The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present:  Chairman Douglas L. Thompson, Vice-Chairman Keja Whiteman, Travis Becker and Stephanie Kessler.  Commissioner Larry Allen was absent for personal reasons.   County Clerk and Clerk of the Board Julie A. Freese was present for the meeting.

Travis Becker moved, Keja Whiteman seconded, to approve the Agenda as amended.  Motion carried unanimously.

Stephanie Kessler moved, Travis Becker seconded, to approve the Minutes of the Regular Meeting held on December 2, 2014.  Motion carried unanimously.

Keja Whiteman moved, Stephanie Kessler seconded, to approve the following Title 25 vouchers for payment:  Wyoming Behavioral Institute in the amount of $10,275.00; SageWest Health Care in the amount of $20,825.00; and Fremont Counseling Service in the amount of $140.00.  Motion carried unanimously.

The following items in the Signature File were reviewed:  1) Record of Proceedings; 2) letter to employee regarding concerns with biometric testing requirement; 3) thank you card to COBECON; 4) Agricultural Lease Agreement with Steve Husted for three year lease on Major property; 5) Abatement Summary cover sheet; and 6) thank you letters to three individuals not reapplying for terms on various County appointed boards.  Travis Becker moved Stephanie Kessler seconded, to approve a WYDOT Land Lease for Richardson Pit for Recreational, Historical and Cultural uses.  Motion carried unanimously.  Travis Becker moved, Stephanie Kessler seconded, to approve ten Summary Statements of Fair Market Value for either temporary or permanent easements required for the Mortimore Lane Reconstruction Project – Phase I.  Motion carried unanimously.

County Clerk Julie Freese will contact three Special Districts that have not filed their annual report with the Department of Audit.  If they remain non-compliant, State Statute requires the County Commissioners to place a public notice in a newspaper indicating the special district is in danger of being dissolved due to comply with the legal reporting requirements.  She will keep the Commission apprised of her progress.

A Local Government Liability Pool Notification of Pending Claim Settlement was reviewed.  An ambulance employee inadvertently hit claimant’s vehicle with a gurney, due to wind, causing damage to lens of tail light.  The settlement amount is $385.35.  Stephanie Kessler moved, Keja Whiteman seconded, to approve the Claim Settlement.  Motion carried unanimously.  The Board will send a letter to all County entities covered under LGLP to state a primary point of contact needs to be the Commissioners.

A letter from the County Treasurer’s Office was acknowledged stating that in accordance with Wyoming Statute 18-4-106 “the county treasurer shall…each year cancel all unpaid county warrants which have been issued for more than twelve (12) months.  The county treasurer shall certify to the board of county commissioners…the number and amount of each county warrant…The board of county commissioners…shall enter the list upon its journal and have the list published in the minutes of the regular…meeting.”  “Any person holding a cancelled county warrant…may present the warrant…to the board of county commissioners within five (5) years after the date of cancellation and they shall issue the holder of the warrant…a new warrant in the same amount…”  Stephanie Kessler moved, Travis Becker seconded, to certify that the following warrants, which were issued more than twelve (12) months ago, have not been paid, and are now cancelled.  Motion carried unanimously.

The Commissioners acknowledged a refund check from Sage West Health Care in the amount of $609.87 as a result of a refund for a Title 25 patient.

Commissioner Kessler was excused for personal reasons for a portion of the meeting.

Sheriff Hornecker Skip Hornecker was present for a monthly report.   November Detention average statistics indicate 170 total inmates, of which 151 are in house and one housed out of county.  This is compared to one year ago of 155 total inmates, 142 in house and five housed out of county.  As of the current date, 64 inmates (61 in house, 3 out of facility) of the total 177 inmates on the roster are sentenced.  There were 190 recorded intakes in November.  One hundred twenty six inmates in detention are pre-adjudicated.  There are still two open positions in Communications.  Director Freeman attended the Wyoming APCO/NENA conference in Casper and was subsequently elected to fill the First Vice President seat for the Wyoming Chapter, which is also Wyoming’s national representative for APCO International.  This past week, a Law Enforcement Training Consultant provided an audit of the Priority Dispatch Law Enforcement Protocol System and several suggestions are being placed into current procedures.  Detention has three open certified positions.  All Patrol/Enforcement positions are filled.

