Introduction

The speaker will adopt a practical approach to the management of defects in conjunction with a discussion in respect to the standard forms of construction contract eg, PAM. The seminar will also discuss the administrative and practical aspects of the exchange of correspondence between parties, gathering of evidence, comparative advantage of arbitration, litigation and mediation in resolving a claim. In addition, case studies of Court decision will also provide further interest in the subject.

Objectives

• Rights and duties of parties in respect of construction defects as provided in the contract forms

• A practical approach to managing defects

• Arbitration, litigation or mediation in the claim for defects

Department of Building, National University of Singapore BSc(Building)(Hons), LLB (Hons)(London), Barrister-at-law,  Middle Temple, Advocate & Solicitor of the Supreme Court of Singapore

Lim Pin practised as a Quantity Surveyor in MINDEF in the 1980s. The projects involved the construction of camps, offices and other military facilities. Having gained contracts administration and site experience, he pursued his practice of construction litigation and arbitration with the law firm Donaldson & Burkinshaw where he acted for a number of contracts, both local and overseas, in construction claims. Some of the claims were in respect of the construction of high-end condominiums and MRT works. Capitalising on his experience in construction arbitration and litigation, he gained exposure in corporate work by joining the local

conglomerate NatSteel Ltd as its Head, Legal where he oversaw business transactions in the Company’s diversified businesses such as construction, property, electronics, manufacturing and trading of steel.
