The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present: Chairman Douglas L. Thompson, Vice-Chairman Keja Whiteman, Travis Becker, Stephanie Kessler and Larry Allen. County Clerk and Clerk of the Board Julie A. Freese was present for the meeting.
Travis Becker moved, Larry Allen seconded, to approve the Agenda. Motion carried unanimously.
Travis Becker moved, Larry Allen seconded, to approve the Minutes of the Regular Meeting held on September 16, 2014. Abstaining from the motion due to her absence at said meeting was Commissioner Kessler. Motion carried.
Larry Allen moved, Stephanie Kessler seconded, to accept the regular bills for payment, with the exception of a property tax payment to the Fremont County Treasurer, pending clarification on a one time LeClair Irrigation District $100 per land owner charge on the assessments. Motion carried unanimously. Later in the meeting Travis Becker moved, Larry Allen seconded, to pay the property tax assessment to the Fremont County Treasurer. Motion carried unanimously. Deputy County Attorney Darrough will write a letter to LeClair Irrigation District requesting a refund of $100, as the County was charged for two assessments.

Larry Allen moved, Stephanie Kessler seconded, to accept a voucher from Wyoming Behavioral Institute in the amount of $4,110 and from Fremont Counseling Center in the amounts of $3,080 and $3,500 for Title 25 patients. Motion carried unanimously.
The following items in the Signature File were addressed: 1) Abatement Summary cover sheets; and 2) Record of Proceedings. Stephanie Kessler moved, Larry Allen seconded, to approve an Administrative Services Agreement for Fremont County Government, Plan Sponsor & Administrator, and Blue Cross Blue Shield of Wyoming. Motion carried unanimously. Stephanie Kessler moved, Travis Becker seconded, to approve a letter Centers for Medicare & Medicaid Services exempting the Fremont County Employee Benefit Plan from the Mental Health Parity requirement as part of the HIPAA Exemption Election Document. Motion carried unanimously. Stephanie Kessler moved, Larry Allen seconded, to approve a License for New Construction of Utility Crossing or Encroachment from Qwest Corporation d/b/a CenturyLink for Mortimore Lane and from Rocky Mountain Power for Mortimore Lane. Motion carried unanimously. Stephanie Kessler moved, Larry Allen seconded, to approve the Medical Director Agreement between Fremont County Ambulance and David Scott Bender. Motion carried unanimously. Stephanie Kessler moved, Travis Becker seconded, to ratify a Service Line Agreement with Source Gas for the Fremont County Justice Center location. Motion carried unanimously. Stephanie Kessler moved, Travis Becker seconded, to approve an Agreement for Exchange between Fremont County Solid Waste Disposal District and Fremont County for the Shoshoni Transportation Shop. Motion carried unanimously. Stephanie Kessler moved, Travis Becker seconded, to approve a Shoshoni Transportation Department Shop Land Lease Agreement between Town of Shoshoni and Fremont County Government. Motion carried unanimously.
The Board acknowledged meeting information for the 2014 WCCA Winter Meeting to be held December 10-12, 2014 in Worland.
The Executive Health Insurance Committee received notice from Sheriff Hornecker that John Applegate has submitted his resignation from that Committee. Sheriff Hornecker subsequently recommended the appointment of another Sheriff’s Department employee, Eileen Davis, to the Committee. Stephanie Kessler moved, Travis Becker seconded, to appoint Eileen Davis to the Executive Health Insurance Committee. Motion carried unanimously.
Public Comment was held with Missy White providing an Airport Service Task Force update. They have met with both Cody and Jackson airport officials. She expressed appreciation to Representative Larsen and Senator Bebout for their help on the issue. Runway reconstruction will be taking place and a funding gap exists. Federal grants have been applied for and there may be funding through Wyoming Business Council to hire a grant writer. The goal of 10,000 enplanements has not been met, the number is 8,000. An exemption will be used next year during the reconstruction project. Commissioner Kessler, also on the Task Force, stated that jet service will be possible for the County next year following runway reconstruction.
Travis Becker moved, Stephanie Kessler seconded, to adjourn into Executive Session with Transportation Superintendent Dave Pendleton and Riverton Crew Chief Billy Meeks, regarding personnel. Motion carried unanimously. Travis Becker moved, Larry Allen seconded, to return to Regular Session. Motion carried unanimously.
