When we asked from mahagunpuram official about completion certificate, they told that they have the compounding certificate from GDA.

Can some one have idea about what is this compounding certificate?

Is it sufficient or still required the completion certificate?

If they have not obtained the completion certificate, then what action we are planning to get the same from builder ?

Everybody, including you, should try hard (in writing to Mahagun) so that

Mahagun should consider all these things. Otherwise, later on in future, don't complain about the basic requirements [like Electricity (Cheap Electricity), Drinking Water (Ganga Water), Municipal Services, etc.]. What is a completion certificate?

During the construction of a building, the builder is supposed to get

no-objection certificates from various departments of the local development authority for basic amenities such as water and electricity, stating that the building construction is not violating any norms in the area.

Once the project is completed, the local authority inspects the premise on the basis of the building plan and awards the completion certificate if it is

satisfied. According to apartment Acts of various states, after completion of a project, it is mandatory for the builder or the owner of a stand-alone property to get a completion certificate from the local authority to ensure the supply of basic amenities.

The builder then applies to the departments yet again along with a copy of the completion certificate to get water, electricity connection and other basic amenities for the project.

Provisional completion certificate: Sometimes builders get a provisional

completion certificate to hand over the possession of apartments in a newly constructed project. In the meanwhile, the developer finishes the remaining work such as painting and landscaping. However, the provisional certificate is valid only for six months. After the expiry of this period, the builder has to apply for the final completion certificate.

Why is it important?

Apart from ensuring that basic amenities, such as water, electricity and

drainage system are provided, a completion certificate ensures that the

builder/owner has constructed the building according to the approved building plan. Without obtaining the completion certificate, the builder cannot give the possession of the house to the buyer.

If the builder cannot get the completion certificate, there could be trouble in

terms of delay in possession. For instance, in the Commonwealth Games Village (CWG) in New Delhi, it was found during the process of awarding the completion certificate that the builder had violated norms of the floor area ratio limit by constructing on a larger area than mandated. While the government is yet to decide on awarding the completion certificate and regularization of the extra area, buyers in the project are waiting for possession.

It is understood that, at present, all the residents of Siddhi Block (Tower),

Saraswati Block (Tower) and Vinayak Block (Tower), who have received Possession Letters, have not been provided with a copy of Completion Certificate alongwith the Possession Letters. Hope everything gets completed smoothly and all flat owners at MAHAGUNPURAM live in peace.

I have my flat in Bhagirathi Tower. I would like to know if anyone has got

possession of their flats or tentative schedule of possession. If yes whether they are getting all the property documents necessary as per the local authorities. please share your experience on this platform.

as i know, few of them in the list of these documents are :-

1. Approved development plan/layout for complete building or at-least your Flat with common area.

2. Architectural specifications line fire safety and earthquake safety

parameters if any.

3. Completion Certificate as per that plan.

4. Please add any other if you know.

I have asked these documents to Mahagun some times back but they didn't provide it to me at that time. They said all the necessary documents has been provided to bank which has financed (in my case HDFC). but they promised to provide these documents to me at the time of possession.

I want to know whether people who has already got possession had faced any problem in getting these documents. please share your experience with all of us.

It may be possible someone among us may be helpful to you.

We all and, especially those who are getting the keys of their Flats in

November, 2012 at Mahagunpuram, should request Mahagun Group (Mahagun Real Estate Private Limited) to give a copy of the Completion Certificate of the completed Tower (s) /Flat (s) for our record and also for further necessary action as copies of Completion Certificate will be required to be given to various Authorities (GDA, Revenue Department, Municipal Corporation, etc) in future for various services.

It is understood that the Possession of Flat (s) / Tower (s) should have to be given to the individuals by first obtaining Completion Certificate from the concerned Authority by Mahagun Group (Mahagun Real Estate Private Limited) only then the works in Flat (s) / Tower (s) are stated to be complete in all respects. Otherwise, later on, we can not ask for them. By having Completion Certificate, no Authority can seal or demolish our Flat (s) / Tower (s) in future and also we can not be denied of various municipal, etc services (drinking water, etc).

