Minutes

September 9, 2014

The Cedar County Commissioners met in the Boardroom of the Cedar County Courthouse at 8:30 am and the meeting was called to order as advertised, with Jerry Wiese, David McGregor and Terry Pinkelman answering roll call. Also present County Clerk David Dowling. Chairman McGregor stated the open meetings laws are posted on the wall for public inspection.

Motion was made by Pinkelman and seconded by Wiese to approve the agenda. Motion carried with a 3 to 0 vote. Motion was made by Pinkelman and seconded by Wiese to approve the minutes from the last meeting. Motion carried with a 3 to 0 vote.

Road Supt., Carla Schmidt presented an underground easement for district three approval. Schmidt then reviewed a sign audit report received from NIRMA. Chairman McGregor asked Carla to break the report down by district for each commissioner.

Dave Sudbeck, Zoning Administrator/Weed Supt., reported on a possible new residence in the county and stated he had nothing to report on weed control.

Motion by Pinkelman and seconded by McGregor to go into board of equalization. Motion carried with a 3 to 0 vote. Assessor Don Hoesing presented a list of parcels that valuation corrections were made. A protest on parcel 2662 was reviewed as presented by the land owner and was discussed with assessor Hoesing. Motion was made by McGregor to deny the protest and retain current value. Motion was seconded by Wiese and the motion carried with a 3 to 0 vote. At 10 bids were opened from two vendors in the county to be purchased by district two for a service truck. District two commissioner stated he would like to review each bid and then made a motion was made by Wiese and seconded by McGregor to accept the bid from Peitz GMC to purchase the gas pickup as bid and will notify the successful bidder. Motion carried with a 3 to 0 vote.

David and Anna Marie Haselhorst met with the board to discuss a bridge project near their property. Carla Schmidt stated she had called the engineer and stated that the repair to replace the bridge would be very costly. The stated they would contact them before anything is done to the bridge replacement.

At 11 the budget hearing was opened as advertised. With no questions from the audience the hearing was closed and hearing was opened for setting the final tax request. With no questions on the tax request the hearing was closed.

Motion was made by McGregor and seconded by Wiese to approve the budget for 2014-2015 and set the final tax request at $4,824,042.00. Motion carried with commissioners Wiese, McGregor and Pinkelman voting in favor of the motion.

September 23, 2014

The Cedar County Commissioners met in the Boardroom of the Cedar County Courthouse at 8:30 am and the meeting was called to order as advertised, with Jerry Wiese, David McGregor and Terry Pinkelman answering roll call. Also present County Clerk David Dowling. Chairman McGregor stated the open meetings laws are posted on the wall for public inspection.

Motion was made by Wiese and seconded by Pinkelman to approve the agenda. Motion carried with a 3 to 0 vote. Motion was made by McGregor and seconded by Pinkelman to approve the minutes from the last meeting. Motion carried with a 3 to 0 vote.

Road Supt., Carla Schmidt reported on a mine safety meeting and training that is scheduled to take place next month. The board decided to set up the training on the 18th of November this year with NIRMA and having Chad Engle for the instructor. Carla then stated plans are being worked up for some bridges for FEMA assistance. An interlocal agreement was reviewed as amended by County Attorney, George Hirschbach regarding the Laurel Ag Rex road. Keelan Holloway had informed the board that the City of Laurel is fine with the revision made by the county attorney. Motion was made by Wiese and seconded by McGregor to approve the agreement with Laurel on the road near the Ag Rex property in Laurel. Motion carried with a 3 to 0 vote.

John Thelen approached the board on an issue with a fence that was removed from the road right of way near his property. The fence was removed by the county because it was in violation of the law. The county attorney then explained the law regarding fence placement and the reasons the fence cannot be placed in the right of way. Thelen asked if he could get a two week easement to keep the fence and then he would get it taken out. The board agreed to the two week easement and then asked Thelen if would make a permanent change so the fence doesn’t get placed into the right of way next year. Thelen did not reply to the question. The board then stated the fence will not be allowed next year and will be removed if placed into the road right of way.