Transportation Superintendent Dave Pendleton stated there will be a Lander Truck Driver vacancy in Lander, effective November 1st. He requested approval to hire an applicant that was recently interviewed for another vacancy. Travis Becker moved, Stephanie Kessler seconded, to authorize offering the position to the recently interviewed applicant for the vacant Lander Truck Driver position. Motion carried unanimously.
A Petition for Assumption of Maintenance of Beebe Road was reviewed by Dave Pendleton. The Fremont County Solid Waste Disposal District stated this Road is currently maintained by the District. An Agreement for Exchange of the Shoshoni Transportation Department Shop to Fremont County was approved with the agreement the County would resurface Beebe Road. No mention was made in the Agreement for maintenance following the resurfacing project. Chairman Thompson asked for a motion to assume maintenance of Beebe Road. No motion was forthcoming and the District will be informed their Petition for Maintenance was not approved.
Dave Pendleton updated the Board on recent developments on the Lower North Fork Reconstruction of the 20 mph curve. Due to the recent rainstorms and irrigation water, the ground was saturated. Numerous photos were distributed for the Board’s information. Trihydro Engineers Jeff Young and Sam Hartpence were present surrounding discussion that additional work was necessary in preparation of putting down the asphalt pavement. Pendleton reviewed the work that has been done as a result, putting in geo fabric, rock, sub-base and base materials and subsequently stated a Change Order would be coming from Alexander Excavation in the amount of $32,000. A preliminary budget hearing would be presented later in the day for the increase to the 1% project. Pendleton stated the work has been completed and was necessary for providing solid road bed, safety issues, as well as the importance of not putting the project further behind schedule as we are quickly moving towards winter. County Clerk Julie Freese raised the issue that the Commissioner liaison had not been contacted prior to Pendleton’s approval of the emergency work and that checks and balances have been put in place which she did feel were followed. Deputy County Attorney Darrough suggested wording in future contracts to ensure proper individuals are apprised prior to change orders involving monetary increases to projects.
A Public Hearing was held at 10:15 a.m., as advertised, regarding an Application for Transfer of Ownership of the Atlantic City Mercantile from Real West Enterprises, Inc. to Atlantic City Mercantile, Inc. Applicant Ron Abernathy was present and Chairman Thompson asked for a report from the Sheriff’s Department regarding any calls they had received involving the establishment. A verbal answer was several calls of fighting amongst customers as well as with the other liquor establishment in the area. Nobody was present in the audience, either for or against, the transfer. Travis Becker moved, Larry Allen seconded, to approve the Transfer of Ownership to Atlantic City Mercantile, Inc. d/b/a Atlantic City Mercantile. Motion carried unanimously.
Building Maintenance Supervisor J.R. Oakley was joined with Vehicle Maintenance Supervisor Glen Steers regarding Oakley’s earlier request for an additional vehicle for his fleet for the Detention Custodian. Present in the audience was County Treasurer Scott Harnsberger. Steers stated there is a vehicle that has been taken out of service from the Sheriff’s Department that would be sufficient for the needs of the Building Maintenance Department, with a blue book price between $4,500 and $8,000, and he felt $6,000 was a fair price for the unit. It was determined the amount would not qualify for funding through the Capital Revolving Fund (minimum amount of $10,000) and the Board asked Oakley if he could fund $4,500 from his Department for the unit. That amount would then be placed in the Capital Revolving Fund, where the original vehicle purchase was made. Keja Whiteman moved, Larry Allen seconded, to transfer the vehicle to the Building Maintenance Department at a cost of $4,500 to be paid back to the Capital Revolving Fund from said Department. Commissioner Becker voted to amend the motion to set the cost at $6,000. Motion died for lack of a second. Voting on the original motion was held with Commissioners Becker and Kessler voting no. Motion carried.
Information Systems Support Supervisor Joni Miller introduced newly hired Information Systems Assistant Greg Tromburg to the Board.
County Planner Steve Baumann presented a proposed re-plat of Phister Subdivision, a five lot simple subdivision. The original subdivision was two lots and the re-plat increases the size of Lot 1 and divides Lot 2 into four new lots. The location is within the one mile buffer of the City of Riverton and has received their approval, along with unanimous approval from the Fremont County Planning Commission. Travis Becker moved, Larry Allen seconded, to approve the re-plat of Phister Subdivision. Motion carried unanimously.