The following Article by `Jeevan Prakash sharma' was published regarding Registered Flat could be `unauthorised' in The Hindustan Times (htestates) today (17th November, 2012) :-

AUTHORITIES ARE ALLEGEDLY REGISTERING ALL TYPES OF APARTMENTS IN DELHI NCR WITHOUT THE REQUISITE CHECKS.

1. When 42-year old businessman Vikrant Verma (name changed) bought a flat in a group housing society in Ghaziabad and got it registered, he thought all formalities related to the purchase had been completed. However, much to his horror just a few days after the registration, the Ghaziabad Development Authority (GDA) SEALED the apartment alleging FAR (Floor Area Ratio) violation.

2. "The Developer had built 50 Apartments in excess of the number

sanctioned by the GDA for that particular project and sold these to buyers

unaware of their legal status. Things would not have gone out of hand had the developer obtained a COMPLETION CERTIFICATE from the GDA – which helps property buyers get details of a property. Strangely enough, even though the developer managed to dispose of these `Unauthorised' Apartments, the Revenue Department went ahead and Registered them without verifying their legal status", says Verma.

3. This is a matter of great concern for people who are investing their lifetime savings in properties.

4. HT Estates has been informed by consumer activists and RWA officials that once a house is registered, it is presumed to be legally safe and free from all encumbrances, but contrary to popular belief, thousands of property buyers in DELHI, GHAZIABAD, NOIDA, GURGAON AND FARIDABAD have suffered huge financial losses and physical and mental harassment even after paying STAMP DUTY AND REGISTERING the property with the Authorities. Register such properties without checking the COMPLETION CERTIFICATE of the Project. The complete lack of coordination between the Revenue Departments and the Development Authorities is enabling many Real Estate Developers and Agents to CHEAT CUSTOMERS.

5. Legal Experts say that a COMPLETION CERTIFICATE is a pre-requisite document for Property Registration, SK Pal, a Supreme Court Lawyer who is fighting many cases for Residents' Welfare Associations (RWAs) in Courts, says, "The two Hands of the Government – the Revenue Department and Development Authorities – can't go in different and opposite directions. A COMPLETION CERTIFICATE is mandatory for Registering any Property, BUT, UNFORTUNATELY, DUE TO PRESSURE TO COLLECT MORE REVENUE, THE REVENUE DEPARTMENTS VIOLATE THE LAW".

6. When a Developer gets his Construction Plans sanctioned from the

Development Authority, only the latter is in a position to check if the

construction has taken place as per the Sanctioned Plan.

7. "So once the Development Authority issues a COMPLETION CERTIFICATE, it means that the construction has taken place according to the Sanctioned Plan and all the residential units get legal protection", says Alok Kumar, Vice Chairman, RWA Federation, Ghaziabad, who has filed a PIL in the Allahabad High Court highlighting the issue in Ghaziabad.

8. Nitin Saxena, a consumer activist, alleges that there have been cases

in Gurgaon of even well-known Developers constructing dwelling units in areas earmarked for Parks and Community Centres. A Developer in Sector 56, Gurgaon, has allegedly built flats on the terrace in violation of Sanctioned Plans.

9. "All the flats are illegal, but they are Registered and openly sold in

the market. It's your bad luck if you happen to be a buyer whose flat is being SEALED or DEMOLISHED".

10. Should obtaining a COMPLETION CERTIFICATE be made MANDATORY for a Developer before it hands over the Flats to buyers? And should all projects, once completed, be scrutinised thoroughly to ensure these adhere to the Sanctioned Plans? Officials do not have much to say.

11. PC Meena, Deputy Commissioner, Gurgaon, says, "A COMPLETION

CERTIFICATE is not a pre-requisite document for Registration of Property. If it is made mandatory, it will lead to further harassment and complications for the property buyers but if the Development Authorities such as Haryana Development Authority or Town and Country Planning, Gurgaon give us any such guideline, we will follow it".

