The Board of Fremont County Commissioners met in Regular Session at 9:00 a.m. with the following members present: Chairman Douglas L. Thompson, Vice-Chairman Keja Whiteman, Travis Becker, Stephanie Kessler and Larry Allen. County Clerk and Clerk of the Board Julie A. Freese was present for the meeting.

Travis Becker moved, Larry Allen seconded, to approve the Agenda, as amended. Motion carried unanimously.

Travis Becker moved, Stephanie Kessler seconded, to approve the Minutes of the Regular Meeting held June 24, 2014. Chairman Thompson abstained due to his absence at said meeting. Motion carried.

Travis Becker moved, Larry Allen seconded, to approve Contracts between Wyoming Department of Health, Behavioral Health Division and Fremont County Board of County Commissioners as Governing Body for the Court Assisted Supervised Treatment Program of Fremont County and the Fremont County Juvenile Treatment Court. Motion carried unanimously. Travis Becker moved, Stephanie Kessler seconded, to approve the Licenses for New Construction of Utility Crossing or Encroachment submitted by RT Communications for Lost Cabin Road and Burlington Resources Oil & Gas Company for Lysite Creek Road. Motion carried unanimously. Travis Becker moved, Stephanie Kessler seconded, to approve a Cooperative Agreement for Responsibilities between the Wyoming Department of Family Services, Child Support Enforcement, and Fremont County Clerk of District Court. Motion carried unanimously. Travis Becker moved, Keja Whiteman seconded, to approve a letter of support to Senator Mike Enzi for his efforts to preserve the states’ rights and promote local management of lands and wildlife that inhabit them through the Sage Grouse Protection and Conservation Act. Voting against the motion: Stephanie Kessler. Motion carried. Keja Whiteman moved, Travis Becker seconded, to approve an amended Memorandum of Understanding between Fremont County School District No. 1 and Fremont County housing of the Day Reporting Program at the Starrett Junior High School facility. Motion carried unanimously. Keja Whiteman moved, Larry Allen seconded, to approve the Wyoming Health Council Contract with Fremont County Family Planning for Title X funding. Motion carried unanimously.

The following items in the Priority Mail were reviewed: 1) BIA letter regarding their intent to take into trust for the benefit of the Shoshone Tribe lands owned by Dave Long (taken under advisement); and 2) letter of concern from citizen regarding providing a county facility for recent Citizens for Equal Rights Association workshop (Chairman Thompson to respond).

Keja Whiteman moved, Stephanie Kessler seconded, to adjourn into Executive Session with Transportation Superintendent Dave Pendleton and Deputy County Attorney Jodi Darrough regarding potential property acquisition. Motion carried unanimously. Travis Becker moved, Stephanie Kessler seconded, to return to Regular Session. Motion carried unanimously. Keja Whiteman moved, Stephanie Kessler seconded, to provide an appraisal to affected landowners to use in negotiating right-of-way purchase to bring a road up to county standards, and further informing them county maintenance will cease immediately until county road standards are met. Voting against the motion: Doug Thompson. Motion carried.

Dave Pendleton stated an appraisal has been done on the Solid Waste Disposal District building located in Shoshoni. It shows the building’s value to be $85,000. The District had earlier offered the building to Fremont County for use as a Road Maintenance shop and stated they would take in-kind work on Beebe Road as a trade. Pendleton distributed a preliminary opinion of probable project costs for cold mix for Beebe Road, totaling $87,344. The District currently has a long term lease with the Town of Shoshoni for the building, with 18 years remaining on their lease. Discussion was held regarding the necessary changes to the lease agreement with the Town as well as with the District. Keja Whiteman moved, Larry Allen seconded, to approve the trade of the building for cold mix on Beebe Road, and having the County Attorney negotiate a long term lease with the Town of Shoshoni. Voting against the motion: Stephanie Kessler and Doug Thompson. Motion carried.

The bids for the 2014 County Wide Sign Replacement project was reviewed as follows:

S &L Industrial $167,077.40

Keja Whiteman moved, Larry Allen seconded, to accept the low bid from S & L Industrial for the 2014 County Wide Sign Replacement project. Motion carried unanimously. The Notice of Award was signed by Chairman Thompson. Pendleton stated the project is budgeted for funding through the Road Construction Fund and will replace roughly 10%-15% of all County signs.

Commissioner Allen relayed concerns he had received regarding damage to private property at the bottom of the hill on Burma Road. Dave Pendleton stated either chevron signs or jersey barriers will be installed to alleviate this issue.

