ESTE ES UN CONCURSO DE HABILIDAD Y/O DESTREZA. NO NECESITA COMPRAR NADA. NINGUNA COMPRA NI PAGO DE NINGUNA CLASE AUMENTARÁ SUS POSIBILIDADES DE GANAR.
I. ELEGIBILIDAD: Este concurso de Tu Visión Canal de Tu Visión está abierto para todo aquel que:
• sea residente legal en cualquiera de los cincuenta (50) estados de los Estados Unidos y el Distrito de Columbia (pero no otros territorios de los EE.UU.)
• tenga por lo menos quince (15) años de edad al momento de inscribirse con permiso de sus padres o tutor legal.
• sea completamente responsable por la creación de la presentación que propone, inlcuyendo, pero sin limitarse a escritura, guión, ejecución, videgrafía, fotografía y edición
• use una cuenta válida y activa de Tu Visión Canal que haya sido registrada usando un nombre e identidad verdaderos – las inscripciones que se descubran tener nombres o identidades falsos serán descalificadas y a estos individuos podría prohibírseles alguna otra participación en ese y en todos los demás concursos.
2. DESCALIFICACION: Los empleados (incluyendo internos actuales), miembros, gerentes principales , oficiales, agentes, afiliados, subsidiarios, empresas administrativas, agencias de publicidad, agentes de mercadeo y sus respresentantes, así como sus familiares y parientes, u otras peronas con las que vivan no califican para participar en el Consurso. De nuevo, Tu Visión Canal se reserva el derecho de verificar los requisitos para calificar y descalificar su participación si se descubre que usted ha infringido estas condiciones para participar.
3. ACUERDO CON LAS REGLAS: Al participar en el Concurso, usted está en completo e incondicional acuerdo en aceptar estas Reglas y las decisions del Patrocinador, las cuales son finales y obligatorias en todos los asuntos relacionados al Consurso. El hecho que usted reciba o no un Premio, depende del cumplimiento de todos los requisitos establecidos en estas Reglas. El Concurso está sujeto a todas las leyes federales, estatales y locales del lugar en que se aplican en estas Reglas. Se anhula donde la ley lo prohíbe o lo restringe.
4. PERIODO DEL CONCURSO: Se aceptarán inscripciones entre las 12:00:01 a.m. hora de la zona del Pacífico (según apliquen las zonas de la horas del día en ese momento) de el 8 de Septiembre de 2014 y las 11:59:59 pm hora de la zona del Pacífico (según apliquen las zonas de las horas del día en ese momento) de el 8 de Octubre de 2014 (el “Período del Concurso”). El computador del Administrador es el aparato controlador oficial de la hora del Concurso. Nota: Se requiere un mínimo de 25 participantes para el día 8 de Octubre de 2014 o el concurso será extendido como se indica en el párrafo Número 23 de estas Reglas.
5. PERIODO DEL VOTACIÓN ABIERTA AL PÚBLICO GENERAL: El público general inscrito en tuvisioncanal.com tendrá la oportunidad de votar por sus videos, participantes o historias preferidas del 8 de Septiembre de 2014 al 8 de Octubre de 2014.
6. TIPOS DE CONCURSOS Y CATEGORIAS: Hay diferentes concursos disponibles para participación; no hay límite en el número de inscripciones que se puedan presentar por individuo o cuenta en cualquiera de los concurso o en el numero de concursos en el que un solo individuo o cuenta pueda participar en un momento dado:

7. PROCESO DE INSCRIPCION:
• Registra una cuenta de usuario con Tu Visión Canal usando un nombre e identidad verdaderos yendo al sitio www.tuvisioncanal.com (el “Sitio”) y registrándote gratis al:
• oprimir el botón “Regístrate gratis”
• ingresar tu información para crear un nombre de usuario y contraseña
• Inscribe tu video en la categoría apropiada entre las fechas de comienzo y final al:
• Visitar el Sitio durante el período del concurso
• Ingresar usando tu información de Cuenta
• Hacer clic en “sube tu video” para ingresar el video
• Selecciona “Concursos” y después, bajo “Seleccionar Categoría” selecciona ” Concurso Secretos de Belleza con Yasmany” para inscribir tu video para participación. Si deseas inscribir el mismo video para otro concurso necesitarás comenzar nuevamente el proceso y seleccionar el concurso correspondiente al que deseas inscribir tu video bajo “Seleccionar Categoría”. (“Video”) (Colectivamente, tu “Inscripción”)
• No hay costo alguno para participar en ningún concurso
• Asegúrate de que el video llene los requisitos ténicos apropiados:
• Un archivo en video debe inscribirse teniendo no más de tres minutos y cero segundos (3:00) de duración.
