The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present:  Vice-Chairman Keja Whiteman, Travis Becker, Stephanie Kessler and Larry Allen.  Chairman Thompson was absent for professional reasons.  County Clerk and Clerk of the Board Julie A. Freese was present for the meeting.

Larry Allen moved, Stephanie Kessler seconded, to approve the Agenda as presented.  Motion carried unanimously.

Travis Becker moved, Larry Allen seconded, to approve the Minutes of the Regular Meeting held on November 4, 2014.  Motion carried unanimously.

Larry Allen moved, Stephanie Kessler seconded, to accept the regular bills for payment.  Commissioner Becker abstained from voting on The Print Shop voucher.  Motion carried unanimously.  Commissioner Becker asked for clarification on several vouchers within the Fremont County EMS system and Liaison Commissioner Allen will visit with the department and report back.

Larry Allen moved, Stephanie Kessler seconded, to accept a voucher to Fremont Counseling Service in the amount of $4,340.00 and Sage West Health Care in the amount of $13,116.00 for Title 25 patients.  Motion carried unanimously.

The following items in the Signature File were reviewed:  1) HR training certificates for “Handling Employee Complaints” and 2) Record of Proceedings.    Larry Allen moved, Stephanie Kessler seconded, to approve an Interagency Agreement between Wyoming Department of Health, Division of Healthcare Financing and Fremont County Public Health Nursing.  Motion carried unanimously.  Larry Allen moved, Travis Becker seconded, to approve a Grant Award for U.S. Department of Homeland Security Federal Emergency Management Agency for subrecipient grants to the City of Lander ($5,367.06) and Fremont County Fire Protection District ($7,197.45).  Motion carried unanimously.  Larry Allen moved, Stephanie Kessler seconded, to approve a 2012/2013 Subaward Agreement between Volunteers of America Northern Rockies and Fremont County in the amount of $32,939 for federal fiscal year ending September 30, 2015.  Motion carried unanimously.  Larry Allen moved, Travis Becker seconded, to approve Amended Resolution 2014-01 adding investment firms for the purchase, sale, transfer and exchange of U.S. Government agency securities.  Motion carried unanimously.  (A complete copy of the Resolution is on file in the Commissioners Office).

Larry Allen moved, Travis Becker seconded, to accept a voucher from EBMS for health insurance claims in the amount of $869.55.  Motion carried unanimously.

County Clerk Julie Freese reviewed discussion with a representative from Utility Bill Solutions Group stating the former company went through a series of ownership changes that interrupted the flow of services to clients.  The County retained the former company in 2010 to audit utility bills to see if there were any savings or refunds available.  As the audit was not performed at that time due to ownership changes, the new company is requesting the County sign an addendum an updated authorization form to activate the existing agreement.  The company provides their services free of charge if they cannot yield savings or refunds.  Stephanie Kessler moved, Travis Becker seconded, to approve the addendum with Utility Bill Solutions Group.  Motion carried unanimously.

Larry Allen moved, Stephanie Kessler seconded, to adjourn into Executive Session with County and Prosecuting Attorney H. Michael Bennett regarding potential litigation.  Motion carried unanimously.  Sheriff Hornecker and Deputy County Attorney Jodi Darrough were present.  Travis Becker moved, Larry Allen seconded, to return to Regular Session.  Motion carried unanimously.  Attorney Bennett will forward Resolutions requesting outside council on several upcoming cases due to conflict of interest.

Sheriff Skip Hornecker presented a monthly report.  Detention statistics total 170 on the total roster with one juvenile housed out of county.  This compares to one year ago of 168 on the total roster and one inmate housed out of county.  Of the total 170 inmates, 67 are sentenced and there were 170 intakes recorded in October.  There are 103 inmates in detention pre-adjudicated.  The Communications Center has two open positions.  Several Communications officers are attending a state conference.  Detention has three open certified positions.  The open Patrol position in Dubois has been filled and the applicant will report for duty by the end of the month.

