The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present: Chairman Douglas L. Thompson, Vice-Chairman Keja Whiteman, Travis Becker and Larry Allen. Commissioner Kessler was absent for personal reasons. County Clerk and Clerk of the Board Julie A. Freese was present for the meeting.

Larry Allen moved, Travis Becker seconded, to approve the Agenda, as amended. Motion carried unanimously.

Travis Becker moved, Keja Whiteman seconded, to approve the Minutes of the Special Meeting held July 7, 2014 for the FY 2014-15 budget hearing and the Regular Meeting of July 8, 2014. Chairman Thompson abstained from voting on the July 7th minutes due to his absence at said meeting. Motion carried.

Larry Allen moved, Keja Whiteman seconded, to accept the regular bills for payment, pending appropriate documentation on a travel voucher. Commissioner Becker abstained from voting on The Print Shop voucher. Motion carried.

Keja Whiteman moved, Travis Becker seconded, to accept a voucher from BCBS for health insurance claims through July 21, 2014 in the amount of $63,807.90. Motion carried unanimously.

Keja Whiteman moved, Larry Allen seconded, to accept vouchers from Fremont Counseling for $2,400 and $3,120 and SageWest Health Care for $23,800 and $11,900 for Title 25 Patients. Motion carried unanimously.

The following items in the Signature File were reviewed: 1) Public Notice regarding adoption of Resolution No. 2014-19 “Fremont County Enhanced 911 Emergency Telephone System and Imposition of a 911 Emergency Telephone Service User Tax”; 2) letter to BIA regarding an application for the acquisition of land by the United States to be held in trust for the use and benefit of Audrey Ward; 3) Adjustment to Assessment Summary; and 4) Record of Proceedings. Keja Whiteman moved, Larry Allen seconded, to approve a Contract between State of Wyoming, Department of Family Services and Fremont County Board of Commissioners to fund services for the Community Justice Services Board. Motion carried unanimously. Travis Becker moved, Larry Allen seconded, to ratify a Volunteers of America Northern Rockies 2012 OJJDP Non-Participating State Grant Application. Motion carried unanimously. Travis Becker moved, Larry Allen seconded, to ratify a Catering Permit submitted by Rowena Bland d/b/a LaPeyre Ent., Inc. for the Wrangler Classic on July 18-20, 2014 at the Jim Moss Arena located on Eight Mile Road. Motion carried unanimously. Travis Becker moved, Larry Allen seconded, to approve an application for funding under the Governor’s Federal Natural Resource Policy Account to cost-share a feasibility study with the U.S. Army Corps of Engineers in order to determine whether any cost-effective solutions exist for the Lander flooding problem. Motion carried unanimously. Travis Becker, moved, Larry Allen seconded, to approve a Memorandum of Understanding between the Department of Revenue and Fremont County, setting forth responsibilities concerning administration of the Computer Assisted Mass Appraisal System. Motion carried unanimously. Travis Becker moved, Larry Allen seconded, to approve Resolution 2014-21 “Appropriation Resolution” adopting the FY 2014-15 budget. (A complete document is available in the Commissioners Office). Travis Becker moved, Larry Allen seconded, to approve an amended Salary Contribution Agreement with the University of Wyoming and Fremont County for an additional Extension professional. Travis Becker moved, Larry Allen seconded, to approve an Amendment of Dispatch Agreement between the City of Lander and Fremont County. Motion carried unanimously.

The following items in the Priority Mail were reviewed: 1) Request from Fremont County Fair for judges for the “Best Baked Beans in Fremont County” contest on August 2nd. Commissioners Allen and Whiteman plan on attending. 2) A recommendation from Building Maintenance Supervisor J.R. Oakley was reviewed relating to the demolition of the old farmhouse on the Majors property. Oakley was present for the discussion and stated it would be feasible to perform the work while Dave’s Asphalt equipment is onsite. The estimated cost would be $8,375 for the demolition and dump fee. The Board stated there may be certain items that could be donated to Habitat for Humanity (doors, etc.). Travis Becker moved, Larry Allen seconded, to approve Dave’s Asphalt providing the demolition of the farmhouse, with funding through the Commissioners contractual line item. Voting against the motion: Keja Whiteman. Motion carried. Oakley stated his department would absorb other related costs (electrical, etc.). Chairman Thompson will meet with the Solid Waste Disposal District Director regarding any possible fee waivers associated with the demolition project. 3) Commissioner Whiteman will complete a survey to provide feedback for the annual performance review done for the County Nurse Manager. 4) The Board acknowledged the outstanding efforts of Fremont County EMS who received a Grade A from the Wyoming Department of Health during a recent site inspection. 5) A Department of Workforce Services seminar “Wyoming Preference Act of 1971” was reviewed and Deputy County Attorney Jodi Darrough stated she planned to attend which will provide information regarding Wyoming Statutes and individual contractor responsibilities for employing Wyoming residents after contracts with Wyoming governmental entities have been awarded. 6) The Certificate of Assessment Roll for the Year 2014 for LeClair Irrigation District and Riverton Valley Irrigation Districts were acknowledged.