• El tamaño del archivo del Video no debe ser más de 2GB en tamaño
• Los videoarchivos deben presentarse en uno de los siguientes formatos de archivos: .MPEG; .MOV; .AVI; .WMV. A los finalistas se les podría pedir que presenten el audio original y los archivos del video que usaron durante la producción de la presentación para propósitos de difusión. Esto puede incluir archivos QuickTime files sin comprimir, mezcla final audio y/o audio de bandas separadas para diálogo, música y efectos. Estos son mandatorios para llegar a las finales en la competencia.
• El idioma principal en cada video debe ser español en cuanto a que:
• Cincuenta por ciento (50%) de todas las palabras (habladas, cantadas, etc.) deben estar en el idioma español; o
• Si el video contiene menos de cincuenta por ciento (50%) de todas las palabras (habladas, cantadas, etc.) en el idioma español, entonces la porción total en inglés debe contener subtítulos en español.
• Asegúrate de que tu inscripción sigue las Reglas de Participacion, lo cual siginifica que el material presentado no puede incluir, según lo determinado por el Patrocinador, bajo su propia discreción, ningún contenido que:
• Sea sexualmente explícito o sugestivo; innecesariamente violento or derogatorio de ningún grupo étnico, de raza, profesional o de edad; profano o pornográfico; o que contenga desnudez de cualquier clase,
• Fomente el alcohol, drogas ilegales, tabaco, pistolas, armas de fuego (o el uso de cualquiera de las ya citadas);
• Fomente alguna actividad que parezca ser insegura o peligrosa;
• Sea obsceno u ofensivo; apoye cualquier forma de odio o de odio en grupo;
• Difame, falsifique o contenga comentarios menospreciativos acerca del Patrocinador o sus productos, u otras personas, productos o empresas;
• Viole los derechos de marcas registradas de cualquier entidad a través del uso de logos o vestimenta de tal entidad (tal como paquetes o fraseología distintiva);
• Viole los derechos de autoría de otro al usar materiales con derecho de autor que pertenecen a una entidad (incluyendo fotografías, música y otros trabajos o imágenes de arte); todas las inscripciones deben ser originales de los participantes;
• Anuncie o promueva cualquier marca o producto de cualquier clase;
• Contenga alguna identificación personal, tal como nombres de individuos, direcciones de calles o electrónicas, números de teléfonos;
• Viole o apoye la violación de cualquier ley, regla o norma;
• Contenga materiales que muestren los nombres, parecido físico u otro indicio que identifique a alguna persona;
• Promueva algún partido político, agenda o mensaje; y/o
• Conlleve mensajes o imágenes inconsistentes con la imagen positiva y la buena fe con las cuales el Patrocinador desea asociarse;
O que de otra manera viole nuestras Condiciones de Servicio http://www.tuvisioncanal.com/condicionesdelservicio, Directrices de la Comunidad http://www.tuvisioncanal.com/directricesdelacomunidad, o Pólitica de Privacidad http://www.tuvisioncanal.com/politicadeprivacidad.
8. DESCALIFICACION: Al entrar a un concurso, el participante acepta que la inscripción se conforma a las Reglas Oficiales del Concurso según se definen aquí y que Tu Visión Canal y los jueces que TVC ha nombrado pueden en su absoluta discreción descalificar del Concurso la inscripción del participante si TVC y sus jueces creen que la inscripción no está en conformidad con las Reglas Oficiales del Concurso. Las inscrpciones descalificadas no se publicarán y TVC no está bajo obligación alguna de notificar a los participantes que sus inscripciones se descalificaron.