Dave Pendleton presented a Right-of-Way Agreement with the Sally J. McJunkin Living Trust as required for the North 2nd Street curve project. The curve is being reconstructed to accommodate a 45 mph curve from the existing 20 mph curve and is funded by 1% funds. The appraisal has been done for the .45 acres of easement required for the project. Stephanie Kessler moved, Larry Allen seconded, to approve the Agreement as submitted. Motion carried unanimously.

In closing, Dave Pendleton distributed copies of W.S. § 24-3-201 Identification of County Roads, for their review. He asked the Board to think about the possibility of declaring an official county road map. County Clerk Julie Freese expressed concerns as her office is responsible for filing all road plats and she has been in the process of updating all records over the last several years. Pendleton stated improvements to Red Canyon Road are completed for the most part, with the exception of signage and gravel. The newly hired Riverton Road Crew Chief is on board and beginning his duties.

Chairman Thompson presented Emergency Management Coordinator Kathi Metzler with a plaque in recognition of 25 years of service to Fremont County. Various co-workers were present in the audience.

Popo Agie Conservation District Supervisor Jeri Trebelcock presented a draft grant application for Federal Natural Resource Policy Account grant funding for the purpose of partnering with the US. Army Corp of Engineers in a Section 205 Flood Risk Management Study to see if a cost-effective solution exists to protect the Lander community from future flood hazards. Stephanie Kessler moved, Keja Whiteman seconded, to approve the Application pending several adjustments discussed. Motion carried unanimously.

The Death Benefit portion of the Fremont County Personnel Policy Handbook was reviewed, as approved annually by the Commissioners. The policy states the beneficiaries of a full time employee is entitled to receive the total sum of $10,000, and part-time employees’ beneficiaries to receive $5,000. Travis Becker moved, Larry Allen seconded, to approve the Death Benefit, with funding through the Health Benefit Fund. Motion carried unanimously.

Commissioner meeting reports were given:

Commissioner Allen attended the FCAG meeting in Shoshoni where issues with WRTA were discussed.

Commissioner Whiteman spent time with the newly hired Director of Planning, Steve Baumann, last week.

Commissioner Kessler reviewed potential issues with the Dubois community regarding artifacts recently returned to the University of Wyoming. She stated the monthly Museum Board meeting will be changed from it’s regular date in July of June 10th to June 7th in order to reach a quorum.

Commissioner Becker attended the monthly Planning Commission meeting. There will be a chance to meet with the contractor of the new Fremont County Justice Center on July 10th and a ground breaking has been scheduled for July 11th.

Commissioner Thompson attended the State Sage Grouse meeting last week and was also invited to the signing of the amended Bureau of Land Management Resource Management Plan in Cheyenne. Also returned to Cheyenne to visit with BLM regarding the appropriate management levels for wild horses.

A Budget Work Session was held.

County Assessor Tara Berg updated the commissioners on the proposed assessed valuation for the county for FY 14-15. She stated that it had taken a long time to get the railroad information in, and now that she had them in, the assessed valuation would likely be certified at $917,572,607. The Clerk had currently been using an estimate of $9.6 million for assessed valuation for budgeting purposes. This increased the budget reserves by about $91,000.

Sheriff Hornecker and Communications Supervisor Carl Freeman joined Freese and Mike Stalder in updating the commissioners on the E-911 and Dispatch budget. They had anticipated the change from $.50 per line to $.75 per line would increase the revenue by approximately $33,000 but this was actually an increase per month making a full year more like $360,000. The 5 year plan was revised with this projection helping to make this budget more sustainable with the updated revenue. Commissioners will hear comments on increasing the per line fee at their public hearing July 7, 2014 at 5:30 p.m. and make a final decision the next day, July 8 during the final budget adoption process. The budget takes into account 3 months at $.50/line and 9 months at the $.75/line should this proposition pass as it will take time to get vendors to change the fees.

County Clerk Julie Freese and Clerk of District Court Kristi Green had presented the commissioners a request to reconsider the reduction in both budgets for digitization projects. Both ladies told the commissioners that they were happy to make the cuts if it would help get employees raises, but since the current budget has adequate reserves, they asked if their projects could move forward in full. The Clerk stated her revenues had exceeded last year’s revenues by $184,000 which were due to an increase in the fees which are collected from people looking at the records. Her project is to take all microfilm records and move them to digital means that would be available on the website. The reader printer which is the only method to read these is old and she cannot find a replacement. The full project is $145,000 and she has been able to slowly make the changes by utilizing $10,000 a year out of the budget. Green stated her project cannot be broken into 3 phases due to the cost of setup and difficulties deciding where to end ½ of the project. Her index is a permanent record and they have no backup. The commissioners took this request under advisement and will address it at the budget adoption on July 8.

