July 26, 2016
The Cedar County Commissioners met in the Boardroom of the Cedar County Courthouse at 8:30 am and the meeting was called to order as advertised, with Jerry Wiese, David McGregor and Terry Pinkelman answering roll call. Also present County Clerk David Dowling. Chairman McGregor stated the open meetings laws are posted on the wall for public inspection.
Motion was made by Pinkelman and seconded by Wiese to approve the agenda. Motion carried with a 3 to 0 vote. Motion was made by Wiese and seconded by Pinkelman to approve the minutes from the last meeting. Motion carried with a 3 to 0 vote.
Road Supt., Carla Schmidt presented underground easement permit for district two approval and signature. Discussion was held on the STP and HBC funds that are sent to Cedar County from the state and are asking for an explanation of the expenditures, which Schmidt stated none of the funds have been used at this time and stated a project or two being planned for this year should be paid from these funds. Discussion was then held on fences in the road right of way and stated she will mail letters to all residents in violation and stated she needs a list of names from the road department on violations in the county.
Zoning administrator, Dave Sudbeck stated the issue at the zoning board of adjustments was tabled and the local board of adjustments requested obtaining legal counsel for this issue.
Assessor, Don Hoesing presented changes in real estate on parcels 634, 634.01, 635, 1995, 5886.01, 7742.01, 7742, 9616400.01 and 9696000.02. Motion was made by McGregor and seconded by Pinkelman to approve the list of property as presented by the assessor. Motion carried with a 3 to 0 vote.
At 10 bids were opened for the purchase of a low-boy trailer for district one. Bids were received from Sioux City Truck and Trailer, Murphy Tractor, Titan Machinery and Nebraska Machinery. Commissioner Pinkelman stated he would be reviewing the bids and make his decision later in the week and notify the successful bidder and award the bid at the next meeting.
Joan Brodersen, Peggy Leiting and Kami Asbra met with board to discuss budgeting funds for the libraries again this year. Joan Brodersen from Hartington read a statement regarding membership numbers and usage of the libraries in the county. Peggy Leiting from Randolph presented information that is available through the library service. Kami Asbra from Laurel stated they use the money to purchase books and stated the funds are very much appreciated and asked the board to again support the libraries in the county. Asbra also explained some of the other programs that are offered through the library including adult oriented programs. Motion was made by Pinkelman and seconded by Wiese to budget a total of $15,000.00 again this year $6,000.00 for Randolph and Hartington and $3,000.00 for Randolph. Motion carried with a 3 to 0 vote.
County Attorney, George Hirschbach discussed the zoning policies and talked about the proper procedures regarding procedures to protest a zoning permit.

August 9, 2016
The Cedar County Commissioners met in the Boardroom of the Cedar County Courthouse at 8:30 am and the meeting was called to order as advertised, with Jerry Wiese, David McGregor and Terry Pinkelman answering roll call. Also present County Clerk David Dowling. Chairman McGregor stated the open meetings laws are posted on the wall for public inspection.
Motion was made by McGregor and seconded by Wiese to approve the agenda. Motion carried with a 3 to 0 vote. Motion was made by Pinkelman and seconded by Wiese to approve the minutes from the last meeting. Motion carried with a 3 to 0 vote.
Road Supt., Carla Schmidt presented temporary underground easement applications for district three and district two approval. Applications were reviewed and signed for approval as presented. Schmidt then presented resolution 16-09 to upgrade a road to local from minimum maintenance. Motion was made by McGregor and seconded by Pinkelman to approve resolution 16-19. Motion carried with a 3 to 0 vote. Carla stated she has sent two more fence in the right of way notices out to get them removed. Carla reported that the sign tech has been replacing several signs in the county.
Michael Foss met with the board to discuss the area where he lives. Mr. Foss thanked commissioner Pinkelman for the service on the roads in his area and stated in the last three days two areas have been damaged by end guns from irrigators allowing water to be sprayed on the roadway. Mr. Foss also stated law enforcement has been very good with problems they have had near the river.
Dave Sudbeck reported on zoning issues and visited about shared use of the county pickup being used for sign and noxious weed and zoning use. Sudbeck stated he has checked with the railroad on weed control along the tracks.
Kirkham & Michael engineering firm for a box culvert project in district two updated the board on the project and stated it has been ordered to start on October 1 and stated they will handle the project in a timely matter.
County Attorney, George Hirschbach informed the board the law suit over a ditch problem, which started 10 years or more ago and has now gone to the Nebraska Supreme court system.
Clerk of District Court informed the board that it could be months before the court will consider taking the case and stated they could push the case back to the court of appeals.
Assessor Hoesing presented tax corrections on parcels 7603 and 7603.01. Motion was made by McGregor and seconded by Wiese to approve corrections as presented. Motion carried with a 3 to 0 vote.
Commissioner Pinkelman reported on a recent Corps of Discovery meeting he attended talked about trimming trees and normal operation.
With no further business or agenda items the following claims were reviewed and signed for payment and the meeting was declared adjourned.