9. CRITERIOS DE EVALUACIÓN:
La evaluación se basará en el voto popular de otros usuarios de TVC. El público general inscrito en tuvisioncanal.com tendrá la oportunidad de votar una vez por cada video(s) de su preferencia. Los 5 videos con el mayor número de votos para la fecha 8 de Octubre de 2014 pasarán a la ronda final donde Yasmany seleccionará al ganador que se anunciará el 11 de Octubre del 2014 y que ganará el premio. El voto de los jueces en la selección del Ganador o Ganadores es definitivo y de carácter obligatorio para todos los participantes en asuntos relacionados con el Concurso.
Cualquiera que registre una Cuenta en el Sitio puede votar durante el Período de Votación por la inscripción que mejor llene los criterios de evaluación.
o Se permite un voto por video por dueño autorizado de cuenta. Los Promotores del Concurso tienen el derecho, en su absoluta discreción, de mantener la integridad del Concurso, incluyendo el derecho de invalidar votos, inclusive, pero sin limitarse a, razones que se dan a continuación:
o Votos múltiples del mismo usuario desde diferentes direcciones de IP o de diferentes direcciones electrónicas; votos por inscripciones fraudulentas (usando un enlace de redirección, un enlace disfrazado, un enlace fraudulento, etc.);
o Fallas técnicas de servidores o conexión del internet;
o Retractación de los usuarios de sus propios votos;
o Actualizaciones técnicas o de contenido que hacen que los votos sean incompatibles o inconsistentes;
o Conducta inapropriada al promover votos (spam: uso de basurero en correo, hostigamiento, etc.);
o La compra o intercambio de votos en forma doméstica o en el exterior;
o Pago u otras formas de compensación ofrecidas en intercambio por votos;
En caso de un empate, el Patrocinador de la Inscripción votará para el desempate. Las inscripciones empatadas se someterán al siguiente criterio, cada uno de los cuales se evaluará igualmente en el proceso del puntaje, siendo definitiva la decisión de los jueces:
o La calidad técnica de la presentación del video
o Valor de entretenimiento, lo cual incluye originalidad, creatividad y calidad de talento.
Al entrar al Concurso, los participantes están total e incondicionalmente de acuerdo en aceptar estas reglas y las decisiones de los jueces, las cuales serán definitivas y obligatorias en todos los asuntos relacionados con el Concurso. Cualquier protesta en la realización del concurso, selección de los ganadores o la presentación de los premios se debe hacer inmediatamente; la resolución de cualquier protesta se hará en la absoluta discreción del Patrocinador de la Inscripción o de los Oficiales LLC de Tu Visión, cuya decisión se considerará final.
10. POSIBILIDADES DE GANAR: Las posibilidades de ganar varían. Estas dependen del número de personas que participen.
11. PREMIOS: Un (1) ganador recibirá: (i) un premio en dinero en efectivo de Quientos Dólares ($500); (ii) la oportunidad de que su Video se exhiba en el sitio de la página del Patrocinador, incluyendo un blog en el sitio del Patrocinador. El ganador debe tener toda la identificación necesaria (por ejemplo, una licencia válido para conducir en los Estados Unidos) para reclamar el premio. El ganador será la única persona responsable de obtener una identificación válida relacionada a la aceptación y uso del premio; el Patrocinador no sustituirá ningún premio que se haya perdido, mutilado o haya sido robado. Los premios no son transferibles. No habrá sustituciones o cambios por dinero en efectivo, a excepción de la falta de disponibilidad de algún premio, en cuyo el Patrocinador se reserva el derecho de sustituir un premio por otro de igual o mayor valor. El ganador o ganadores se anunciarán aproximadamente el 11 de Octubre de 2014 de todas las inscripciones elegibles que se hayan recibido.
