Minutes
July 13, 2015
On July 13, 2015 the Hartington City Council met for their regular meeting at the city hall beginning at 7:00 P.M. Notice of time and place of the meeting was given in the advance notice by posting. Notice of time and place of the meeting was communicated in the advance notice to the mayor and council.
Present were Mayor Peitz; Councilpersons Addison, Kruse, Christensen, and Bartling; Legal Adviser Pier; and City Clerk ~ Treasurer Lenzen.
Mayor Peitz called the meeting to order followed by all present reciting the Pledge of Allegiance. He announced that the open meeting law poster was on the back wall of the council room and reminded all present to silence their cell phones.
A motion to approve the minutes of the June 22, 2015 meeting and the June 2015 treasurers report was made by Bartling and seconded by Christensen. A roll call vote was taken. Bartling – yes, Christensen – yes, Kruse – yes, and Addison – yes. Motion carried.
The following Cedar County Sheriff report was given by Deputy Todd Greiner. Hours of patrol were 465. Call of service were 5 EMS assists, 1 coroner call, 2 disturbances, 1 parking complaint, 2 suspicious vehicles, 1 theft, and 1 open door. Traffic stops were 5 verbal warnings, 9 written warnings, 1 citation, and 1 arrest.
Resolution No. 20150713 – Rehabilitation Guidelines – NED, Inc, NENEDD was introduced by Councilman Kruse. A motion to adopt Resolution 20150713 was made by Kruse and seconded by Addison. A roll call vote was taken. Kruse – yes, Addison – yes, Bartling – yes, and Christensen – yes. Motion carried.
The council reviewed a manager application of Tina M. Krings for Casey’s General Store. A motion was made by Addison and seconded by Kruse to approve the application. A roll call vote was taken. Addison – yes, Kruse – yes, Christensen – yes, and Bartling – yes. Motion carried.
Dan Kathol presented pay request No. 5 for the SRF loan. This request would be for the P & E bill in the amount of $115,210.57 for additional dirt removal and seeding. The cost for the seeding will be reviewed with the contractor. A motion was made by Christensen and seconded by Kruse to table the pay request No. 5. A roll call vote was taken. Christensen – yes, Kruse – yes, Addison – yes, and Bartling – yes. Motion carried.
Mr. Kathol also presented a request to mow the reservoir/retention pond area. He has obtained an estimate from Jueden Lawn Service. It would be for 18.5 acres at $40.00 per acre for a total of $740.00. A motion to approve the one time mowing for $740.00 and to review later if a second mowing and fall spraying is necessary was made by Addison and seconded by Christensen. A roll call vote was taken. Addison – yes, Christensen – yes, Bartling – yes, and Kruse – yes. Motion carried.
The Community Redevelopment Authority reappointments were the next agenda item. The Authority consists of five board members. Reappointments were Randy Kathol and Brandon Baller. A motion to approve the reappointments was made by Christensen and seconded by Bartling. A roll call vote was taken. Christensen – yes, Bartling – yes, Kruse – yes, and Addison – yes. Motion carried.
The following department reports were given.
PARK/POOL – Councilwoman Addison: The new building at the complex has been insured for a value $22,000.00.
COMPLEX/AUDITORIUM – Councilman Kruse: An estimate will be obtained for doors for the complex building. The gym floor will be worked on the end of July, Wiechelman is building stronger stands for the basketball hoops, and Miller Painting is painting the gym and auditorium entry way.
FIRE/AMBULANCE – Councilman Christensen: None
GENERAL – Mayor Peitz: The new sign has been installed for the new fire and ambulance facility.

Carla Becker presented information pertaining to two grants that the Economic Development Corporation is applying for. One is a planning grant for the new industrial site and one is for a housing development master plan for Westfield Acres Phase II. Matching funds would come from LB840.

Minutes
June 8, 2015
The Regular Meeting of the Chairman and Board of Trustees of the Village of St. Helena, Nebraska was held on June 8, 2015 at the St. Helena Hall. Notice of the hearing was given in advance by posting in three public places within the Village of St. Helena.
Present were Chairman Victor Paltz, Trustees Jody Albrecht, Loren Bender and Clerk Paula Pinkelman. Clair Wieseler and Audrey Pinkelman were absent.
Minutes of the May 11, 2015 meeting were read and approved with a motion by Jody Albrecht and seconded by Loren Bender with all in favor.
A motion was made by Loren Bender and seconded by Victor Paltz to approve the financial report as read with all in favor.

The final paperwork requested by NDEQ was completed and submitted therefore the water tower project loan process is now completed.
Victor Paltz has talked with Cedar-Knox PPD in regards to reinstalling the light pole that was previously removed.
Victor Paltz attended the Dept. of Roads meeting that was held in Wynot on May 12, 2015. There was a suggestion that when we do the village street work we should not mill the streets but rather just do an overlay instead.
Culvert repairs still need to be done. Victor Paltz will get bids from local contractors and set up a plan to get the work done.
The next meeting will be July 13, 2015 at 6:00 P.M. With no further business to discuss Loren Bender made a motion to adjourn the meeting at 7:15 P.M. and Jody Albrecht seconded the motion with all in favor.