12. But RK Singh, Senior Town Planner, expresses ignorance about the Revenue Department making the issue of a COMPLETION CERTIFICATE a precondition for Registering a Property. "In the first place, we don't have such violation in Gurgaon where Builders have encroached upon common areas such as Park and Community Centre to construct Flats. But as far as Registration of Properties is concerned, I don't know whether COMPLETION CERTIFICATE is a necessary document for an Apartment Registration. But I am sure the Revenue Department has stringent norms to check any illegalities," he claims.

13. Lack of coordination is evident in Ghaziabad too, where GDA Officials claim that the Revenue Officials should not Register a Property without a COMPLETION CERTIFICATE while the Revenue Department says the document is unnecessary.

14. SK Zaman, Senior Town Planner, GDA says, "Without a COMPLETION CERTIFICATE, an Apartment should not be Registered because the said Certificate can only differentiate between what is LEGAL and what is ILLEGAL".

15. Disagreeing with this, Rajesh Kumar, ADM, Finance and Revenue,

Ghaziabad, says, "We don't need to make a COMPLETION CERTIFICATE such an important document. At present we are Registering Apartments without a COMPLETION CERTIFICATE".

16. As far as Delhi is concerned, ever after having several stringent

norms for Property Registration, a COMPLETION CERTIFICATE is not required for freehold properties. A Revenue Official, requesting anonymity, says, "In Delhi we don't have Group Housing Societies of Private Developers like Ghaziabad and Gurgaon. But in private colonies a lot of fraud takes place when a Builder violates the sanctioned Plans. Such independent floors can be Registered without a COMPLETION CERTIFICATE". If you buy an independent floor and get it Registered

and if the MCD (Municipal Corporation of Delhi) later discovers violations in

the Construction Plans, it can either demolish the construction or book the

Property as `unauthorised'. In both cases the buyer has to suffer, says the

Officer.

The following facts about Completion Certificate are published in The Hindustan Times (htestates) today (17th November, 2012) :-

(a) As per legal provisions related to real estate development in various

States, it is mandatory for developers to get a completion/occupancy certificate once they complete the projects.

(b) Completion Certificate means a No-Objection Certificajjjte (NOC) has

been granted by the authorities for the building, fire and electrical safety

etc. If granted, it means that the structure has been constructed according to the sanctioned Plan.

(c) A Completion Certificate is the only way to keep a check on

construction of dwelling units which don't have the requisite safeguards in

place.

(d) Legally, Possession without Completion Certificate is not possible.

Every developer is supposed to seek a Completion Certificate from all concerned authorities before he/she offers Possession Letters to buyers.

(e) Though it is not mandatory to submit a Completion Certificate for

Registration under the Indian Registration Act, Legal Experts say Revenue

Departments should ask for Completion Certificates before Registering Property.

LUCKNOW : Hardening its stance on the rampant illegal constructions in the city, Lucknow Development Authority has issued instructions to put information plates providing details about the sanctioned map on the construction sites above 300 metre square area and also upload the information on its website.

LDA's VC Rajiv Agarwal on Monday instructed officials that all the multi-storeyed commercial buildings and group housing societies that have been constructed in past three years should upload information about the sanctioned map along with the number of floors on LDA's website. He has also directed to display the list of all constructed or under construction group housing flats, multi-storeyed commercial complexes and housing societies built on residential plots on the notice boards of the DM, ADM and deputy registrar for the public.

The banks would also be provided a circular informing about these properties, so that they may check with the authority, while deciding to give housing loans on them. The UP Power Corporation officials have been asked not to supply electricity to all the people enlisted.

If any person is using the parking lot for any other purpose in an under-construction site, orders have been given to all executive engineers to restore the parking and regularly check the implementation of the same. If a person has constructed a building without getting its map sanctioned from the authority or has got it approved by the Jila Panchayat, the structure would considered illegal.

The LDA VC has instructed all the engineers to do a survey in their respective zones and stop all unauthorised constructions with immediate effect and also take legal action against them. He said that it has been found that many institutions and people are illegally involved in land-deals without approving the layouts by the competent authority. These would be stopped as per the UP Urban Planning and Development Act 1973 and liable for legal action.

