weighted scoring method, the award of the contract should be made available to the individual consultant whose offer has been evaluated and determined as responsive/compliant/acceptable and having received the highest score out of a set of weighted technical and financial criteria specific to the solicitation.
