He brought a claim for, inter alia, arrears of pay and non-payment of a discretionary meal allowance. The employment tribunal dismissed those claims. The Employment Appeal Tribunal allowed the employee's appeal in respect of the claim for arrears of pay as the tribunal had failed to make a determination of whether the employee had worked the requisite number of hours to be entitled to payment.