12. AVISO AL GANADOR Y RECLAMO DEL PREMIO: Si usted fue seleccionado como Ganador(a), se le notificará por medio de correo electrónico a la dirección electrónica provista por usted en su “Cuenta.” Si no se puede contactar al ganador o ganadora dentro de los siete (7) días de calendario después de la primera intención de aviso, si el premio o el aviso de premio se nos devuelve como no posible de entregar, si la persona ganadora se niega a aceptar su premio o en el caso de falta de cumplimiento con estas reglas y requisitos del Concurso, tal premio se anulará y se seleccionará en sustitución a un ganador o ganadora entre las inscripciones elegibles restantes. Un premio es algo personal para el ganador y no es transferible. Una vez que se anule el premio, no se dará compensación.
La aceptación de cualquier premio constituirá y significará un acuerdo y consentimiento del ganador de que TV y sus designados pueden usar el nombre del ganador, su domicilio, estado, parecido, fotografía, inscripción, parafraseo de declaraciones y/o información sobre el premio en relación con el aspecto promocional, publicitario u otros propósitos, en escala mundial, en cualquier y todos los medios de prensa ahora conocidos o desde ese punto en adelante, incluyendo la red (internet), sin limitación y sin más pago, aviso, permiso u otra consideración, excepto donde la ley lo prohíba. Sin limitar la generalidad de estas Reglas Oficiales del Concurso, el ganador le concede irrevocablemente TVC la licencia sin exclusividad del uso de la inscripción según se especificó arriba. El individuo participante, si sale seleccionado ganador, entiende que él o ella tendrán que firmar documentos más extensos para el abandono de estos derechos. Al punto que este abandono de derechos más tarde entre en conflicto con esta sección de las reglas, los derechos concedidos a TVC en el abandono posterior de derechos tendrán prioridad sobre los anteriores.
Sin embargo, el Ganador acepta y reconoce que TVC no estará bajo obligación de usar la Inscripcción y TVC en su total discreción tendrá el derecho de refrenarse de usar tal Inscripción. TVC no incurrirá ninguna responsabilidad al punto de que TVC decida refrenarse de ejecutar cualquiera de sus derechos en este documento. El Ganador indemnificará a TVC, y cualquier concesionario de TVC contra todas las quejas, daños, obligaciones y gastos (incluyendo honorarios razonables de abogados y gastos legales) que surjan del incumplimiento de estas condiciones.
13. DERECHOS CONCEDIDOS POR USTED: Al inscribir una participación, usted:
• Autoriza darle a TVC una licencia no exclusiva, libre de regalías, irrevocable, perpetua, para usar, modificar, publicar, crear obras derivativas y exhibir tales inscripcciones en total o en parte en base mundial y en incorporar dicha obra en otros otrabajos en cualquier forma, medio o tecnología ahora conocida o que surja más tarde, incluyendo propósitos de promoción o mercadeo. La persona participante, si es escogida como ganadora, entiende que él o ella tendrá que firmar documentos más extensos para el abandono de estos derechos. Al punto que este abandono de derechos más tarde entre en conflicto con esta sección de las reglas, los derechos concedidos a TVC en el abandono posterior de derechos tendrán prioridad sobre los anteriores.
• Está de acuerdo en que ni ahora ni en el futuro recibirá usted pago por su inscripción o por concederle al Patrocinador cualquiera de los derechos esteblecidos en estas Reglas.