Steve Baumann had been selected by the Board to be one of three viewers in the Alteration of Mortimore Lane. Baumann informed the Board that one of the three viewers has medical problems and is not able to complete his duties as Appraiser. The Board asked Baumann to return later in the day in order to give the Board time to find a replacement Appraiser. Larry Allen moved, Stephanie Kessler seconded, to approve an Order Appointing Replacement Appraiser and Extending Deadline for Appraiser’s Report in the Matter of the Alteration of Mortimore Lane (Docket No. 2014-07). Motion carried unanimously. Said date for filing of the Appraisers Report was extended to October 15th and the new Appraiser is Andy Frey.
David Lee, Field Engineer with Manufacturing-Works, updated the Board on the company he represents that fully assesses operations of manufacturers and technology companies and delivers solutions in the most cost effective manner. Partnerships with the Wyoming Business Council and University of Wyoming are in place.
Fremont County Emergency Medical Services Director Joe Zillmer was joined by Division Supervisor Todd Smith and Mobile Integrated Healthcare Clinical Supervisor Jess Miller to review a Sustainability Analysis Report compiled by Zillmer. Approximately 20 people were present in the audience (a complete list is on file in the Commissioners Office). Zillmer opened his discussion by asking the Board to make the determination of whether EMS is a vital service in Fremont County, as much as Fire, Sheriff, etc. They are looking at funding sources to maintain the level of services in Fremont County and are applying for two grants, with several others in the development phase. The Wyoming EMS Sustainability/Evaluation Grant will be submitted next week. The grant only provides outside evaluation of current systems and management, which will be helpful, but will not provide financial assistance in offsetting operational expense. The second grant is a Federal MIH Grant, a three year funding request, allocating $200,000 per year for three years, and would be utilized to offset personnel cost, capital equipment purchases and increase health care access in Fremont County. Topics were then reviewed in the Sustainability Analysis Report in detail as follows: 1) Morbidity & Mortality rates; 2) Account Receivable and Funding Projections; 3) Operational Analysis; 4) Clinical Sophistication; 5) Capital Equipment Evaluation; 6) Mobile Integrated Health (MIH) Project; 7) Budget Projections Fiscal Year 2015-2016; and 7) Questions and Public Comments. Zillmer stated that to maintain the current staffing levels, FCEMS will require a minimum of an additional $1.6 – $2.3 million dollars to operate with reasonable response times. There are currently four 24-hour staffed ambulances, seven days a week. This is a reduction of five from the previous five years, amounting to a reduction of 5,284 unit hours from previous years. Accounts receivables can never be expected to contribute more than 40-48% of operational costs. FCEMS budget for FY 2014-2015 totaled $3,463,032 and the budget shortfall was met with almost $1,000,000 from the “reserve fund”. The anticipated budget for FY 2015-2016 is approximately $4,300,000. Fremont County EMS responds to 6,000 requests for service per year, being the third busiest system in Wyoming, only trailing behind Cheyenne and Casper. Several people in the audience spoke in support of EMS sustainability, including Brad McKee (Wyoming Life Flight); Allison Sage, Penny Robertson and Shawn McRae. Daniel Myers, Dubois Clinic Manager, stated the Mobile Integrated Healthcare program in Dubois, staffed by Jess Miller, was launched with the Dubois Medical Clinic being the pilot program. MIH is a proven approach to the healthcare delivery system, is a patient centered, mobile resources in the out-of-hospital environment to care for patients enrolled in the program through referrals from physicians. Zillmer stated he has formed the EMS Sustainability Task Force, who will have their first meeting October 21st. Health Care Survey results were also distributed, taken from randomly calling citizens of the County, on a variety of subjects related to EMS.
A preliminary budget hearing was held. Present were County Julie Freese and Financial Assistant Jim Anderson. Anderson stated the hearing would consist of the upcoming Change Order for the Lower North Fork 20 MPH Curve project for $32,000. Anderson stated he would recommend a transfer of $30,000 as there was adequate funding already in the project to cover the remaining $2,000. The budget transfer information will be advertised and the public hearing date set for the following meeting.
Fremont County Library Director Tracy Cook and Bookkeeper Rebecca Thomas were present for an update. Cook reviewed the work done on the Outpost Libraries, which enable improved library services around the County (Crowheart, Hudson, Fort Washakie, Jeffrey City, Shoshoni), as part of the draft Library Strategic Plan. New computers and equipment have been installed at all Outpost areas, with the exception of Fort Washakie, who utilizes the school system. The Library Board pays for internet service for those areas that do not get internet elsewhere (school, town, etc.). Hudson and Shoshoni will be joining the State system.