Sheriff Hornecker reviewed a draft Memorandum of Understanding between Fremont County Sheriff’s Office and PAWS for Life Animal League.  The MOU will obligate funding for animal control within Fremont County, not to exceed $9,000 budgeted for the fiscal year.  The cost of the care provided will be $10/day per dog for a period of seven days, after which time any associated costs will be absorbed by PAWS.  The MOU will be finalized in the near future.

In a final matter, Sheriff Hornecker will schedule a meeting with stakeholders in the County regarding Title 25 patients (involuntary commitments).  He stated the Sheriff’s Department has had eight transports within the last six weeks to Wyoming Behavioral Institute in Casper.  He stated it is not the responsibility of his Department to transport these individuals.  He will ask that a Commission representative be a member of the stakeholder meeting when scheduled.

County Clerk Julie Freese and Financial Assistant Jim Anderson presented a preliminary budget hearing.  Library Director Tracy Cook was present to review the SLIB grant of $573,000 for the Riverton Library Roof (Phase I) Project.  She stated the County’s infusion of $250,000 will only be used if an additional SLIB Mineral Royalty Grant application from SLIB is awarded in January of 2015 for the drainage project (Phase II).  Youth Services Director Chuck Kratz reviewed a VOA and OJJDP annual grant award of $32,939, also part of the Unanticipated Revenue budget hearing.  The earlier requested amount from Sheriff Hornecker of $9,000 to be transferred from the Cash Reserve to his Department will also be advertised.  The adjustments will be advertised and the Public Hearing will be held November 25th.

Public Health Nursing Manager presented a powerpoint presentation on Life R U Ready.  She stated that based on a community assessment performed in 2011 and the report completed in 2012, indicated the community wants safe schools, good health care and concerns throughout the county was expressed regarding drug and alcohol abuse.  This program began in Gillette and lets kids be in a safe environment to see what bad consequences they may face if they choose to participate in alcohol and/or drugs.  They offered the program to 101 6th grade participants from Dubois, Shoshoni, Wind River and Fort Washakie schools in May of 2014 and the activity was held at the Fremont Center at the Fairgrounds.  This age group is the targeted age as they will begin to face many life altering decisions in the next few years.  The program was a huge success due to the efforts of Kathy Laidlaw, Nurse Supervisor, present for the discussion, and who did most of the organizational work with the 42 agencies and community members that participated (Police Department, Coroner’s Office, Injury Prevention Resources, Wyoming Highway Patrol, etc.).  They also had a speaker from the Department of Vocational Rehabilitation, a young women that suffered traumatic brain injury following being involved in a vehicle wreck while impaired.  They plan to invite the larger schools for their next session as the first session with the smaller schools was more manageable for their first presentation.

Julie Twist was then joined by Jamie Cardine for a Family Planning update.  The Riverton clinic was closed and the program was absorbed by Public Health.  Medical Director Dr. Hopkin reviews all their charts and Trish DeClue is a new provider and will see clients at Lander Medical Clinic by appointment.  Other providers in the Clinic stated they will refer patients to the program as well.  They reviewed statistics between 2006 and 2011 that indicated Fremont County had the highest number in the state of teen pregnancies.  They discussed revenue vs. expenditures of the program and stated they are getting closer to sustainability.

Transportation Superintendent Dave Pendleton presented additional documents related to the Notice to Proceed to S & L Industrial for the County-Wide Sign Replacement 2014 project.  The Chairman signed the appropriate document.  He presented a Memorandum of Agreement for Maintenance of Dry Creek Road between Fremont County Government and Cameco Corporation.  The MOA was the first step in moving the project forward.  The next step is for the WDEQ’s Abandon Mine Lands Division to assemble a master agreement for the project that will identify all of the entities involved and define their roles and responsibilities for the project.  Once that agreement is signed, it will release project funding so that it may be designed and constructed.  Once construction improvements have been completed on the 7.6 mile portion of the Road, it will then become a county-maintained roadway once it is approved by the Board of Fremont County Commissioners.  Travis Becker moved, Stephanie Kessler seconded, to approve the Memorandum of Understanding as presented.  Motion carried unanimously.

