The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present: Chairman Douglas L. Thompson, Vice-Chairman Keja Whiteman, Stephanie Kessler and Larry Allen. Commissioner Becker was absent for personal reasons. County Clerk and Clerk of the Board Julie A. Freese was present for the meeting.

Larry Allen moved, Stephanie Kessler seconded, to approve the Agenda, as amended. Motion carried unanimously.

Larry Allen moved, Keja Whiteman seconded, to approve the Minutes of the Regular Meeting of July 22, 2014. Commissioner Kessler abstained due to her absence at said meeting. Motion carried.

Larry Allen moved, Stephanie Kessler seconded, to accept the regular bills for payment. Motion carried unanimously. County Clerk Julie Freese stated the County Attorney’s Office is researching the appropriate process to change a contractual agreement with LM Olson to hold retainage for the Fremont County Justice Center construction project with the Fremont County Treasurer instead of a Rawlins banking institution.

Larry Allen moved, Keja Whiteman seconded, to accept a voucher from BCBS for health insurance claims through August 4, 2014 in the amount of $37,904.67. Motion carried unanimously.

The following items in the Signature File were reviewed: 1) Certificate of Achievement for Fremont County EMS upon their Wyoming Department of Health Grade A Report Card; and 2) Record of Proceedings. Keja Whiteman moved, Larry Allen seconded, to approve an application for a 24-Hour Malt Beverage Permit from Paulette Moss for a Wrangler Team Roping event at the Jim Moss Arena on August 16 & 17, 2014. Motion carried unanimously. Keja Whiteman moved, Larry Allen seconded, to approve an Office of Homeland Security Grant Award Agreement in the amount of $30,000 for the FY 2014 Emergency Management Performance Grant. Motion carried unanimously. Keja Whiteman moved, Larry Allen seconded, to approve Fremont County Bank of the West Credit Card Application forms for Melinda Cox, Steve Baumann and Jesse Miller, all with a limit of $1,500. Motion carried unanimously. Keja Whiteman moved, Larry Allen seconded, to approve Amendment No. 1 to the Inberg-Miller Engineers Service Agreement for additional surveying to prepare a one-lot subdivision plat and a 25-foot extension of Lots 3 and 4 in a westerly direction. Voting against the motion: Keja Whiteman. Motion carried. The following Application/Permits to Construct Access Driveway from Sylvia Crouter for Wagon Box Lane and Will Rigsby for Horse Creek Road were reviewed, along with License for New Construction of Utility Crossing or Encroachments from Rich Pingetzer for Bass Lake Road, PacifiCorp for Baldwin Creek Road and Bradley Iiams for Iiams Road were also reviewed. Keja Whiteman moved, Larry Allen seconded, to approve all the applications as presented. Motion carried unanimously.

Chairman Thompson recessed the Board of Fremont County Commissioners and convened as the Fremont County Board of Equalization. Keja Whiteman moved, Larry Allen seconded, to approve the Decision of the Fremont County Board of Equalization in the protest of Jerry & Carol Whitehurst (Docket No. 2014-04). Commissioner Kessler abstained from voting on the motion due to her absence at the hearing on July 22nd. Motion carried. Chairman Thompson adjourned the Fremont County Board of Equalization and convened the meeting of the Board of Fremont County Commissioners.

The following items in the Priority Mail were reviewed: 1) reply letter from the Office of the Governor regarding the Emergency Medical Services Sustainability Trust. Emergency rules have been promulgated and Commissioner Kessler will assist Fremont County EMS with the application process. Suggested changes from the Commissioners were deemed substantive rule changes and would require repeating the full promulgation process, and 3) suggested wording regarding reimbursement for travel expenses subject to federal per diem rates was discussed. The Board suggested adding a reminder of the federal per diem rates on the current travel vouchers, as well as a link for a website with these rates; 4) the Board acknowledged receipt of the Mountain View Acres Subdivision Improvement District Assessment Rolls; 5) Fremont County FSA Office Summary Acreage History Report for Major property (to be forwarded to Assessor’s Office); and 6) E-mail message from Building Maintenance Supervisor J.R. Oakley updating the Board on the trenches at Fremont County Justice Center construction site was reviewed regarding the need to use a “mud mat” to fill some of the trenches to provide a solid base to place the structure for the required compaction. Keja Whiteman moved, Larry Allen seconded, to approve the Mud Mats as required for the construction process. Motion carried unanimously. The applicable change order will be forthcoming for the anticipated additional cost of $8,500.