The regular monthly meeting of the Village Board of Wynot was called to order at the Wynot Town Hall on Wednesday, July 15, 2015, at 7:00 p.m. by Chairperson John Eskins Jr. . Notice of the meeting was posted in three (3) public places on Tues, June 11, 2015, at 1 p.m., namely the Wynot Town Hall, Wynot Post Office, and the Cedar Security Bank. Roll call indicated members present: John Eskins, Charles Jones, Ron Rolfes, and Maurice Ketter not present was Jim Hans. Also present were Rose Rolfes, Village Clerk/Treasurer, Dave Koch, Maintenance; and Jody Koch. Ron Rolfes made a motion to approve the Consent Agenda including the following: Minutes of the June 10, 2015, Regular Village Board Meeting; Village of Wynot’s Treasurer’s Report for June 2015; and the Claims attached hereto, Charles Jones seconded the motion. Motion Carried.
Building Permits
A building permit was read by Norma Foster. Motion by Maurice Ketter to approve the building permit, Charles Jones seconded it. Motion carried.
Back Lot
Motion was made Maurice Ketter to add red rock to back lot and add a couple of trees. Ron Rolfes seconded it. Motioned carried.
Tree Dump
Discussion was held on currant tree dump. Mike Steffen has closed hole and dug a new one. Days and hours of new lot will be posted shortly. Charles Jones will keep the board posted on results.
Dog Ordinance
Discussion was held on pit bulls being allowed in the city limits of the Village of Wynot. Attorney Mike Stevens presented an ordinance. Motion was made by Ron Rolfes to accept ordinance 15-001, Charles Jones seconded it.

VILLAGE OF WYNOT,
NEBRASKA
AN ORDINANCE REPLACING MUNICIPAL CODE SECTION 6-110 RELATING TO THE PROHIBITION OF VISCIOUS DOGS WITHIN THE CORPORATE LIMITS AND ZONING JURISDICTION OF THE VILLAGE OF WYNOT, NEBRASKA; DEFINING VICIOUS DOGS; PROVIDING PENALTIES; REPEALING ALL CONFLICTING ORDINANCES; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE BOARD OF THE VILLAGE OF WYNOT, NEBRASKA AS FOLLOWS:
SECTION 1. That from and after the effective date of this ordinance, the following ordinance concerning the prohibition of owning, keeping or harboring a “vicious” dog in the corporate limits and zoning jurisdiction of the Village of Wynot, Nebraska, be and is hereby adopted and shall be hereinafter referred to as Municipal Code Section 6-110 shall read as follows:
6-110 Dogs: Vicious Dog.
a. It shall be unlawful for any person to own, keep, or harbor a vicious dog within the corporate limits or zoning jurisdiction of the Village of Wynot, Nebraska.
b. A vicious dog is defined as follows:
(1) Any dog with a known propensity tendency or disposition to attack unprovoked, to cause injury to, or otherwise threaten the safety of human beings or domestic animals; or
(2) Any dog which because of its size, physical nature, or vicious propensity is capable of inflicting serious physical harm or death to humans and which would constitute a danger to human life or property if it were not kept in the manner required by this article; or
(3) Any dog which, without provocation, attacks or bites, or has attacked or bitten, a human being or domestic animal; or
(4) Any dog owned or harbored primarily or in part for the purpose of dog fighting, or any dog trained for dog fighting; or
(5) Any pit-bull terrier, which shall be defined as any American Pit-bull Terrier or Staffordshire Bull Terrier or American Staffordshire Terrier breed of dog, or any mixed breed of dog which contains as an element of its breeding the breed of American Pit-bull Terrier or Staffordshire Bull Terrier, or American Staffordshire Terrier as to be identifiable as partially of the breed of American Pit-bull Terrier or Staffordshire Bull Terrier, or American Staffordshire Bull Terrier; or
(6) A Rottweiler, Doberman, Wolf, Wolf-Hybrids or Wolfhound.
c. If a dispute exists as to whether a dog within the Village or its zoning jurisdiction is of the breed or has the primary characteristics of one of the breeds of dogs determined to be a vicious dog as defined herein, the Village shall employ a licensed veterinarian to examine the animal or pictures of the animal to determine whether such animal is one of the breeds or has the primary characteristics of the breeds determined to be dangerous.
d. Any person, firm or other legal entity violating the terms of this ordinance shall be fined in a sum not to exceed $500.00 and each day’s violation shall be a separate offense.
SECTION 2. REPEAL OF CONFLICTING ORDINANCES. All ordinances or parts of ordinance in conflict herewith are repealed. Specifically, current municipal code section 6-110 is being replaced with the above revised language.
SECTION 3. EFFECTIVE DATE. This ordinance shall go into force and effect from and after its passage, approval and publication as required by law.