Tracy Cook stated they are requesting approval to move money from Lander Library personnel funds, equivalent to the wages used for the vacant Library Page position from Salaries (Part-Time) to Salaries, (Substitutes). The budget impact will be zero. Substitutes possess the necessary skills to work the circulation desk, answer reference questions and fill in for absent staff. The Page position, vacated earlier, was responsible for mailing and shelving and these duties have been picked up by current staff already. The Board consensus was approval of the change from Salaries (Part-Time) to Salaries (Substitutes).
In a final item, Tracy Cook asked for approval for the Library to hire Dubbe Moulder Architects and Trihydro for the design work for the roof and drainage project at the Riverton Library, estimated to cost $114,600. Both these firms were involved in the feasibility study and have been recommended by the Library Board. Cook stated there is grant money available from Countywide Consensus Block Grants ($563,000) and the Federal Mineral Royalty Grant will be decided on January 15th. Cook was asked to work with the County Clerk and Treasurer to set up a formal budget for the project. It was determined that a bid date of late January/early February would be beneficial to get ahead of the construction bid season.
County Clerk Julie Freese reviewed a Rocky Mountain Power Community Performance Plan document. The Board requested she be the contact person on their behalf.
Dave Pendleton returned to report on a meeting he and Commissioner Thompson attended with Cameco representatives in Casper last week to discuss the Dry Creek Road pending Memorandum of Understanding. Issues have been resolved with the MOU. In additional discussion, a geotech report was completed by the AML for the road route which determined that nine inches of gravel is needed. Preliminary cost estimates indicate the road project budget will be short $500,000 and additional funding would be needed to begin the project. The Commission agreed they would not provide any monetary contribution to the project as the County will maintain the road, if and when it is completed, through the regular maintenance schedule.
Crews are widening East Fork Road and will haul gravel to it next spring. Applied mag chloride to Union Pass Road following the recent moisture in the area. Continuing planning on the railroad crossing at Lysite. Will meet with Federal Highway Administration officials next week in Dubois regarding the Wiggins Fork Bridge and Horse Creek Road projects. Working on right-of-way for the Diversion Dam bridge project. Specifications have been completed and the project has been put out to bid. A separate schedule will be needed for any additional work on needed patching on the road.
County Planner Steve Baumann returned to the meeting to review three updated Job Descriptions for staff (GIS Technician, Secretary and Small Wastewater Specialist). In other business, he stated part of the Rural Addressing rules state that a road with more than three addresses must have a road name. The costs associated with sign and installation is the responsibility of the landowners. Many older subdivisions have road name signs that are faded and unreadable, which were put in by the subdivider. He recommended putting together a news release to encourage proper and legible road signage for health and safety reason. The Board asked him to draft something to present to the GIS Committee for review prior to placing in the newspapers.
Vice-Chairman Whiteman stated Job Descriptions have been updated on all Department Heads and she recommended evaluations be the next step in the process. She will work on a sample evaluation that can be customized for each individual Department Head. The proposed process will be discussed at the upcoming Elected Officials/Department Heads meeting next week. Following the Commissioners evaluation of all Department Heads, it will then be the recommendation to have the Department Heads conduct evaluations on all their employees.

Commissioner Whiteman attended portions of the recent WACO meeting in Lander. Attended the work session with Elected Officials the previous week and one day of the Enhancing Tribal and State Collaborations to Build Sustainable Public Safety Partnerships meeting. Several issues for the Policy Committee were discussed (Military Leave, Break in Service and part-time employees in relation to the new definition of vacation time).
Commissioner Kessler stated the Museum Director and Board are doing a great job and she will forward copies of their newly revised Handbook and Collections Management Policy.
Commissioner Becker also attended the work session with Elected Officials the previous week. He had a concern expressed to him regarding a bid announcement for the cooling system at the Courthouse and Detention Center.
Commissioner Becker was absent from the remainder of the meeting in order to attend a GIS meeting.
Commissioner Thompson attended a Lander Resource Management Plan meeting, Resource Advisory Council meeting and most of the WACO meetings. Traveled to Montana to attend a Western Interstate Region Board of Director’s meeting.
There being no further business, Larry Allen moved, Stephanie Kessler seconded, to adjourn the meeting at 3:450 p.m. and reconvene for a Regular Meeting on October 14, 2014 at 9:00 a.m. Motion carried unanimously.
