Last week, tech big shots like Apple CEO Tim Cook, Alphabet CEO Larry Page and Microsoft CEO Satya Nadella met with Trump in New York. You can bet the pitch was similar.
Their economic argument, that the industry suffers from a shortage of workers, is false and misleading. Big tech companies take advantage of the H1B program to drive their bottom line. The law permits companies to lay off their own employees in favor of foreign workers doing the work in the states or overseas. Think about that. The law does more than look the other way at firms that hire foreign workers instead of American citizens; it allows companies to ditch their own employees so they can hire foreign nationals. Remember the recent story about laid-off Disney workers who were forced to train their foreign replacements?
Not surprisingly, tech firms use the provision to their advantage. In late 2014, Microsoft laid off 21,000 workers. In September 2015, Hewlett Packard announced it was cutting 25,000 to 30,000 workers. That was on top of the 55,000 jobs it slashed the year before.

Another problem with the H1B program is the law rewards companies for outsourcing their training programs. About half, or 40,000 of the visas handed out each year, don’t go to firms such as Microsoft, Apple or Facebook, the companies we think about when we hear H1B. They go to professional offshore outsourcing firms such as Cognizant, which received 9,000 H1B’s last year.
Outsourcing firms operate an almost pyramid-like system: they bring foreign nationals to the United States, who then learn the jobs of American citizens. Then these foreign workers return home overseas. Many times, the best workers in India arrive in a tech-friendly city such as Seattle, learn the ins and outs of their host company, fly back to the subcontinent to run a call center or IT department, and train their workers with the skills they learned in the United States.

I am a Middle Eastern woman who came to the US as a graduate student in 2014. During the presidential election, I supported the Trump campaign and as a result I got in to heated discussions with many of my liberal friends and colleagues. I completely understand that Trump’s style is brash and unorthodox and he can be extremely critical of sensitive issues which puts him at odds with liberals and most of the world. However, I truly believe he defends the interest of the American people. Being the reader of this article you might ask yourself why I am supporting his policies despite his attitude toward Middle Easters and immigrants. I believe many would change their minds about his policies concerning immigration and H1B if they finished reading this article.
At the moment the President is trying to pass a bill to increase the minimum salary of H1B visa holders and is looking to implement tougher background checks on H1B applicants, as a result many American liberals are attacking him. Some Americans believe that the H1B is the engine of innovation and high technological jobs that they say Americans are unable to perform. However, there is immense evidence that proves H1B is not only taking jobs from Americans but also from true foreign talent.
Trump met with the CEO’s of large American corporations who claimed they are unable to find qualified American workers. Therefore, they are asking the president to review his new immigration policies along with the H1B visa bill.
Here I am going to talk about what made America the greatest country in the world and why it is necessary for everyone to recognize these values so will be able to identify what policy is good and benefits America and what policy is not. My father was in the US about 40 years ago and his experience is totally different from what I have observed here. I always loved American values such as honesty and hard work that my father talked about it all the time, but in my opinion these values are not respected by some of immigrants and that is why I think it is necessary that someone like Trump protects and revives these values. Trump is right when he talks about broken immigration system or giving jobs to Americans. The growing corruption in the job market especially in the IT industry is very dangerous for the future of this country. The IT industry has one of the highest pay rate jobs in the US, It also produces jobs more than any other industry in the US. However, this rich, vibrant industry is mostly controlling by Indians in the US not because they are intelligent.
The long story short, there are many staffing agencies, that recruit foreign students from third world countries such as India with absolutely no work experience. They are told to create fake resumes with 7 to 10 years experience and then staffing agencies teach them how to effectively lie in order to deceive recruiters and be hired by American corporations. Meanwhile American students who have earned legitimate college degree remain unemployed. Another point worth mentioning is, even the foreign students not willing to commit fraud also remain unemployed in the US. American citizens have no chance of interviewing for these positions since there isn’t fair competition in the market and also they don’t get hired by those staffing agencies. The other issue is foreigners and professionals with lower but with credible work experience most likely will remain unemployed too. When I am speaking about fake or unreal, Let me explain in more detail. It is my guess there are approximately 300 staffing agencies, that train fresh foreign graduates for 4 to 6 weeks for jobs like business analyst or quality assurance, they are then sent to companies like Wells Fargo, Chase, Molina Healthcare, BCBS, United Healthcare and other huge American companies with a pay rate of approximately $50.00 to $100.00 per hour but the students get paid between $25.00 to $35.00 per hour. The revenue from these Indian agencies exceeds 30 million dollar per year. Imagine the feeling of those Americans or foreigners who work hard to establish legitimate businesses. If the US government were to investigate the IT contractors of some of these American corporations mentioned above, they would find that almost all of the contractors have entered with falsified credentials and counterfeited immigration documents because these agencies introduce them as Green Card holders or US Citizen. The resume of those students include about 7 to 10 years of false experiences with projects in the very well-known companies while they just graduated and they are 21 to 28. Now the new America is not about the hard work and honesty, it is about who is telling the best lies and the system rewards them for it. This is unfortunate that even if Americans enter the IT industry they have to work hard for 5 years to be in the same position that the foreign students get in less than one month.