The Public Comment period was held:

Mortimore Lane resident Pam Barten presented a letter addressed to DOWL HKM, World Wide Consulting Group and Fremont County Commissioners expressing frustration and concern about differing and changing responses they get when discussing the number of trees that will be cut down on their property as well as not receiving correspondence in writing as requested throughout the planning process. She further displayed photos of the trees in question for the Board’s information.

Transportation Superintendent Dave Pendleton presented a Construction Contract for Alexander Excavation, Inc. for the North 2nd Street Realignment project. Said bid had been let earlier and he stated the contractor has 45 days to complete the project, which will begin the first week of August. If weather related issues make chip sealing impossible by September 1st, it will be postponed until after June 1, 2015.

Dave Pendleton presented Change Order No. 1 from HK Contractors, Inc. for the Eight Mile Road Asphalt Overlay, Phase II project. The Change Order consists of a $5,000 deduct for mailbox replacement purchases. As the owner will supply the replacement mailboxes, this cost is not necessary. Travis Becker moved, Larry Allen seconded, to approve the Change Order as presented. Motion carried unanimously.

The Board was updated on several speed studies being conducted by Dave Pendleton. A gentleman on Elkhorn Drive had called earlier and requested speed limit signs on that road and Pendleton will provide him an update on the priority of the studies taking place in the County.

Dave Pendleton stated they are researching gravel pit sources in the County. Presently stockpiled materials are only enough for approximately 21 miles of the total 750 miles of County roads. He stated the importance of locating sources at strategic areas of the County and he is working with the municipalities and WYDOT on possible sources. The Board asked him to put together a plan of where the sources are needed and status of each. He stated political signs placed in the County right-of-way will be removed and taken to the respective County shops. The Dry Twin Creek Bridge has been replaced with two culverts. This option is not available for the Twin Creek Bridge, as it has a large drainage area and would require a bridge or multiple concrete box culverts at great expense. The Road will be re-aligned to a new location that does not require a large drainage structure and the old portion of road reclaimed and the bridge removed.

DOWL HKM Engineer Diane Oress joined Dave Pendleton to discuss the Mortimore Lane Reconstruction – Phase I project. She presented a map of the area for the Board’s information and read a letter in response to Steve and Pamela Barten’s letter that was discussed earlier in the meeting by Mrs. Barten. Oress’ letter stated that it is likely the trees along their driveway can be protected during construction; however, they are waiting on the value of the trees should one or more be harmed during construction. There will be an understanding and means to compensate the property owner for the loss of trees, if that should occur. Transportation Superintendent Dave Pendleton was requested to be at all future meetings with landowners if possible. Mortimore Lane resident Carol Sanders was present and stated her belief that Mortimore Lane should be completed the entire length, not just the portion from Sinks Canyon Road to the bridge. The Commissioners explained why the project is not for the entire road length at this time. Deputy County Attorney Jodi Darrough reviewed several options available for the necessary reconstruction for the Phase I project that included formal condemnation proceedings or alteration of county highways. She recommended the Alteration procedure which will require a Resolution and setting of a date for objections and claims for damages of August 25, 2014. Travis Becker moved, Keja Whiteman seconded, to approve Resolution 2014-20 “Alteration of Mortimore Lane”. Motion carried unanimously. (A complete copy is on file in the Commissioners Office). Notice will be sent to the affected landowners along with statutory advertising of three consecutive weeks in the newspapers.

County Clerk Julie Freese presented Financial Assistant Mike Stalder with a retirement plaque for 30 years of service. Stalder’s last day is July 31st. Numerous co-workers were present in the audience. Both Freese and the Commissioners expressed appreciation for Mike’s work for the County and wished him the best in his retirement.

Fremont County Firewise Coordinator Ron Wempen provided an update on the Firewise Program. Discussion topics were: Title III Program, other current landowner projects, Homestead Park Community Assistance Grant, Popo Agie Estates project, Porcupine Road Project (Fuel Treatment Access), South Pass Aspen Project and Mountain Pine Beetle information.