14. SUS REPRESENTACIONES Y GARANTIAS: Al entrar en el Concurso, usted acepta y garantiza que:
o Ya sea :
La inscripción sea completamente suya, libre de cualquier derecho prendario o gravamen, o
Usted ha obtenido todos los derechos necesarios para concederle a TVC el derecho y/o permitirle a TVC la inscripción en cualquiera de los medios ahora conocidos o por conocer, por todo el universe y en perpetuidad, y que usted tiene todos los derechos de producción, distribución y/o explotación de la inscripción, incluyendo sin limitación todos los derechos al parecido, nombres, voces e información biográfica incorporada en la inscripción, cualquier localidad, cualquier obra de arte, cualquier logo u otra propiedad intelectual en cualquier y en todos los otros elementos o contenido en la inscripción y puede producir prueba por escrito de la concesión de estos derechos bajo solicitud;
o La inscripción es original de usted y no está basada en ningún otro material o fuente (incluyendo pero sin limitarse a escritos, poesía, texto, gráficas, trabajo de arte, logos, fotografías, parecidos a cualquier tercera persona, grabaciones musicales o películas;)
o El uso y explotación de la inscripción no violará o infringirá los derechos de ninguna tercera persona (incluyendo sin limitacion infracciones de aquellos derechos basados en autoría, marcas registradas o incumplimientos de secretos de marcas, invasión de privacidad,derechos falsos, distorsión de imagen, malversasión de derechos o publicidad, difamación u otros derechos contractuales, civiles o de otro fundamento) y usted pueda producir prueba escrita de autorización necesaria de terceras personas bajo solicitud;
o Usted tiene el derecho de presentar y ofrecer tal material a TVC sin obligación a cualquier tercero, y TVC no requiere el consentimiento de ninguna otra persona o entidad para explotar por completo la inscripción según se presentó en éste documento.
o Usted es el único propietario de los derechos de autor de toda la música y orquestación integrada en la inscripcción según se expuso en éste o ha obtenido todos los derechos necesarios para concederle a TVC el derecho y/o permiso a TVC para usar toda la música y orquestación integrada en ella y usted pueda producir prueba escrita de la autorización necesaria de terceras personas bajo solicitud; y
o Usted no alegará, mantendrá o ayudará a que otras personas aleguen o mantengan querella, acción o demanda de ninguna clase o naturaleza contra TVC o entidades relacionadas o afiliadas, sucesores, apoderados y concesionarios de TVC referente al uso de la inscripción, incluyendo sin limitacion infracciones de aquellos derechos basados en autoría, marcas registradas o incumplimientos de secretosde marcas, invasión de privacidad,derechos falsos, distorsión de imagen, malversascón de derechos o publicidad, difamación u otros derechos contractuales, civiles o de otro fundamento.
o Usted ha leído, entendido, aceptado y estado de acuerdo en aceptar y a regirse por las Condiciones de Servicios del Administrador http://www.tuvisioncanal.com/condicionesdelservicio Community, Directrices de la Comunidad http://www.tuvisioncanal.com/directricesdelacomunidad, o Política de Privacidad http://www.tuvisioncanal.com/politicadeprivacidad, a medida que ellas se enmienden de vez en cuando.
15. PUBLICIDAD / COMUNICADOS DE PRENSA: Los participantes del Concurso no pueden ofrecer comunicados de prensa u otra publicidad en conexión con su participación en el Concurso. El compartir inscripciones y videos a través de la prensa social es aceptable y se anima a los participantes a que lo hagan.
16. FALLAS TECNICAS: Estipulaciones de Responsabilidad: Los Promotores del Concurso:
• No son responsables por errores humanos, robo, destrucción o daño de las Inscripciones u otros factores razonablemente fuera de su control. Usted asume todos los riesgos de Inscripciones dañadas, perdidas, atrasadas, incompletas, inválidas, incorrectas o extraviadas.
• No garantizan, representan o aseguran en forma expresa o ímplicita, en conexión con su habilidad para en cualquier forma permitir, desarrollar o comercializar la Inscripción suya.
• No tendrán responsabilidad hacia el Ganador ni otra persona por no haber dado el Premio o una parte del mismo, por razones ajenas al control razonable de los Promotores en cuanto a que el Premio no estaba disponible debido a fuerzas mayores, fallas técnicas o de equipo, actos terroristas, disputa laboral o acto/omisión de cualquier clase (ya sea legal o ilegal), interrupción del transporte, disturbios civiles o cualquier otra causa similar o diferente más allá del control del Patrocinador.