Why Is This Happening?
American companies don’t want to spend time and money to train potential employees and keep them indefinitely. They want a huge replaceable labor force so they’ll have the option of dismissing them whenever they want. By doing so, they also will be able to maintain unemployment rate which prevents an inflated economy but unfortunately, the unemployed Americans or honest foreigners who don’t want to contribute in fraud will remain unemployed.
Economics Impact
The economic impact of these fraudulent businesses is horrific. Over 50% of US corporations had failed IT projects last year, mostly due to a lack of properly trained business analyst. In addition the productivity of these students are quit low, but they are hired as experienced contractors. American companies unknowingly inject a lot of cash into this fraudulent system, while they should hire American students or qualified foreign students and pay them lower rate and spend the rest of it to train their workforce which is more efficient.
On the other side the real brain power and scientists have a much lower chance of receiving H1B and work in the US. The United State has an annual limit on issuing H1B visa, however, the US government has decided to apply a lottery system since the number of H1B applications have increased tremendously within the past 10 years due to these fraudulent business practices. It means that many real scientists are not able to receive this visa because their names have not been selected by the lottery. In fact the US is losing its brain power since the government doesn’t investigate the applicants’ background properly. Americans are simply excluded from this thriving market because staffing agencies fear that their dirty game would be exposed to the public. I have really no idea how these industries are created but I know a firm and strong man like Trump would be able to end this nonsense which is happening in this country right now.
Liberal and Business Owners point of view:
Dr. Michio Kaku believes that the H1B is a Americas secret weapon. He would be absolutely right provided the H1B is granted according to some standard. Unfortunately 2/3 of H1B visas go to IT workers, which is a relatively high number of them is quality assurance and business analyst. Hiring unreal professional and eliminating Americans from the IT job market does not benefit America or its economy. I challenge the government to investigate the backgrounds of H1B holders and find out just how many of them have just graduated from college with absolutely no work experience and doing the job that Americans are not able to do them while American students are having a difficult time to get in the same positions or market. Dr Kaku mentioned that stupidity rank is increasing in the US and that is why H1B is necessary for the economy. Americans are not stupid, they are not given the same opportunities that the other international people receive here therefore, there is harder for them to grow.
Also Dr. Kaku criticized the US’s educational system. It is good to know that thousands of foreigners come to the US every year to study in this so called broken educational system and after graduation, they are called the brain power of this country. It would be worthy to mention the US still has the highest ranked universities in the world.
During the meeting of CEO with Trump in the white house, the companies’ CEO mentioned that they are not able to find the qualified people for the jobs. I really think the government needs to regulate these companies. How these companies issue such complicated criteria in their jobs descriptions and qualifications while these jobs are filled with students who have no experience. Therefore it would be logical to conclude that most of those qualifications are not necessary to do the jobs and in fact is a learning process. Actually, every American student is able to do these jobs if the companies provide them two to three weeks training.
Solution:
First, government should regulate the H1B visa intensively. These regulations can be included minimum education, experience, and the type of jobs and also the entity who applies for their H1B. Increasing the minimum salary of H1B holders is a great initiative from the Trump administration. If this bill is passed, those agencies would not be able to pay to their consultants. In addition, running this kind of business would not be profitable anymore. However, qualified scientists already earn such annual salary since their expertise is in high demand. This bill will benefit America’s economy and American people. It also benefits the scientists who are willing to work in the US and receive legal status.
Second, government agencies should monitor available IT positions with companies and mandate that American citizens have first priority and train them for these jobs instead of hiring fake unproductive foreigners and paying them huge salaries with training. I believe it is totally fine for foreigners work in the US but this fraudulent system should end immediately.