Financial Assistant Mike Stalder and Jim Anderson reviewed a summary of bids for color copiers (two for the County Attorney’s Offices in Lander and Riverton and one for the Elections Office), all approved for funding through the FY 14-15 Capital Revolving Fund requests. Stalder recommended the bids submitted by the Office Shop be accepted for $21,000 for the two copiers for the County Attorney’s Office and one for the Election Department for $12,100, not counting total trade in value of $9,000. Travis Becker moved, Keja Whiteman seconded, to accept the bids from the Office Shop. Motion carried unanimously.

The FY 2014-15 Capital Revolving Request List was reviewed and several projects were added later after the original authorization. Keja Whiteman moved, Travis Becker seconded, to authorize $16,500 for the UPS replacement for the Information Systems Support department. Motion carried unanimously. ISS Supervisor Joni Miller had submitted the required Equipment and Procurement Form for the project purchases which were approved by the Board. In a related issue, Commissioner Whiteman stated the Fremont County Fair & Rodeo had several projects that were moved from their budgets to the Capital Revolving Fund, and required authorization. Keja Whiteman moved, Larry Allen seconded, to authorize $88,000 for fencing and $31,000 for the Sunset Arena Improvements. Motion carried unanimously.

Fremont County Weed & Pest Supervisor Aaron Foster and Board Chairman Sollie Cadman reviewed the Final Budget for the District.

Keja Whiteman moved, Larry Allen seconded, to adjourn into Executive Session with former Museum Board member Tom Duncan for an Exit Interview. Motion carried unanimously. Travis Becker moved, Larry Allen seconded, to return to Regular Session. Motion carried unanimously.

Chairman Thompson recessed the Board of Fremont County Commissioners and convened as the Fremont County Board of Equalization. Four Dismissal Orders were presented, as the Protestants had requested their protests be withdrawn: Halmay Holdings, Inc. (Docket No. 2014-06); Paul C. Travis Becker moved, Keja Whiteman seconded, to sign the four Dismissal Orders. Motion carried unanimously.

Terrance R. Martin was introduced as the Hearing Examiner for the tax protest hearing of Jerry and Carol Whitehurst (Docket No. 2014-04). Present was Taxpayer Carol Whitehurst and present for the Assessor was Tara Berg, Deputy Angela Wilson and Deputy County Attorney Jodi Darrough. Following the hearing, Chairman Thompson adjourned the Fremont County Board of Equalization and reconvened as the Board of Fremont County Commissioners.

Fremont County Library Bookkeeper Rebecca Thomas and Technology Manager Jenny Wills presented quotes for new technology hardware and software that was approved for funding in the amount of $57,200 through the Capital Revolving Fund. Upgrades are needed in order to improve newer technology to customers and will be a benefit by having fewer computers with downtime and replacing the server will help the system provide reliable service. Travis Becker moved, Larry Allen seconded, to approve the recommended purchases from Dell Direct, Pine Cove Consulting and Microsoft to total $47,533.31. Motion carried unanimously.

Planning Director Steve Baumann informed the Board he will require additional software to adequately work with the Assessor’s Office to insure rural addressing is being compiled correctly, formatted and applied to allow integration with the 911 system. Assessor Tara Berg and GIS Mapper Chip Williams were present for the discussion and Williams stated there is an extra license available for the ARCGIS program for Baumann’s computer. There will be an additional $400/year maintenance fee for the program which will be absorbed into the Planner’s budget. In other business, Baumann informed the Board that the Secretary has resigned her position, effective July 24th. That position has previously been performing the task of Secretary in addition to addresser, following the resignation of the GIS Technician last year in which the position was not refilled. He stated the time is opportune to take the Department into a whole new direction concerning GIS implementation to insure they move forward with addressing and permitting to enhance both their department and the Assessor’s Department. He proposed hiring a Secretary and adding the GIS Technician position back in, requiring an additional amount for this position. He stated his belief the additional position is a sound investment in the future of the Department, a backup plan for any changes in the Assessor’s Department and a step forward in a fuller implementation of GIS throughout Fremont County Government. Travis Becker moved, Larry Allen seconded, to approve rehiring for the Secretary position as well as for a new position for a GIS Technician. Voting against the motion: Keja Whiteman. Motion carried. Baumann will keep the Board updated on the successful candidates for each position and related salary requirements. Commissioner Whiteman volunteered to work with Baumann on adequate job descriptions for both positions. Baumann was also asked to provide an update to the Board in six months regarding the additional position responsibilities and progress related activities.