• Junto con cualquier Patrocinador, Administradores y sus empleados, oficiales, directores, agentes, contratistas, representantes, afiliados, divisiones, subsidiarios y agencias de publicidad/promoción ( “Grupos Concesionarios”) no asumirán responsabilidad de ninguna clase por nada de lo siguiente:
• transmisiones atrasadas, fallidas, parciales o indescifrables por el computador;
• fallas técnicas de cualquier clase, incluyendo, pero sin limitarse a servicio interrumpido o inaccesibilidad de la red, servidor u otras conexiones;
• la disponibilidad, accesibilidad, fallas técnicas o comunicaciones fallidas del computador, transmisiones por sátelite, teléfono o cable;
• el capturar en forma incorrecta o inexacta información a causa del Sitio o sus usuarios;
• manipular, piratear cualquier equipo o programación asociada con el Concurso o utilizada por el mismo;
• errores de cualquier clase ya sean de naturaleza humana, mecánica, electrónica, de la red o de otra manera que surjan o se relacionen con el Concurso;
• robo, pérdida, destrucción o daño a una Inscripción en parte o en su totalidad; y otros factores fuera de su control;
• daños físicos al computador de usted o de cualquier otra persona con relación o como resultado de la participación en el Concurso o al bajar o usar materiales del Sitio o cualquier Sitio del Concurso.
17. LIBERACION Y RENUNCIA: Al participar en el Concurso, los participantes están de acuerdo en liberar e indemnizar a TVC y sus oficiales, directores,agentes, representantes, empresas principales, subsidiarias, asignadas, empleados e inversionistas ( los “Grupos Concesionarios”), de cualquier y todas las demandas y/o causas de acción de cualquier naturaleza o clase, ya sea conocida actualmente o desconocida, imprevista, que surja de la participación en el Concurso o recibo, uso o mal uso de cualquier premio. 1. ELIGIBILITY: This Tu Visión Canal contests is open to anyone who is:
• A legal resident of the fifty (50) United States and the District of Columbia (but not other U.S. territories)
• at least fifteen (15) years of age at the time of submission with parent permission or legal guardian.

3. AGREEMENT TO RULES: By participating in the Contest, you fully and unconditionally agree to and accept these Rules and the decisions of Sponsor, which are final and binding in all matters related to the Contest. Whether or not you receive a Prize is contingent upon fulfilling all requirements set forth in these Rules. The Contest is subject to all applicable federal, state, and local laws. 4. 7. ENTRY PROCESS:
• Register a user account with Tu Visión Canal using a real name and identity by going to www.tuvisioncanal.com (the “Site”) and register for free by:
• clicking on the “free registration button”
• entering your information to create a username and password.
• Submit your video in the proper category between the start and end dates and times by:
• Visiting the Site during the Contest Period
• Logging in using your Account information
• Clicking on “sube tu video” to upload a video up
Choose “Concursos” then under “Seleccionar Categoría”, choose ” Concurso de Belleza con Yasmany” to submit your video for participation. If you would like to submit the same video for another contest you would need to start the process again and select the corresponding contest that you would like to submit your video for under “Seleccionar Categoria” (“Video”) (collectively, your “Entry”).
• There is no cost to enter any contest
• Ensure the video has the proper technical requirements:
• A video file must be submitted which is no more than three minutes and zero seconds (3:00 min) in length.
• The Video file size must be kept at 6GB size
• Videofiles must be provided in one of the following file formats: .MPEG; .MOV; .AVI; .WMV. Finalists may be asked to provide the original audio and video files used during production of the entry for broadcast purposes. This may include uncompressed QuickTime files, final audio mix and/or separate audio tracks for dialogue, music, and effects. These items are mandatory to become a finalist in the competition.
• The primary language in each video must be Spanish in that:
• fifty percent (50%) of all wording (spoken, sung, etc) must be in the Spanish language; or
• if the video contains less than fifty percent (50%) of all wording (spoken, sung, etc) in the Spanish language, then the entire English language portion must contain Spanish subtitles.
