SWEEPSTAKES DESCRIPTION / TIMING: The Dash to Daytona Sweepstakes (“Sweepstakes” or “Promotion”) is offered in the 48 contiguous United States and District of Columbia (“U.S.”). Promotion begins at 12:01 PM Eastern Time (“ET”) on 06/23/15 and ends on 12/31/15 at 11:59 AM ET (“Promotion Period”). Administrator’s computer is the official time keeping device for the Promotion.
SPONSOR: Ford Motor Company, 16800 Executive Plaza Drive, Dearborn, MI 48126.
ADMINISTRATOR: CCO Communications, Inc., d.b.a. Campbell Marketing and Communications, 3200 Greenfield Road, Suite 280, Dearborn, MI, 48120.
ELIGIBILITY: The Promotion is open only to legal residents of the 48 contiguous United States and District of Columbia who are at least eighteen (18) years of age or older as of date of entry with a valid driver’s license. Employees, directors and officers and their immediate families (spouses and siblings, parents and children and their spouses) and household members of Ford Motor Company (“Sponsor”), CCO Communications and their respective parent companies, subsidiaries and affiliates and companies involved in the implementation and execution of the Promotion (collectively the "Promotion Entities") are not eligible. Promotion is void in Alaska, Hawaii, Puerto Rico and other US Commonwealths, Territories and jurisdictions (including overseas military installations) and where prohibited.
AGREEMENT TO THE OFFICIAL RULES: By participating in the Promotion, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and the Administrator, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.
HOW TO ENTER THE SWEEPSTAKES: Participants may enter online at www.DashtoDayto
na.com or on-site where sponsor has its Ford Performance display during the 2015 race season at the NASCAR Sprint Cup Series or IMSA TUDOR United SportsCar Championship. Not all Ford Performance displays are participants in this sweepstakes. Displays eligible for Dash to Daytona will be promoted as such. Sponsor may not display at all events and reserves the right to add, change and/or cancel its intentions to display at any or all of the above locations, at any time, without notice. You will be asked to provide your first and last name, mailing address, phone number and email address (optional). You may also be asked to answer optional questions; however, they need not be answered in order to be eligible for the Sweepstakes. One entry into the Sweepstakes per person is allowed.
Limit: One (1) Sweepstakes Registration per person. Any violation of this limit will result in disqualification. Use of any automated system to participate in the Sweepstakes is prohibited and will result in disqualification.
In all cases, online submission of registrations is the sole responsibility of the participant. Registrations online that are incomplete or otherwise corrupted are void. Sponsor is not liable or responsible for late, lost, damaged, delayed, invalid or misdirected registrations for online entry methods which will be disqualified. All entries become the exclusive property of Sponsor, and none will be acknowledged or returned.
WINNER SELECTION / VERIFICATION: The drawing and prize winner determination will be conducted by the Administrator, an independent judging organization, based on the sweepstakes schedule outlined above, by randomly pulling from all eligible entries (regardless of method of entry). Odds of winning the prize in a sweepstakes drawing depends on the number of eligible entries received for the applicable drawing. Potential winner will be contacted by Administrator by telephone and/or email and will be required to complete and return an Affidavit of Eligibility and Liability Release and except where prohibited by law, a Publicity Release Form (“Affidavit/Release”) within five (5) days of receipt to be eligible to claim the prize. If a potential Prize winner fails to timely execute and return the Affidavit/Release or if he/she is otherwise ineligible to receive the prize or if a potential prize winner cannot be contacted after reasonable effort as determined by Administrator in its sole discretion, an alternate will be selected in his/her place (from among all remaining eligible entries received for the applicable drawing).