Transportation Superintendent Dave Pendleton presented a Notice to Proceed to HK Contractors, Inc. for the Eight Mile Road Asphalt Overlay – Phase II project for signatures. A Contract with S & L Industrial for the County-Wide Sign Replacement Project 2014 was presented for signature as well. Pendleton presented two Agreements with Federal Highway Administration, Federal Lands Highway, in which Fremont County will contribute $10,000 for each project with 1% funding towards the development of a scoping report, project agreement and project delivery plan including a design statement of work and project cost estimate for the Horse Creek Road and Wiggins Fork Bridge projects. Keja Whiteman moved, Larry Allen seconded, to authorize 1% funding in the amount of $10,000 for each project. Motion carried unanimously.

In other business, Dave Pendleton gave an update on what the various crews were doing within the County. He and staff are working on gravel sources and quantities needed and will provide a plan in the near future. Chairman Thompson relayed a concern he received regarding V-1 Road as well as concerns from several landowners on Mortimore Lane. Commissioner Whiteman further relayed concerns she had received with Diversion Dam Road and he stated he would look at estimated costs associated with drainage and pavement issues in that area. In closing, Commissioner Kessler stated concerns with Shrine Club Road due to anticipated increased traffic and a potential need for a guardrail.

Vehicle Maintenance Administrative Secretary Pennie Buffington was present to provide an update on numerous vehicle accidents. Also present was Transportation Superintendent Dave Pendleton and Sheriff Skip Hornecker.

1) Motor Grader – potential vandalism was reported on the motor grader on Lewiston Road on South Pass in the Rock Creek area. The operator had reported the damage to the Sheriff’s Office who stated the window facing east had a pit in the glass from something striking it from the outside, possibly done by a small caliber firearm round or air rifle. It could also have been caused by a rock striking the glass that was kicked up from a passing vehicle. Buffington stated the window had been replaced at a total cost of $500.

2) A Transportation Department employee caused $343.18 worth of damage to irrigation pipe on Iiams Road. Crews were in the area applying water in preparation for mag chloride operations. While turning the semi/water trailer around at the end of the road, the operator had to back into a field, running over irrigation pipe. The County’s liability carrier, Wyoming Association of Risk Management (WARM), has made a settlement to the individual for the pipe replacement.

3) Transportation Department 2000 Chevy Silverado 2500 (PT-1376) – Dave Pendleton reported an employee was turning south off WY 134 and as there was an oncoming vehicle, could not use the other lane to make a wider turn and hit a fence post, causing damage to the right side of the truck. Three quotes were received, with the low bid at $3,142.61. Pendleton recommended the vehicle not be repaired but rather the dents knocked out by Vehicle Maintenance at a cost of $250. The damage does not impact the functionality of the vehicle, but may have an impact on the vehicle value at the time it is replaced. The Board agreed with the recommendation to fix in house at a cost of $250.

4) County Attorney’s vehicle (PC-1101) received damages due to a hit and run accident while parked at the Riverton Office. Three bids were received and the low bidder was Olson’s Auto Body & Towing in the amount of $1,177.47. Extensive camera footage was available for review and Buffington suggested posting a $500 reward towards the arrest and conviction of the person causing the damage, following review of correct wording by the County Attorney’s Office. Larry Allen moved, Stephanie Kessler seconded, to accept the low bid submitted by Olson’s Auto Body & Towing in the amount of $1,177.47 and offer the $500 reward from the Vehicle Maintenance Department. Voting against the motion: Keja Whiteman. Motion carried.

5) EMS Ford Expedition (CO-2469) received damage when it struck a deer. Three bids were received with the low bidder being Fender Mender Body Shop in the amount of $5,465.91. Buffington stated Fremont County Sheriff’s Office investigated; however, the County’s property insurance carrier, WARM, stated the importance of getting an outside agency to investigate. As a result, their Department is waiting for an outside agency’s report and she suggested a reminder be sent to all staff using County vehicles to seek an outside agency in the event of an accident. As the WARM deductible is $5,000, discussion was held on whether or not to submit the claim as the County would only recoup $465.91 and could possibly cause the rates to increase. Stephanie Kessler stated her belief that the County should be using the policy if they were paying the premiums and moved to accept the low bid from Fender Mender in the amount of $5,465.91 and submit the claim to WARM. Voting against the motion: Doug Thompson and Keja Whiteman. Motion failed. Larry Allen moved, Keja Whiteman seconded, to accept the bid from Fender Mender only. Motion carried unanimously.

6) Sheriff’s Department 2008 Ford F150 pickup (PT-1070) – while unit was traveling on Paradise Valley Road, was struck by lightning, causing the patrol vehicle to completely stop running. The rear radio antenna was gone, causing equipment failure. WARM has approved replacing the unit and equipment and the County was able to piggyback with WYDOT’s bidding contract (which will expire August 12th) for the low bid from Fremont Motors for $26,472.00 as well as costs for all other equipment and set up costs, make the total replacement cost $55,660.52. Discussion was held regarding the proper Department to fund the $5,000 deductible and County Clerk Julie Freese will review whether the authorization would qualify for funding through the Capital Revolving Fund. Larry Allen moved, Keja Whiteman seconded, to accept the bid from Fremont Motors in the amount of $26,472.00. Motion carried unanimously.