Orders have been issued that any group housing flat or multi-storeyed commercial complex must not get possession without submitting a completion certificate. The superintendent engineer has been made the nodal officer to check such activities.

Ask them to provide a copy of Compounding Certificate. Only then, you will be able to know the difference between the Completion Certificate and Compounding Certificate.

Whether the basic amenities [like Electricity (Cheap Electricity), Drinking Water (Ganga Water), Municipal Services, etc.] will be provided by various authorities with the production of a copy of Compounding Certificate or it is mandatory to get all these amenities only on the production of a copy of Completion Certificate.

Please ask to builder for showing the Occupancy Certificate issued by GDA before registry of your flat.Don't ask to builder over phone.

Please send the mail to customercare@... and ask for this certificate. Its mandatory to every builder,who is offering the possession of Flat to show this certificate on demand of flat owner.

Hello Friends,

Today, I had visited Mahagun and had a long discussion with Nidhi and Megha. During our discussion I got to know that Mahagun hasn't received NOC from GDA yet. Nidhi also made one point clear that Mahagun should only expect NOC from GDA once construction work is over. So, I feel there is no point in discussing on NOC anymore.

Moreover, I also made payment against the amount demanded by Mahagun in the "Offer of Possession" letter. Actually, I had to make payment in a hurry because my travel to the United States is planned for 20th October. Nidhi assured me that the flat registry process will be completed by 16th October (once Shradh period is over).

I just called Megha Tyagi to inquire about the CC (completion certificate), initially she pretended as if they have CC for Mahagunpuram but when I requested to get the copy of it, she said Mahagun does not have CC for Mahagunpuram project yet.

I (along with my two colleagues) am planning to write an application to Mahagun officials to provide us the the copy of CC.

We also went through the U.P. urban developement act and it clearly says that it is illeagl to have possession of a project without having the CC.

Complete projects before giving possession: Ghaziabad Development Authority

GHAZIABAD: The Ghaziabad Development Authority (GDA) has directed all builders and developers in the city to refrain from handing over possession of housing and commercial units without obtaining 'completion certificates' of projects.

The directions have been issued after detection of increasing number of cases where buyers had moved into premises of under-construction projects that did not have completion certificates. Officials at the GDA said that due to lack of proper civic amenities within and around such under-construction projects, several occupants who have already moved in have been making rounds of the development authority's office complaining about lack of basic provisions like water supply, streetlights, etc.

GDA officials say that punitive action might be taken against developers who have been resorting to the practice of handing over possession of properties even though it is mandatory to obtain 'completion certificates' under the Uttar Pradesh Urban Planning and Development Act, 1973. "Immediately upon completion of a project, the concerned developer should apply for obtaining a completion certificate. Allottees should be handed over possession of properties and encouraged to move in only after the project is certified as complete by the authority," said RK Singh, secretary of GDA.

Section 15-A of the urban planning and development Act, besides making it mandatory upon developers to obtain certificates of completion from the development authority, also prohibits allottees in projects from occupying any portion of it until the project has been certified by the authority to have been completed as per plan.

GDA has also appealed to buyers to ensure that the projects they move into have obtained the necessary 'completion certificates' so that any kind of inconveniences or accidents, caused due to non-completion of works, are avoided in the future.

Through a notice, the GDA has distanced itself away from any onus likely to be placed upon it for any untoward incident reported to have occurred due to occupancy in under-construction projects.

"Allottees in projects of private developers should insist upon completion certificates before taking possession of properties. Developers would be forced to obtain these certificates if buyers put up the pressure for it," added Singh.

However would suggest to draft the letter for concerns like partial completion/non livable etc around 20th oct and send to (a) Directors (b) Mahagun company.

And a separate query not complaint to GDA asking justification for addition of EDC etc in registry amount.

We all can attest and give our support to the final draft which can be sent through registered post to both separately.

I believe we all want to pay the amount and shift there ASAP, just that we want some basic hygiene conditions to be ready before we shift along with family and kids.