Wiese stated he attended a meeting on the Area on Aging and said things are going very good with that organization. Wiese then reported on the Region IV meeting stating the group is working on getting the Legislature to put some money into the organization.

With no further business or agenda items the meeting was declared adjourned.

HARTINGTON CITY COUNCIL

Minutes

September 8, 2014

The Hartington City Council met for their regular meeting and the budget public hearing on September 8, 2014 at the city hall beginning at 7:00 P.M. Notice of the time and place of the meeting and the public hearing was given in the advance notice by posting. Notice of time and place of the meeting and public hearing was communicated in the advance notice to the mayor and council.

Present were Mayor Peitz; Councilpersons Addison, Kruse, Christensen, and Bartling; Legal Adviser Pier; and city clerk ~ treasurer Lenzen.

Mayor Peitz opened the budget public hearing at 7:02 P.M. Mike Pommer, CPA, was present to review the budget and answer any questions. The total taxable value is $82,601,104. The property tax request is set at $477,025.00. Last year’s levy was 0.351391 and this year is 0.354848. The public hearing was closed at 8:10 P.M.

Mayor Peitz called the regular meeting to order at 7:11 P.M. followed by all present reciting the Pledge of Allegiance. He announced that the open meeting law poster was on the back wall of the council room and reminded all present to silence their cell phones.

A motion was made by Kruse and seconded by Christensen to approve the minutes of the August 25, 2014 meeting. A roll call vote was taken. Kruse – yes, Christensen – yes, Addison – yes, and Bartling – yes. Motion carried.

The following building permits were presented and reviewed. Lori Koch – storage shed and Rick Sudbeck – storage building and garage. Mr. Sudbeck may request a variance. A motion was made by Christensen and seconded by Bartling to approve the Koch permit and the Sudbeck permit as the set backs were described on the permit. A roll call vote was taken. Christensen – yes, Bartling – yes, Kruse – yes, and Addison – yes. Motion carried.

Mayor Peitz introduced Resolution 20140908 – setting the final tax request. The tax request has been set at $477,025.00. A motion to adopt the resolution was made by Christensen and seconded by Kruse. A roll call vote was taken. Christensen – yes, Kruse –yes, Bartling –yes, and Addison – yes. Motion carried.

Ordinance No. 835 – vacating a street was explained by Legal Adviser Pier. A consent paper from one of the property owners adjacent to the street had not been returned, so no action could be taken. A motion to table the agenda item was made by Addison and seconded by Kruse. A roll call vote was taken. Addison – yes, Kruse – yes, Bartling – yes, and Christensen – yes. Motion carried.

Resolution 20140908 A – establishing fees for the operation and funding of the city cemetery was introduced by Mayor Peitz. Cemetery lots will be $250.00 per lot and interment fee will be $125.00.

A motion to adopt Resolution 20140908 A was made by Addison and seconded by Christensen. A roll call vote was taken. Addison – yes, Christensen –yes, Kruse – yes, and Bartling – yes. Motion carried.

The following Cedar County Sheriff report was given by Deputy Howell. Patrol hours were 406 and school traffic 9.25 hours. Calls of service were 6 EMS assists, 1 coroner call, 1 missing person, 2 accidents, 1 suspicious person, 2 criminal mischief, 2 animal complaints, and 2 parking complaints. Traffic stops were 6 verbal warnings, 11 written warnings, and 4 citations.

The following department reports were given.

PARK/POOL – Councilwoman Addison: Nothing on park/pool. A lady representing Passport Nebraska had stopped at her office and gave a compliment on a great community we have.

COMPLEX/AUDITORIUM – Councilman Kruse: The steps, platform and handicap ramp are complete at the auditorium, waiting for Wiechelman to complete the railings. Repairs to the complex railings are done.

FIRE/AMBULANCE – Councilman Christensen. Gave an update on the new fire hall. Plans are being done for an open house.

GENERAL – Mayor Peitz: Gave an update on the asphalt overlay street project.