• Ensure that your submission follows the Submission Guidelines, which means that the submission may not contain, as determined by the Sponsor, in its sole discretion, any content that:
• Is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity of any kind,
• Promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing);
• Promotes any activities that may appear unsafe or dangerous;
• Is obscene or offensive; endorses any form of hate or hate group;
• Defames, misrepresents or contains disparaging remarks about the Sponsor, or its productsor other people, products or companies;
• Violates the trademarks rights of any entity through the use of that entitiy’s logos or trade dress (such as distinctive packaging or phraseology);
• Violates another’s copyrights by using copyrighted materials owned by any entity (including photographs, music and otherworks of art or images); all submissions must be original creations of the entrants
• Advertises or promotes any brand or product of any kind;

8. DISQUALIFICATION: By entering a contest, entrant agrees that the submission conforms to the Official Contest Rules and as defined herein and that Tu Visión Canal and its appointed judges in their sole discretion can disqualify the entrant’s submission from the Contest if TVC and its appointed judges believe the submission fails to conform to the Official Contest Rules. Disqualified submission will not be posted or published and TVC is under no obligation to notify entrants whose submissions were disqualified.
9. JUDGING CRITERIA:
Judging will be based on a popular vote of other TVC users. The General public registered at tuvisioncanal.com will have the opportunity to vote once for each of their favorite videos. The top 5 videos with the most votes by October 8th, 2014 will enter the final round whereYasmany will choose the winner who will be announced on October 11th, 2014 and will win the grand prize. The judges in selecting the Winner(s) are final and binding on all entrants in all matters relating to the Contest.
o Anyone who registers for an Account on the Site can vote during the Voting Period for the Entry that best meets the Judging Criteria.
o There is one vote per video allowed per authorized account holder. The Contest Facilitators have the right, in their sole discretion, to maintain the integrity of the Contest, including the right to void votes, including, but not limited to, for the following reasons:
o Multiple votes from the same user from different IP addresses or from different email addresses; fraudulent entry votes (using a redirect link, a disguised link, a fraudulent link, etc.);
o Technical malfunction of servers or internet connection;
o User(s) recanting their own votes;
o Technical or content upgrades that render votes incompatible or inconsistent;
o Inappropriate conduct in promoting votes (spam, harassment, etc.);
o The purchase or exchange of votes domestically or overseas;
o Payment or other forms of compensation offered in exchange for votes;
In the event of a tie, the Entry Sponsor judges will vote to break the tie. The tied entries ill be judged on the following criteria, each of which will be valued equally in the scoring process, with the decisión of the judges being final:

11. PRIZES: One (1) Winner will receive: (i) a cash prize of Five Hundred Dollars ($500); (ii) the opportunity to have his/her Video showcased on Sponsor’s website, including a feature in blog post on Sponsor’s website. Winner must have all necessary identification (e.g., a valid U.S. driver’s license) required to collect winnings. Winner will be solely responsible for obtaining valid identification relating to acceptance and use ofthe prize. Sponsor will not replace any lost, mutilated, or stolen prize. Prizes are non-transferable. No substitutions or cash redemptions, except in the case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal orgreater value. The winner(s) (“Winner(s)”) will be announced on or about October 11th,2014 from all eligible Entries received.
12. PRIZE WINNER NOTIFICATION AND PRIZE CLAIM: If you are selected as a Winner, you will be notified of the selection of your Entry by email address provided by you on your “Account”. If winner cannot be contacted within seven (7) calendar days of first notification attempt, if prize or prize notification is returned as undeliverable, if winner rejects his/her prize or in the event of noncompliance with this Contest rules and requirements, such prize will be forfeited and an alternate winner will be selected from all remaining eligible entries. A prize is personal to the Winner and is non-transferable. Upon prize forfeiture, no compensation will be given.

Entrant, if chosen as a winner, understands that he or she will be required to sign a more extensive release of these rights. To the extent that this later release conflicts with this section of the rules, the rights granted to TVC in the later release shall be controlling.