Sheriff Hornecker gave an animal at large report and stated two animals are housed at PAWS, based on the current contract.  The 2014 Law Enforcement Homeland Security grant award will purchase portable radios that will be field programmable.  The agreement is that must be made available to any incident within the state if needed, if they are not in use.  They are beginning their annual review of Policies and Procedures.  Departments are beginning annual reviews of perspective Standard Operating Plan manuals.  Sheriff Hornecker stated there have been no hunting infractions thus far and he briefly reviewed the federal policy of reporting (or lack thereof) on incidents occurring on the Wind River Indian Reservation.

Keja Whiteman moved, Travis Becker seconded, to adjourn into Executive Session regarding personnel.  Motion carried unanimously.  Travis Becker moved, Keja Whiteman seconded, to return to Regular Session.  Motion carried unanimously.  Keja Whiteman moved, Travis Becker seconded, to clarify the policy of June 10, 2014 that all employees starting after January 1, 2015, regardless of hours worked, will accrue benefits at the stated part-time amount, and all employees receiving additional time due to hours work within that time frame will be rectified.  Motion carried unanimously.

County Clerk Julie Freese and Financial Assistant Jim Anderson presented a preliminary budget hearing.  The adjustments will be advertised and the Public Hearing held the following week.

Commissioner Meeting Reports were given:

Commissioner Whiteman stated the recently formed Juvenile Justice Task Force has met several times with productive and well attended meetings.  She stated Fremont County needs to make sure the University is aware of our interest in filling the vacant Extension position with a Food and Safety Nutrition agent; however, stated the need is high for community development as well, and perhaps an additional position is warranted.

Chairman Thompson will attend the upcoming winter Wyoming County Commissioners Association meeting in Worland the end of the week and will relay Commissioner Whiteman’s comments to University of Wyoming Extension personnel who may be in attendance.

Commissioner Becker attended the Juvenile Justice Task Force meeting on Monday where they are looking at shortfalls within various agencies.  The Fremont County Planning Commission had several subdivisions come before them, one was pulled for the present time due to County Planner Baumann’s discovery of a pipeline on the property.

Fremont County EMS Director Joseph Zillmer and Supervisor Jess Miller were present to review the condition of six stretches that are in critical need of replacement.  He stated the stretchers utilized by EMS are an average of five to seven years old and have been repaired multiple times at great travel/repair expense, becoming a liability.  He presented information on stretchers he proposes to purchase from Stryker Corporation for approximately $49,500 and further provided no interest lease options for review.   He stated his request to purchase the stretches through the Capital Revolving Fund were denied and he has since submitted a federal grant via FEMA for a Assistance to Firefighters Grant that will allow equipment purchases not currently available to your agency and will also replace worn equipment.  If successful, the lease could be immediately paid off.  Zillmer stated current Federal recommendations for all ambulances to be retro-fitted with “crash proof” stabilization/mounting will require a complete transition into new hardware soon.  The Stretcher quote includes a three year free frame warranty and they will be capable of compatible upgrades when the new Federal standards are in place.  They will also provide a loaner stretcher if one needs sent in for replacement/repairs.  Zillmer further distributed a Fremont County Emergency Medical Services Update, as of December 8, 2014.  County Treasurer Scott Harnsberger was in the audience and requested time to meet with Mr. Zillmer to review the terms of the lease as he questioned free warranty and no interest lease options.  He further stated a financial analysis of the Department should be conducted prior to purchasing new equipment.  The Board asked Zillmer to provide additional information on lease options (price per month, total paid at end of lease and buyout options).   Zillmer has scheduled a meeting for December 17th with the acting CEO at Wind River Agency Alice Moore  regarding receivables.

Commissioner Kessler returned to the meeting at this time.

Lower Wind River Conservation District representatives Cathy Meyer, Gavin Woody, Terry Hayes and JW Hendry were present to review the District’s purpose and role in county conservation efforts.  The District is one of three in Fremont County and was formed in 1969 by State Statute that state the Districts are the local voice for natural resource uses.  They reviewed their Annual Report that outlines education provided, District operations, Land Use Planning, Rangeland Monitoring, Soil Conservation, and Water Quality and Quantity.  Land Use Planning projects include being a cooperating agency for the Bureau of Land Management Lander Resource Area Resource Management Plan, BLM development of two Environmental Impact Statements for Moneta Divide and the Beaver Creek Coal Bed Natural Gas Development Project, both potential expansions of oil and gas fields.  The District provided comments on the Shoshone National Forest Plan Revision and sponsored a Level I Study through the Wyoming Water Development Commission of the Badwater and Poison Creek Watersheds (Executive Summary presented for review).  As a result of the study, eight small water development projects were approved for funding, totaling $175,000 from the Wyoming Water Development Commission.  A Summary of Contributions to Resource Conservation was distributed for review, including federal, state, local and private funding sources.  The group thanked the Commissioners for their funding support; however, stated they did not feel they should be included with Social Services pool of money.  The shared their plans to place on the 2016 ballot a request for a District mill levy.  The Commissioners gave their thoughts on how to get information to citizens regarding the important efforts of the District. The agency is vital to the County for subdivision applications.  The District representatives stated they will continue to meet with legislators to voice their concerns as well and Deputy County Clerk Margy Irvine was present in the audience and volunteered to assist the group with looking at trends of past elections to see where they need to target their efforts.