Interviews were held with Nancy Wright for a three year term on the Fremont County Library Board and Robert Scheidemantel for a one year vacancy on the Fremont County Recreation Commission (Riverton Area). One other interview for this position had been held earlier in the month as well. Later in the meeting, Travis Becker moved, Keja Whiteman seconded, to appoint Nancy Wright to the Fremont County Library Board and Robert Scheidemantel to the Fremont County Recreation Commission. Motion carried unanimously.

Travis Becker moved, Keja Whiteman seconded, to adjourn into Executive Session with Fremont County Emergency Services Director Joseph Zillmer and Division Supervisor Todd Smith regarding personnel. Motion carried unanimously. Deputy County Attorney Jodi Darrough was present. Travis Becker moved, Larry Allen seconded, to return to Regular Session. Motion carried unanimously.

Chairman Doug Thompson recessed the Board of Fremont County Commissioners and reconvened as the Fremont County Board of Equalization. Hearing Examiner Terry Martin was present for the deliberation of the Board regarding the tax protest hearing held earlier. Travis Becker moved, Larry Allen seconded, to concur with the County Assessor’s value of the subject property with the exception of determining the exact acreage of land under water. Voting against the motion: Keja Whiteman. Motion carried. Commissioner Thompson adjourned the Fremont County Board of Equalization and reconvened as the Board of Fremont County Commissioners.

County Clerk Julie Freese reviewed some concerns she had received regarding the Emergency Event Response Procedure adopted earlier in the year, as related to employees leaving their regular duties to respond to an emergency agency (volunteer fire fighter, search and rescue, etc.). She suggested an amendment as follows: “County employees may be allowed to serve as an unpaid volunteer for any emergency agency without using their vacation time as long as their supervisor approves their absence from their county job. Maximum time off in this capacity shall be no more than eight (8) hours per incident. Time requested off beyond eight (8) hours shall be taken as vacation time off or time off without pay.” This amendment will be sent to Elected Officials and Department Heads to share with their employees prior to final adoption on August 12th.

County Clerk Julie Freese reviewed W.S. § 18-3-515 – Preparation and publication of annual statements which reads “Each board of county commissioner at their regular July meeting shall request a statement of the receipts and expenditures of the county during the preceding twelve (12) months setting for the source and amount of all receipts and the purpose and amount of all expenditures to be prepared upon reconciliation of all accounts by the county treasurer and county clerk, not later than September 30. The statement shall e signed by the chairman and clerk of the board and shall be published at least two (2) times in a newspaper of general circulation in the county…” Travis Becker moved, Larry Allen seconded, to request said abstract from the County Clerk. Motion carried unanimously.

In other business, Julie Freese reviewed other advertising changes that took effect in July. Every month for the next two years, the county clerks must publish notice regarding information availability that is posted on the website. She stated a special meeting will be set for the Mill Levy setting on August 4, 2014 at 9:00 a.m. She further updated the Board on tribal court orders as these are considered foreign judgments. As a result, the Tribe’s are shutting off reciprocal processes and Sheriff Hornecker will be working with the judicial system to see what can be done to resolve the issue of tribal court orders.

Commissioner Becker updated the Board on the Fremont County Justice Center construction project. He stated Amendment No. 1 to the Inberg-Miller Engineers Service Agreement will be necessary for them to perform a field survey and prepare a one-lot subdivision plat according to the City of Riverton Subdivision Regulations. This will consist of a 25-foot extension of Lots 3 and 4 in a westerly direction, which will provide additional space surrounding a power box. The Board agreed to moving the lot lines permanently.

Executive Health Committee member Margy Irvine and Deputy County Attorney Jodi Darrough reviewed a health insurance claim that has been appealed where the County is the secondary insurance provider. The first company did not process the claim in a timely manner and caused the secondary insurance carrier (County) to deny the claim. Keja Whiteman moved, Larry Allen seconded, to waive the 365 day rule in this instance and have the County insurance process the claim. Motion carried unanimously.

Commissioner Whiteman had the opportunity to participate in a plane ride over the Dunois Valley and reported on the devastating effects of beetle kill in the area.

There being no further business, Travis Becker moved, Larry Allen seconded, to adjourn the meeting at 4:50 p.m. and reconvene for a Special meeting on August 4, 2014 at 9:00 a.m. Motion carried unanimously.