Hospice had requested that they be able to use their interest revenue of approximately $21,000 to purchase heating/cooling system updates that are needed in the facility.

Mike Stalder reported that the attorney’s budget is not correct and they will need an additional $1,450 for the VOCA program. Freese asked if the commissioners wished to infuse the budget. It was the consensus of the board to not add funding to his budget and ask Mr. Bennett to find the money within his budget.

Letters from various departments were passed onto the commissioners thanking them for their consideration of their budgets. One of those letters was from Youth Services Director Chuck Kratz. He thanked the commissioners for the SOC adjustments for his employees and asked if he could slightly vary the amounts (keeping within the total amount given) based on the employees’ years of service which was approved.

It was noted that the Administrative Assistant in the Transportation/Vehicle Maintenance Department has her salary divided between 3 departments. The Clerk will help them determine those salary adjustments and make the proper departmental updates.

Commissioner Whiteman expressed concern regarding the Fair Board’s confusion regarding the reduction of their budget of $108,000 which was then moved into the Capital Revolving Fund. Both Whiteman and Freese will continue talks with members of that board to make sure they know their projects are approved and a rental payment amount will be added to their final budget figure.

Commissioner Thompson reported that the Recreation Board still wishes to add the bathroom to the Green Mountain Campground. They are reworking their current budget to pay for the bathroom.

Commissioner Kessler asked if the Clerk would request a quick one line sentence from all departments and elected official on how they divided up the 2% discretionary amount for salary increases.

Commissioner Allen requested reconsideration of the Ambulance budget. He stated that his discussions with Joe Zillmer resulted in a request of an additional $165,000 which would help restore the Dubois ambulance staff. Commissioner Becker voiced his concern that the board has never determined that the ambulance service in this county would be a professional service and would like the board to have this discussion in the near future. Commissioner Whiteman also stated that county residents must understand that their choice to live farther from the main cities in a county results in delays in many county services. Commissioner Allen stated that Zillmer is continuing his search for grants and some are looking promising.

The County Clerk was asked to make a list of all potential changes to the budget along with changes that must be made to the budget for review at the adoption portion of the meeting on July 8, 2014. All changes will be discussed at that time.

The Commissioners interviewed the following for vacancies on various County-appointed boards: Donald Newton (Library Board); William Brost (Museum Board, Recreation Commission and Historic Preservation Commission); Janet Hulbert-Young, Chuck Lanham, Lois Herbst and Lynn McRann (Historic Preservation Commission); Kristin Paulsen, Harold Albright (Planning Commission); Ron Cunningham (Recreation Commission) and Evan Reimondo (Recreation Commission & Planning Commission). Travis Becker moved, Stephanie Kessler seconded, to re-appoint Kristin Paulsen and Harold Albright to three year terms on the Fremont County Planning Commission. Motion carried unanimously. Keja Whiteman moved, Stephanie Kessler seconded, to re-appoint Donald Newton to a three year term on the Fremont County Library Board. Motion carried unanimously. Stephanie Kessler moved, Larry Allen seconded, to re-appoint Carla Crofts (recently appointed and not re-interviewed) and new member Ronald DuBay (interviewed June 24th) to three year terms on the Fremont County Museum Board. Motion carried unanimously. With several terms available on the Historic Preservation Commission, a weighted voted was taken. Based on the tally, Keja Whiteman moved, Larry Allen seconded, to re-appoint Janet Hulbert-Young, Chuck Lanham and Lois Herbst and new applicant William Brost to three year terms on the Fremont County Historic Preservation Commission. Motion carried unanimously. Travis Becker moved, Larry Allen seconded, to re-appoint Ron Cunningham and appoint new applicant Evan Reimondo to three year terms on the Fremont County Recreation Commission. Motion carried unanimously.

There being no further business, Travis Becker moved, Larry Allen seconded, to adjourn the meeting at 4:25 p.m. and reconvene for a Special Meeting on July 7, 2014 at 5:30 p.m. for the Public Hearing for the proposed FY 2014-15 budget. Motion carried unanimously.