7) Sheriff’s Department 2009 Dodge Durango (PC-1071) – The unit was totaled when the deputy traveled over a large rock on a two track road while investigating a reported wildfire. The rock was struck by the suspension and pulled out of the ground, rolling down the length of the undercarriage. WARM approved total replacement of the vehicle and set up costs, using salvageable equipment items. The low bid was from Fremont Motors Co by using the WYDOT bid contract for $26,472 and additional equipment and set up costs, making total replacement costs $38,019.13, less the $5,000 deductible. Larry Allen moved, Stephanie Kessler seconded, to accept the low bid from Fremont Motors in the amount of $26,472. Motion carried unanimously. This unit will also be researched to see if it the deductible would qualify for funding through the Capital Revolving Fund. Later in the meeting, Julie Freese reported both units would be added to the Capital Revolving Fund, after proper authorization and approval of the bids.

Fremont County Planner Steve Baumann presented a proposed plat for Lone Star Subdivision, a four lot Simple Subdivision located on 2 Valley Road. Mount Hope Second Subdivision is a proposed two lot Simple Subdivision located within one mile of the City of Lander, near Mount Hope Cemetery. This Subdivision has been approved by the City of Lander and the developer has signed an annexation agreement with the City that includes connection to City water and sewer. Both subdivisions were approved unanimously by the Fremont County Planning Commission. Keja Whiteman moved, Stephanie Kessler seconded, to approve Lone Star Subdivision and Mount Hope Second Subdivisions. Motion carried unanimously.

In other business, Steve Baumann stated the current Delegation Agreement between Fremont County and the Department of Environmental Quality, Attachment A, needs to be updated to designate himself as the Delegated Local Official for Fremont County. Keja Whiteman moved, Larry Allen seconded, to approve sending a letter requesting the DEQ update the Delegation Agreement to name the new County Planner Steve Baumann. Motion carried unanimously.

County Clerk Julie Freese presented two bids for an electronic time card system. This project had been approved for funding through the Capital Revolving Fund for $13,000. She recommended the Time Force system bid of $11,336 that is easier to use and implement. There may be some additional charges to get the system fully implemented, so she recommended an authorization to purchase a system, not to exceed $13,000. Larry Allen moved, Keja Whiteman seconded, to approve the purchase of the Time Force electronic time card system, not to exceed $13,000, with funding through the Capital Revolving Fund. Motion carried unanimously.

Building Maintenance Supervisor J.R. Oakley presented a slide show of improvements to the Green Mountain Campground. He stated the Wyoming Recreation Commission has recommended complete closure of the Campground until spring of 2015 in order to give the ground time to recuperate. It needs to go through a freeze and thaw cycle to allow the ground to heal. He stated the Fremont County Recreation Commission recently voted to allow this to happen by closing it for the recommended time frame. As a result, Oakley stated the addition of the new restroom will be postponed until next year as well. DOWL HKM Engineer Diane Oress approved the Punch List with the contractor, Patrick Construction, noting no items for the contractor to address. A Warranty with the contractor was presented guaranteeing all project improvements including materials, equipment and workmanship for one year and a two year warranty on the regrowth of seeded areas. Keja Whiteman moved, Stephanie Kessler seconded, to approve the Certificate of Substantial Completion with Patrick Construction for the Green Mountain Campground Reconstruction project. Motion carried unanimously.

Larry Allen moved, Keja Whiteman seconded, to adjourn into Executive Session with Fremont County Attorney Michael Bennett and Deputy Jodi Darrough, regarding personnel. Motion carried unanimously. Larry Allen moved, Keja Whiteman seconded, to return to Regular Session. Motion carried unanimously.

Keja Whiteman moved, Stephanie Kessler seconded, to approve the hiring of an Addiction Therapist at an annual salary of $48,000. Motion carried unanimously.

Commissioner meeting reports were given.

Chairman Thompson briefly reviewed numerous calls several of them had received regarding a road access issue in the Porcupine Subdivision. Said matter had been referred to District Court where private road issues now commence.

In other business, he asked for a concise overview on the sick leave conversion benefit that was discontinued in July.

There being no further business, Larry Allen moved, Stephanie Kessler seconded, to adjourn the meeting at 12:30 p.m. and reconvene for a Regular Meeting on August 12, 2014 at 9:00 a.m. Motion carried unanimously.
