The U.S. Trustee Program (USTP) is a litigating component of the Department of Justice and has the legal authority to appear in the majority of the bankruptcy cases filed in the United States, from Chapter 7 liquidations to major Chapter 11 business reorganizations. As a result, USTP employees headquartered in Washington, D.C., and in our 93 field office locations throughout the country handle a wide range of challenging and significant matters as we strive to promote the integrity of the bankruptcy system by enforcing bankruptcy laws. Of particular importance is this Program's effort to address fraud and abuse by debtors, creditors, attorneys, and others in the bankruptcy system by taking formal and informal actions in a civil context and making criminal referrals to and working with the U.S. Attorneys.

Incumbent will serve as an Auditor (Bankruptcy) with responsibility for the economic and financial analysis and related investigative work associated with bankruptcy cases under applicable chapters of law, including especially difficult and complex, chapter 7 and chapter 11 bankruptcy cases. Assignments are analytical and investigative in nature and require a professional knowledge of accounting and financial analysis to perform work that is similar in scope and complexity to that performed by a public accounting firm. The following are the duties of this position at the full performance level. The selectee will have the opportunity to learn to perform all these duties, and will receive training to help you grow in this position:

* Examines corporate structures, including assets, liabilities encompassing both secured and unsecured debt, competence of management, income, and expenditures to determine the feasibility of the debtor’s short and long-term operating plans and the viability of the business’ continued operation.
* Reviews and analyzes bankruptcy cases filed by individual debtors, determines adequacy and accuracy of financial documents submitted, and identifies areas of potential fraud and abuse of the bankruptcy system.
* Reviews debtors’ books and financial records, including on-site review, and recommends to the U.S. Trustee (UST) appropriate action to administer the case including appointing a trustee or examiner, or moving to convert or dismiss the case.
* Performs audits, reviews, and analyses of bankruptcy cases administered by standing and panel trustees and determines their adequacy, accuracy, and compliance with accounting principles and practices.
* Reviews audits of trustees performed by Independent Public Accountants for thoroughness and adequacy, and to identify substantive weaknesses in trustee performance requiring corrective action.
* Prepares financial analyses and reports for presentation in court or other legal forum.

**To qualify at the GS-13** level your resume must demonstrate at least one year of specialized experience at or equivalent to the GS-12 grade level or pay band in the Federal service or equivalent experience in the private or public sector. Specialized experience is defined as experience performing audits, reviews, and analyses of bankruptcy cases and determining the adequacy, accuracy, and compliance with accounting principles and practices.

In addition to the required specialized experience identified above, it is preferred and desired that the applicant has experience in and/or knowledge of forensic, regulatory, and/or insolvency accounting and a certificate as a Certified Insolvency and Restructuring Advisor (CIRA), a certificate as a Certified Fraud Examiner (CFE), or a certificate as a Certified Government Auditing Professional (CGAP).

**NOTE: While you may have experience in insolvency and/or forensic accounting which would complement your bankruptcy experience, NEITHER this experience or your education can be substituted for the REQUIRED 6 months bankruptcy experience. **

**_Education Requirement:_******

**Degree: Must submit transcripts or a list of courses.**Accounting; or a degree in a related field such as business administration, finance, or public administration that included or was supplemented by 24 semester hours in accounting. The 24 hours may include up to 6 hours of credit in business law. (The term "accounting" means "accounting and/or auditing" in this standard. Similarly, “accountant” should be interpreted, generally, as “accountant and/or auditor.”) **OR**

**Combination of education and experience:** at least 4 years of experience in accounting, or an equivalent combination of accounting experience, college-level education, and training that provided professional accounting knowledge. The applicant's background must also include _one_of the following:

1. Twenty-four semester hours in accounting or auditing courses of appropriate type and quality. This can include up to 6 hours of business law;

2. A certificate as Certified Public Accountant or a Certified Internal Auditor, obtained through written examination; or

3. Completion of the requirements for a degree that included substantial course work in accounting or auditing, e.g., 15 semester hours, but that does not fully satisfy the 24-semester-hour requirement of paragraph A, provided that:

a) the applicant has successfully worked at the full-performance level in accounting, auditing, or a related field, e.g., valuation engineering or financial institution examining;

b) a panel of at least two higher level professional accountants or auditors has determined that the applicant has demonstrated a good knowledge of accounting and of related and underlying fields that equals in breadth, depth, currency, and level of advancement that which is normally associated with successful completion of the 4-year course of study described in paragraph A; and

c) except for literal nonconformance to the requirement of 24 semester hours in accounting, the applicant's education, training, and experience fully meet the specified requirements.