PRIZES (1 IN TOTAL APPROXIMATE RETAIL VALUE (ARV)/MANUFACTURER’S SUGGESTED RETAIL PRICE (MSRP): The winner will have their choice of (1) of the following EcoBoost-powered vehicles: a 2015 Ford Focus, a 2015 Ford Fiesta, a 2015 Ford Taurus, a 2015 Ford Fusion, a 2015 Ford Mustang, a 2015 Ford Edge or a 2015 Ford Escape (maximum MSRP $33,000.00). The chosen Ford vehicle color will be selected by the Winner. If final vehicle is less than $33,000.00, Winner will not receive the difference in cash. The Winner will also choose (1) of the following trips for two people: an all expenses paid trip to the 2016 Rolex 24 at Daytona or the 2016 Daytona 500. Trip includes race tickets, hotel stay for two nights, round-trip airfare for two people, rental car and daily per diem. If final trip expenses are less than $4,000.00, Winner will not receive the difference in cash. TOTAL ARV/MSRP OF COMBINED PRIZES IS $37,000.00.
PRIZE RESTRICTIONS: Winner is responsible for vehicle registration, license, all taxes, title and insurance fees and for all costs associated with any available upgrade/option, and any other expenses related to the acceptance and use of the prize not specified. Winner must take delivery of vehicle at a Sponsor-specified time and location or prize may be forfeited. Winner must provide valid U.S. driver’s license and evidence of insurance prior to delivery. Vehicle awarded may differ from any vehicle shown in promotional materials and may take up to six (6) months for delivery. By entering, Entrants acknowledge that operating a vehicle can be a dangerous activity and agree to accept all risk and responsibility associated with operating the vehicle. All expenses and costs related to acceptance and use of prize not expressly listed above, are entirely the winner’s responsibility. Prizes may not be transferred or assigned. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute the prize with another prize of comparable or greater value if the intended prize is not available for any reason as determined by the Sponsor in its sole discretion. Winner will be solely responsible for all applicable taxes (not limited to federal, state, local and/or income) on prize, which will be reported to applicable governmental authorities as required by law and all unspecified costs/expenses in conjunction with acceptance, receipt, possession and use of prize. Winner will be required to provide his/her Social Security number or tax ID# for tax reporting purposes; Sponsor will file an IRS Form 1099 with the Internal Revenue Service for the fair market value of prize. Except where prohibited by law, acceptance of a prize constitutes permission for Sponsor and its designees to use winner’s name, hometown, likeness, statements, and other personally-identifiable information for promotional, advertising and marketing purposes in any media throughout the world without additional prize, incentive, consideration, consent or review; and upon request, Winner will provide written consent to such use. Persons participating in the Sweepstakes via the Online entry method grant to Sponsor and its designees the non-exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable, sublicenseable right and license to use, perform, exhibit, reproduce and/or otherwise exploit any content that entrant created in conjunction with participating in the sweepstakes in any manner and in any and all distribution channels, venues or media now known or hereafter devised, without further notice or any compensation to entrant. The preceding grant of rights is subject only to the rights of any social network service operator/website as to content distributed via its social network service.
GENERAL CONDITIONS / RELEASE: By participating, entrants (a) release Promotion Entities, their respective directors, officers, agents and employees (collectively the “Released Parties”) from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of any prize; and (b) acknowledge that Sponsor and Administrator have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to a prize including, but not limited to the prize quality or availability (with the sole exception of any warranty provided by Sponsor on the prize vehicle itself). Neither Released Parties nor any service providers are responsible for any incorrect or inaccurate information supplied by entrants while participating in the Promotion, incorrect or inaccurate transcription of registration information, or for any human or other error, lost data, omission, interruption, deletion, defect, any other error or malfunction, or late, lost, damaged, misdirected Game activities, or otherwise related to or resulting from participation in this Promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Promotion is not capable of being executed as planned, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other causes which in the opinion of Administrator and/or Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, and/or disqualify any entrant and to cancel, terminate, modify or suspend the Promotion. In the event of any cancellation, termination or suspension, notice thereof will be posted at www.dashtodayto
na.com, and the selection of winner for affected drawing will be made in a manner determined by Administrator in its sole discretion to be fair, appropriate and consistent with these Official Rules.
GOVERNING LAW/JURISDICTION/DISPUTES: Entrants agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan or the appropriate Michigan State Court located in Oakland County, Michigan; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and registrant hereby waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of Michigan.