The Cedar County Commissioners met in the Boardroom of the Cedar County Courthouse at 8:30 am and the meeting was called to order as advertised, with Jerry Wiese, David McGregor and Terry Pinkelman answering roll call. Also present County Clerk David Dowling. Chairman McGregor stated the open meetings laws are posted on the wall for public inspection.
Motion was made by Pinkelman and seconded by Wiese to approve the agenda. Motion carried with a 3 to 0 vote. Motion was made by Wiese and seconded by Pinkelman to approve the minutes from the last meeting. Motion carried with a 3 to 0 vote.
Gerry Thoene, county sign tech asked the board about several sign locations and asked about procedures and different sign placements on various county roads.
Road Supt., Carla Schmidt presented one underground easement for district two approval and then stated Kirkham and Michael is doing fracture critical bridge inspections in Cedar County this year and stated we only have one this year to be inspected. Schmidt then presented information on the 2015 fracture critical bridge inspection reports and stated she will give each district reports on their bridges that need attention. Carla then presented traffic count report on the road east and west of the fairgrounds and on the north and south road. The north road had 1170 with a high speed of 92.6 mph and the east and west report showed 1410 with a high speed of 69 mph. Sign placement on those roads was discussed. Carla then stated she mailed two more letters out on roadside fences and they have since been removed. Carla also stated she has contacted land owners on irrigation systems shooting out on the roads. County Attorney, George Hirschbach stated that after the road supt., has made proper notification and after the days allowed, the county road supt. has the authority to go out and remove the fence. The sheriff can also issue a citation to the land owner.
Treasurer, Wiebelhaus met to discuss distress warrants and attorney Hirschbach presented information regarding tax collections and distress warrants. Motion was made by Pinkelman and seconded by McGregor to strike parcel 10054.01 from distress list for 2013 and 2014 tax years. Motion carried with a 3 to 0 vote. Wiebelhaus then reported the federal government has issued flood control money in the amount of $87,557.57 which one fifth of the money goes to the county and the other four fifths goes to the school districts in the county, based on statute 77-1052. Wiebelhaus stated seventy three percent of the taxes are collected for 2015.
Barb Otto met with the board to discuss a project she is working on to put IN GOD WE TRUST on the courthouse wall someplace in the building. The board agreed to purchase two of the signs.
Dave Sudbeck met to discuss weed control, stating he will be attending a search and destroy project at Santee Boat dock to meet with the corps and use their boats and equipment to destroy salt cedar spots.
With no further business or agenda items the meeting was declared adjourned by the chairman.

A special meeting of the Board of Education, Wynot Public Schools, Dist. 101, was called to order by the President, Neal Hochstein, on August 29, 2016 at 6:58 p.m. The public was advised a copy of the Open Meetings Act was available on the table in the Board Room at Wynot Public Schools and that the meeting was properly posted at the following places; Cedar Security Bank lobby in Wynot, Wynot Public School front entrance, and United State Post Office in Wynot. The meeting began with the Pledge of Allegiance. Roll call showed the following board members present: Neal Hochstein, Alison Lange, Dean Heine, Kenny Wieseler, Laurie Schulte, and Danny Wieseler. Also present was Superintendent Jeffrey Messersmith.
Motion by D. Wieseler and seconded by D. Heine to certify the meeting was properly advertised and adopt the agenda. Carried 6-0 MCU