Legal Adviser Pier had received a telephone call pertaining to shooting off fireworks after the homecoming football game of Cedar Catholic. He gave an overview of the State and City rules and regulations pertaining to fireworks.

Clerk Lenzen presented information pertaining to a fund raiser for Gene Haberer.

AN ORDINANCE OF

THE CITY OF

HARTINGTON, NEBRASKA

VACATING GOETZ STREET WEST OF ROBINSON AVENUE, IN THE CITY OF HARTINGTON, NEBRASKA.

WHEREAS, Steven L. Steffen, Jayne L. Steffen, Joshua Lee Climer and Candice K. Climer, are the owners of real estate abutting Goetz Street west of Robinson Avenue between Lots One (1), Two (2), and Three (3), Block Six (6) Felber Place Addition and Lots Seven (7), Eight (8), Nine (9), Ten (10), Eleven (11), and Twelve (12), Block One (1), Felber Place Addition to the City of Hartington, Nebraska, and have requested said street be vacated; and

WHEREAS, the City of Hartington, Nebraska, is the owner of Lots Four (4), Five (5) and Six (6), Felber Place Addition to the City of Hartington, Nebraska, which real estate also abuts Goetz Street west of Robinson Avenue.

BE IT ORDAINED by the Mayor and Council of the City of Hartington, Nebraska:

1. 2. The City of Hartington, Nebraska reserves an easement over, upon and under said street for the purpose of maintaining, operating, repairing or renewing any and all utilities.

3. The abutting property owners have waived any claim against the City of Hartington, Nebraska for any special damages.

4. Goetz Street west of Robinson Avenue between Lots One (1), Two (2), Three (3), Four (4), Five (5) and Six (6), Block Six (6), Felber Place Addition and Lots Seven (7), Eight (8), Nine (9), Ten (10), Eleven (11), and Twelve (12), Block One (1), Felber Place Addition to the City of Hartington, Nebraska, is hereby vacated subject to the reservation of an easement as aforestated and ownership of said street shall revert to the owners of the abutting real estate, one-half (1/2) on each side thereof.

The public is advised a copy of the Open Meetings Act is available on the table in the Board Room at Wynot Public Schools. Roll call showed the following board members present: Neal Hochstein, Dean Heine, Laurie Schulte, Kenny Wieseler. Danny Wieseler and Alison Lange. Also present were Superintendent Jeffrey Messersmith, Principal Richard Higgins and Business Manager Nancy Sydow.

Notice of the meeting was given in advance by publication and/or in accordance with the Board approved method of giving notice of meetings. Notice was given in advance to all members of the Board of Education. Availability of the agenda was communicated in the publicized notice and a current copy of the agenda was maintained as stated in the notice.

A regular meeting of the Board of Education, Wynot Public Schools, Dist. 101, was called to order by the President, Neal Hochstein, on September 15, 2014 at 9:19 P.M. The public was advised a copy of the Open Meetings Act was available on the table in the Board Room at Wynot Public Schools and that the meeting was properly posted at the following places; Cedar Security Bank lobby in Wynot, Wynot Public School front entrance, and United State Post Office in Wynot. The meeting began with the Pledge of Allegiance. Roll call showed the following board members present: Neal Hochstein, Dean Heine, Laurie Schulte, Kenny Wieseler, Danny Wieseler and Alison Lange. Also present were Superintendent Jeffrey Messersmith, Principal Richard Higgins, and Business Manager Nancy Sydow.

Motion by D. Heine and seconded by L. Schulte to certify the meeting was properly advertised and adopt the agenda. Carried 6-0

The Principal’s, Superintendents, and Board Committee reports were presented.

Sealed bids will be received by the Cedar County Clerk until October 14, 2014 at 10:30 a.m. for the construction of two grading projects and other incidental work. The project is referred to as “Fordyce Northwest, FEMA 894 Road” and includes a total of 208 feet of grading and other incidental work on 894 Road in Cedar County, Nebraska.