County Treasurer Scott Harnsberger, County Clerk Julie Freese and Financial Assistant Jim Anderson were present to provide an update on the financial status of Capital projects, including roads, Fremont County Justice Center, Library and Museum projects.  Library Director Tracy Cook was present in the audience.  Harnsberger provided financial information on Road Construction Funds and Infrastructure Projects.  He stated the importance of breaking out engineering costs per project so there can be a better idea of design costs.  Tracy Cook presented a breakdown of revenue and costs for the Riverton Library Roof and Drainage Project, with the drainage project dependent on a Federal Mineral Royalty grant that will be confirmed mid January.  Anderson presented a list of all capital projects on the books and then a detailed report for the status of each project, including revenues and expenditures.  The Board thanked Jim for the helpful information and stated they would like to see quarterly reports on the status of each project.

Robert Baumann was present to interview for a vacancy on the Fremont County Predatory Animal Board.  Travis Becker moved, Stephanie Kessler seconded, to appoint Mr. Baumann to a three year term.  Motion carried unanimously.

Michael Gallagher interviewed for a vacancy on the Fremont County Fair Board.  One other applicant will be interviewed the following meeting after which time an appointment will be made.

Keja Whiteman moved, Travis Becker seconded, to adjourn into Executive Session regarding personnel. Motion carried unanimously.  Travis Becker moved, Stephanie Kessler seconded, to return to Regular Session.  Motion carried unanimously.

Vice-Chairman Whiteman was excused from the remainder of the meeting due to other obligations.

Executive Health Insurance Committee members Jim Massman, Margy Irvine and Kristi Green were present, along with Public Health Nursing Supervisor Julie Twist.  The Committee recently reviewed the Wellness Coordinator’s responsibilities and performance and discovered she has been averaging 32.6 hours per week for two recent pay periods.  The July 2014 change to increase wellness incentives substantially has increased the number of employees using the Wellness Coordinator’s assistance.  She has worked additional hours to meet the demands of the program and made herself available where employees work, as Fremont County covers a large geographic area.  They recommended the Board increase her scheduled hours from 26 hours per week to 32 hours per week with a commensurate pay increase, effective January 1, 2015.  Stephanie Kessler moved to increase the Wellness Coordinator’s hours from 26 to 32 hours per week, effective January 1, 2015.  Motion died for lack of a second. Chairman Thompson stated the request would be taken under advisement until the next meeting to give them time to review the budget impacts and final salary obligation for the increased hours.

The Executive Health Insurance Committee recommended the Board appoint Fremont County Library Bookkeeper Rebecca Thomas to their Committee as an off-line board representative.  Stephanie Kessler moved, Travis Becker seconded, to appoint Rebecca Thomas to the Committee.  Motion carried unanimously.

The Executive Health Insurance Committee representatives stated there has been a 2nd level appeal filed with EBMS from a physician.  Following review of the documentation, Stephanie Kessler moved, Travis Becker seconded, to accept the Health Insurance Committee’s recommendation to deny the claim.  Motion carried unanimously.

Margy Irvine distributed a spreadsheet indicating how many employees selected the Standard Plan (67.48%) and the High Deductible Plan (21.58%) and total waiving (10.94%).  She reviewed the efforts that were made to educate employees that a selection was necessary by December 5, 2014.  Twenty county employees failed to respond to elect their preferred deductible option and three other employees have picked the standard plan, but have failed to document that they have take the required biometrics.  Travis Becker moved, Stephanie Kessler seconded, to finalize a “Statement of Finding” for the file that the Fremont County Commission approved that these employees who failed to meet the deadline and/or requirements for the standard plan will be moved to the high deductible plan starting January 1, 2015.  Motion carried unanimously.

There being no further business, Travis Becker moved, Stephanie Kessler seconded, to adjourn the meeting at 3:40 p.m. and reconvene for a Regular Meeting on December 16, 2014 at 9:00 a.m.   Motion carried unanimously.