If maximum of the buyers in tower Siddhi and Saraswati agree then we may make a complaint to GDA that Mahagun is handing over the flats without the completion certificate. It is only to save the penalty. The place will be livable only after completion of project, ie, somewhere in March 2013.

This is very true that builders are giving possession letters even before receiving the NOC from Gov bodies, and I suspect the same in case of Mahagunpuram.

After our meeting with Nidhi on Saturday I met another Mahagunpuram member Mr. Gaurav, he said that he does not believe that Mahagun has received the NOC letters from different civic bodies and for that he gave a written application to Mahagun to produce the NOC letters for Mahagunpuram project.

Currently Gaurav is not part of this forum but I requested him to join this so that we can fight together and at the same time I have noted down his contact number for further communications.

I'll post the updates once Gaurav gets any update from mahagun officials about NOC letters.

Getting Completion Certificate From Competent Authority.

Any building needs to be constructed as per approved plans without any deviations and violations. Obtaining the completion certificate ensures that the developer has constructed the building as per approved plan.

"Buildings should be certified as having been constructed in compliance of planning permit, building permit and other applicable laws. Electricity, water connection and occupancy should be conditional on such a certificate," says a real estate consultant.

Though some builders issue the completion certificate to release the last installment of the loan from banks, buyers sometime find themselves in peculiar situation when they find discrepancies in the completion of building at a later stage.

"My builder has issued completion certificate before the release of the final installment of loan amount without even tiling and carpentry works. Banks too accepted the letter and released the loan. Later, the builder delayed the process and we had to plead him to complete the work," says Mohan Kumar, a resident of Chennai.

Issuing of Completion Certificate (CC) will ensure that the owner has constructed the building as per approved plan. Without the occupancy certificate, it is difficult to get the electricity, water and sanitary connection. The National Building Code (NBC) 2005, formulated by the Bureau of Indian Standards, spells out new regulations for adoption by infrastructure departments, municipal administrators, public bodies and private agencies.

In Pune, however, owners of flats and houses need not have to depend on the builder for the occupancy or completion certificate as the same will be issued to them if the construction norms have been met and the builder has not bothered to procure it from the Pune Municipal Corporation. However, if the flat or house has not been built as per the norms laid down by the PMC, the owner will have to either tell the builder to fulfill the requirements or do it himself or herself.

An occupancy certificate is an authorisation issued by a local governing body that a newly completed (or substantially completed) building meets the required health and safety standards and can be inhabited.

Why CC is necessary?

The owner has to construct the building as per approved plan without any deviations and violations. Issuing of Completion Certificate will ensure that the owner has constructed the building as per approved plan.

The building will be assessed for property tax with effect from date of completion of the building.

The water rate will be converted in to domestic instead non-domestic with effect from date of completion of the building.

The completion certificate will facilitate payment of final installment of the housing loan to start repayment of the same.

According to A commonfloor update, rain water harvesting system and solar water heater are mandatory for newly constructed building in some states. National Building Code will soon be updated with energy saving methods in construction methods. In order to learn which codes are being used and how they will affect you, contact developers and concerned Authorities in your locality for construction of building or apartment. Deviation from approved plan or violation of National Building Code (NBC) will lead to charge penalty, cancellation of approvals or demolition of property.

On completion of all the formalities by the builder, only the municipal authorities can issue the building completion certificate. If you haven't received it, then you can file an application under the Right to Information Act and find out the reasons as why it has not been issued.

Recently, the consumer forum passed an order in the case of Natalia Co-operative Housing Society Ltd, that in the event of the builder not submitting the building completion certificate as well as paying the difference in stamp duty since 1984 within four months from the date of formation of the co-operative society, he would be liable to pay a penalty of Rs 500 per day after a period of three months from the date of the order. You can approach the consumer forum for deficiency in service against the builder.

Occupancy Certificate.

Occupancy Certificate is a very important document. It evidences the completion of the building as per the approved plan and compliance of local laws. local bodies like city corporations / city municipalities issue occupancy certificates. Without the occupancy certificate, it is difficult to get the water and sanitary connection. Financial institutions insists on occupancy certificate to sanction loans.