Dave Pendleton presented Change Order No. 2 from Alexander Excavation for the North 2nd Street Realignment Project.  This represents an addition of $31,996.70 for the addition of geogrid reinforcement and a 2-feet thick layer of coble rock as a result of sub-surface conditions on the inside of the curve.  Travis Becker moved, Larry Allen seconded, to approve Change Order No. 2 as presented.  Motion carried unanimously.  A Certificate of Substantial Completion was then presented, as a result of an on-site meeting conducted on October 31, 2014.  A tentative list of items to be completed was generated as a result of  that meeting before the project would be considered fully complete.  The list included reclamation of the disturbed areas, chip-sealing and pavement striping.  Larry Allen moved, Stephanie Kessler seconded, to approve the Notice of Substantial Completion.  Motion carried unanimously.  Commissioner Becker voiced concerns that had arisen during this project and he asked Pendleton to look into future contracts to help identify potential problems before the bid is let.

A spreadsheet of Optional One Percent Projects was distributed by Dave Pendleton for review.  He further shared meeting notes of a One Percent Committee Meeting held on October 23rd where each of the projects’ progress was reviewed.  The general consensus of the Committee members was that the projects are moving forward in the right direction and they should stay the course on project goals.  The Committee applauded Dave and the County for being aggressive in applying for grants to stretch the One Percent funding.  During that meeting, James Gores pointed out that at $6.2 million in grant funding, it nearly equals the amount of One Percent Funding that has been spent on projects, stretching the $12 million to $18 million when completed.  The Gabe’s Road Bridge relocation and road realignment project was discussed in depth, and DOWL HKM Engineer Dr. Kasey Jones was present for the discussion.  Pendleton stated that the One Percent Committee approved this project because of safety concerns pertaining to vehicles traveling nearly one mile of canal bank with an open canal on one side with anecdotal reports of prior crashed into the canal.  Also, the 90 degree curve at both ends is difficult for longer vehicles, particularly trucks crossing the bridge which annually results in severe guard rail damage.  Commissioner Becker met with the owner of the property that was originally proposed for use to realign the road across Pilot Canal and reported the landowner has no interest in allowing the road to be built across his property.  Dr. Jones presented six options for the Board to consider, from leaving the bridge and road at its present location to relocating the bridge and rerouting to the west.  Pros and Cons with each option were presented for discussion.  The Board suggested they meet with the Canal company and WYDOT regarding the various options to see if they are even a possibility and then schedule a meeting with landowners in the area to discuss the options and get their feedback.

Commissioner Allen relayed comments he routinely receives on the Moneta-Lysite Road with the high truck traffic.  He will meet with the oil companies in the area to see if they are interested in contributing towards material for road improvements (salt spraying, etc.).  Commissioner Allen stated that by the time the County plow truck gets to the roads after a snowfall, there has been nonstop traffic during the night, making it hard to plow as the road is already a sheet of ice.

Larry Allen moved, Stephanie Kessler seconded, to adjourn into Executive Session regarding personnel.  Motion carried unanimously.  Commissioner Thompson joined the session via speaker phone.  Following the personnel issue, Executive Health Insurance Committee member Jim Massman joined the session regarding a health claim issue.  Larry Allen moved, Stephanie Kessler seconded, to return to Regular Session.  Motion carried unanimously.  Larry Allen moved, Stephanie Kessler seconded, to notify EBMS to pay a claim to the claimant, subject to any applicable deductible amount and other claim payment guidelines, regarding the claimant’s 2nd level appeal of denial.  Motion carried unanimously.

In other business, Jim Massman reviewed a Letter of Agreement with Employee Benefit Management Services for the term ending June 30, 2015 for run out services as a result of the County switching to BCBS effective July 1, 2014.  Travis Becker moved, Larry Allen seconded, to approve the Agreement.  Motion carried unanimously.

Commissioner Allen will meet with Ambulance Director Joe Zillmer regarding his request for funding for ambulance stretchers and different options (replacing vs. repair, etc.).

There being no further business, Travis Becker moved, Larry Allen seconded, to adjourn the meeting at 1:25 p.m. and reconvene for a Regular Meeting on November 25, 2014 at 9:00 a.m.   Motion carried unanimously.