However, Winner accepts and acknowledges that TVC shall not be obligated to use the Submission and TVC in its sole discretion shall have the right to refrain from using the Submission. TVC shall not incur any liability to the extent TVC chooses to refrain from exercising any of its rights hereunder. 13. RIGHTS GRANTED BY YOU: By submitting an entry you:
• Consent to give TVC a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. Entrant, if chosen as a winner, understands that he or she will be required to sign a more extensive release of these rights. To the extent that this later release conflicts with this section of the rules, the rights granted to TVC in the later release shall be controlling.
• Agree that you will not now nor in the future be paid for your entry or for granting the Sponsor any of the rights set out in these Rules.
14. YOUR REPRESENTATIONS AND WARRANTIES: By entering the Contest, you represent and warrant that::

The entry is solely own your entry, free of any lien or encumbrance, or
You have obtained all necessary rights to grant TVC the right and/or to permit TVC to use the entry in any and all media, now known or hereafter devised, through the universe in perpetuity, and that you have all production, distribution and/or exploitation rights in and to the entry, including without limitation all rights to the likenesses, names, voices and biographical information incorporated in the entry, any locations, any artwork, any logos or other intellectual property, and any and all other elements or content in the entry and can produce written proof of the grant of these rights upon request;

o You have the right to submit and to offer such material to TVC without obligation to any third party, and the consent of no other person or entity is required for TVC to fully exploit the entry as provided herein.
o You are sole copyright owner in all music and scoring incorporated in the entry as set forth herein or have obtained all necessary rights to grant TVC the right and/or to permit TVC to use all music and scoring incorporated therein and you can produce written proof of the grant of these rights upon request
o You will not assert, maintain or assist other persons in asserting or maintaining against TVC or TVC’s related and affiliated entities, successors, assignees and licensees any claim, action, suit or demand of any kind or nature whatsoever related to the use of the entry, including without limitation those grounded upon copyright, trademark or patent infringement, violation of trade secrets, invasion of privacy, false light, misappropriation or publicity rights, defamation or other contractual, civil, or other rights, or any other ground in connection with the use of the entry in any way.

16. TECHNICAL FAILURES: Liability Provisions: The Contest Facilitators:
• Are not responsible for human error, theft, destruction, or damage to Entries or other factors beyond its reasonable control. You assume all risk of damaged, lost, late, incomplete, invalid, incorrect or misdirected Entries.
• Make no warranty, representation or guarantee, express or implied, in connection with its ability to in any way enable, develop or market the idea set forth in your Entry.
• Shall not be liable to a Winner or any other person for failure to supply the Prize or any part thereof, by reason of the Prize becoming for reasonsbeyond the reasonable control of the Contest Facilitators unavailable or impracticable to award, or for any force majeure event, technical or equipment failure, terrorist acts, labor dispute, or act/omission of any kind (whether legal or illegal), transportation interruption, civil disturbance, or any other cause similar or dissimilar beyond the Sponsor’s control.

However, nothing contained in these Rules shall be construed to: (i) constitute the parties as partners, joint venturers, principal and agent, employer and employee, co-owners or entrants in a joint undertaking; or (ii) allow you tocreate or assume any obligation on behalf of the Sponsor
If any fraud, technical failures or any other factor impairs the integrity or proper functioning of the contest, as determined by TVC in its sole discretion, and if terminated, TVC may, in its sole discretion, determine the winners from among all non-suspect, eligible submissions received up to time of such action using TVC’s standard judging procedure. TVC, in its sole discretion, retains the right to disqualify any individual it finds to be tampering with the submission process or the operation of the contest or to be acting in violation of the Official Contest Rules. Any attempt by any person to deliberately undermine the legitimate operation of the contest may be a violation of criminal and civil law, and should such an attempt be made, TVC reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law.
TVC’s failure to enforce any term of these Official Contest Rules shall not constitute a waiver of the provision. TVC has the right to verify your eligibility and compliance with these Rules, and to disqualify you on the basis of its investigation.
By entering the Contest, you fully and unconditionally agree to and accept these Rules and the decisions of the Contest Facilitators and the members of the voting community, which are final and binding on all matters relating to this Contest.