Problems with respect to issuance of occupancy certificate arise on account of violation of building laws which are increasing day by day. Though the people have spent their hard earned money on the project with a dream of owning a house, they could not occupy the house for want of occupancy certificate. They have to suffer for none of their faults. Builders having good connections escape through various loop holes in the law.

Having invested precious money in such buildings and after waiting for many years to get an occupancy certificate, the purchasers occupy the houses lest they may loose the property. They prefer to occupy the flats without power, water and sewerage connections instead of loosing the property.

In one of the cases the builder unable to obtain the occupancy certificate after a prolonged wait requested his purchasers and handed over the apartments without power, water and sewerage connections. He put the entire blame on revenue authorities and disappeared. The occupants have to find their own way.

Obtaining the approval of the plans has become just a casual affair and nobody will abide by that. It is just a document to be produced during inspection. During the boom time a builder constructed several houses and flats violating building rules and regulations. He deviated from the approved building plans and went on to construct apartments where he should not have constructed.

The civic authorities refused to give occupancy certificate despite best efforts of the builder.

In the mean time, the apartment purchasers on the assumption that things were happening to their satisfaction, performed house- warming ceremonies and took possession of the flats. When they were about to move in, the builder revealed the shocking news that even though he had constructed the apartments and houses to their liking, the authorities were not issuing occupancy certificate on one pretext or the other.

Another builder constructed small flats targeting the middle- income group. The authorities, however, refused to issue occupancy certificate because of deviation from the approved plan. In this case, the builder got the plan approved for construction of 4 dwelling units – 2 on the ground floor and 2 on the first floor. However, he did some thing different in gross violation of the approved plan. Instead of constructing 4 dwelling units, he constructed 6 dwelling units. The persons who have invested in the flats are now desperate, as they would lose their money and the fiats if the authorities decide to demolish the structure.

It is not that only the flat owners are suffering. A few builders, who have a heart for the investing public, too face problems. One such builder constructed 8 flats in accordance with the building regulations and bye-laws and approved building plan. He has completed five and 3 remains to be completed. The builder has received the full payment from five purchasers other three have backed out. This has put the builder in a difficult situation. For want of funds, three flats remain incomplete. The authorities will issue occupancy certificate only after completion of the entire construction and the financial institutions are refusing to lend in the absence of occupancy certificate or no objection certificate from the authorities. The net result is that not only the builder is losing money but also the purchasers of the flats, who have to pay interest to the financial institutions. The financiers too face difficulties in getting back loan installments.

The authorities in the scheme of things must be blamed for this state of affairs. The inspecting authorities do not carry out periodic and surprise checks at the construction site. In case of deviation they should take the builder to task in the beginning itself and not at the fag end of the construction. Majority of the builders follows rules and regulations; but a few do not. They dishonor rules and regulations by violating them.

This is a vicious circle, which only the government can break. Government must initiate immediate remedial action to stem the rot. The authorities shall not be very rigid in granting completion certificates. If the builder has deviated a little more than the allowed percentage, the authorities may impose the penalty and regularise the building.

The investors too must share the blame. They do not check the antecedents of the builder and his track record `Before taking possession they do not check whether the building is according to the sanctioned plan and the fixtures are according to the agreement. Many do not demand occupancy certificate, parent documents, tide deeds, deposit receipts, from the builder.

The purchaser who has not collected all the required documents, has to face various types of problems at a later stage.

Completion Certificate

 After completing the construction, the owner(s) through Architect shall intimate DDA/MCD. The Architect shall certify that the construction has been carried out as per the proposal submitted earlier and is in conformity with building bye-laws and guidelines for addition(s)/alteration(s) in DDA flats.

 The intimation of completion shall have to be given within 3 years of submission of plans for addition(s) / alteration(s) to DDA/MCD. If no intimation regarding completion of construction is received within 3 years, the permission granted will automatically get revoked and withdrawn.

 In cases where construction has already been carried out and only regularization is required, there will be no need of completion certificate.
