Pay TV providers are not legally required to offer a refund if a channel goes dark in a carriage dispute, ruled the United States Court of Appeals. A class action lawsuit filed by two Dish subscribers claimed they were entitled to a credit for missing time on Fox News and Turner-owned channels in 2014, but the appeals court noted Dish provided the channels during most of the agreement and wanted to offer them during the dispute, and its contract allows for a change in programming packages. So, no refund – and one less headache for pay TV providers in the event of a blackout.
Speaking at NYC’s Television and Video Week, Donna Speciale, president of Turner ad sales, said network programming isn’t the only thing that should be engaging viewers. “Our brands should be entertaining audiences,” said Speciale during the Advanced Advertising Summit. “The ads we feature should be compelling, relevant and ultimately drive product off the shelves, off the lots.” The keys, offered Speciale: Audience targeting, redefining ad environments, content creation and content optimization. Also important in a time of sea change in the industry is working together. “We are not going to be able to advance the ad community if we don’t break down the silos,” said Speciale.
Discovery Communications is partnering with World Wildlife Fund to help conserve nearly 1 million acres of protected habitat in India and Bhutan to protect and increase the wild tiger population. “Discovery is a purpose-driven company, and for more than 30 years we’ve had cameras in every corner of the globe, from Planet Earth to Racing Extinction, documenting and inspiring audiences about the beauty and splendor of our planet,” said Discovery president and CEO David Zaslav. “Unfortunately, our cameras also have captured the fragile state of much of the world and its animals. So today we take a bold step further, beyond the lens, to protect one of our most iconic and endangered species.”
WE tv has expanded its “Watch W/In” tune-in initiative, aimed at driving viewers to shows within three days. During Growing Up Hip Hop and Money. Power. Respect., which air as a two-hour programming block on Thursday nights beginning at 9p, the promotion incentivizes viewers to watch WE tv shows live, on demand, or on their DVRs within three days of its linear premiere to be eligible for prizes.
Veteran-owned clothing company Nine Line Apparel is selling Duty, Honor Courage t-shirts in partnership with American Heroes Channel. A three-night Duty, Honor, Courage patriotic programming event airs on AHC starting Wednesday, November 9 at 8p and continues nightly through Friday, November 11.

Eva Longoria has a new project in development at ABC, reports Variety. The Desperate Housewives alum is producing a comedy based on the 2014 book 940 Saturdays with Ben Spector via her UnbeliEVAble Entertainment. Longoria and Spector are also exec producers of a Magnum P.I. revival being developed for ABC.
Shondaland nabbed an ABC pilot production commitment for a legal drama, written by Scandal’s Paul William Davies. Untitled series is set in New York Federal Court centers on the personal and professional lives of new lawyers.
A project from Grease: Live director Thomas Kail, rapper/producer Common and Ian Edelman (How to Make It in America) landed a script commitment plus penalty from Fox. Drama 93 til Infinity focuses on a black rapper and his best friend from middle school looking for a midlife reboot.
CBS is developing a legal drama from Ridley Scott, David Zucker and Brett Mahoney, reports Variety. Mrs. V. Mr. follows a happily married couple on opposite sides in court cases. Mahoney (MacGyver) will write the pilot; Scott and Zucker produce through Scott Free Productions, along with CBS Television Studios.
David Amann (Castle) will serve as exec producer/showrunner for NBC’s upcoming The Blacklist: Redemption. Spinoff is slated to launch midseason.
NEW & RETURNING SERIES
Nickelodeon greenlit season three of The Loud House, currently the top animated kids’ show on television. The series is averaging a 3.4/985,000 among Kids 2-11 (up 38 percent over last year) and 3.3/585,000 with Kids 6-11 (up 48 percent), and delivering almost 2 million total viewers (1.8 million; up 29 percent).
Season three of Bravo’s Ladies of London launches Tuesday, November 29 at 10p. Watch for rivalries, divorce, pregnancy, illness and, of course, family turmoil.
Azteca America is launching new drama series Rabia, about a group of people who escape a quarantine after a rabies outbreak, on Tuesday, November 1 at 9p (check local listings).
Booted Fox News chief Roger Ailes will be the focus of a limited series from Tom McCarthy (Spotlight), Blumhouse Television (The Jinx) and journalists Gabriel Sherman and Jennifer Stahl. The series ill be based on Sherman’s reporting, including allegations of sexual abuse and harassment.

Bruno Mars will open the 2016 American Music Awards, airing Sunday, November 20 at 8p on ABC. It’s the first AMA performance for seven-time nominee Mars, who won Favorite Pop/Rock Male Artist in 2011.
El Rey and Cricket Wireless are teaming to bring Lucha Underground live events to three cities, featuring meet and greets, wrestling drama and a local Cricket branded store. First stop: Phoenix, on October 23, followed by Houston on October 30 and San Diego on November 5.
Investigation Discovery’s fourth annual “Inspire a Difference” event, cohosted by Glamour, will recognize Maria Bello, Joy Behar and Dave Navarro, as well as their charity partners, for their commitment to raising awareness and providing resources and education to victims of crime and social injustices. Ceremony takes place October 26 in NYC.
Following an episode of How It’s Made on Thursday, October 27 at 9p, Science Channel is airing How it’s Made: Halloween 2016 Special, followed at 10:30p by How It’s Made: Punkin Chunkin 2016 Special. That’s ahead of a Punkin Chunkin marathon on Saturday, October 29, starting at 11a.

It’s not just about content. “We’re in a Golden Age of distribution,” noted Brent Smith, president and co-founder of Evolution Digital, during the “Next TV Summit” event at NYC’s Television and Video Week. “We’re going to help the operator deliver a new service,” Smith said, that will “unshackle” MSOs from proprietary systems and allow for greater innovation.
CASTING
Christopher Lloyd (Back the Future) will guest on season three of Syfy’s 12 Monkeys, as a charming but deadly cult leader.
Alyssa Milano (Mistresses) is onboard season two of Netflix’s Wet Hot American Summer: Ten Years Later. She joins returnees Bradley Cooper, Paul Rudd, Elizabeth Banks, Amy Poehler, Molly Shannon and Janeane Garofalo, among others.
Daniel DiTomasso (Witches of East End) will have some juggling to do. The actor has landed recurring roles on three series: NBC’s Timeless, TNT’s Major Crimes and Amazon’s Good Girls Revolt.
Production is underway for Pop scripted comedy The Joey Mac Project, from CBS Television Studios. In addition to Mac, the series stars Adam Ray (MadTV), Jamie Denbo (Orange Is the New Black), Katie Wee (New Girl), Punam Patel (Toast) and Jordan Black (The Mindy Project).

Movie service Vudu is launching an ad-supported movie streaming service. Initial offerings include the likes of Mad Max, 2010’s True Grit remake and School of Rock. “Millions of customers already buy and rent content on Vudu on a monthly basis,” said Jeremy Verba, VP and GM of Vudu. “This new service provides value for customers who want to watch movies and TV for free, when and how they wish to watch, without sacrificing quality.”
The launch of Turner’s SVOD movie service, Filmstruck, slated for yesterday, was postponed to November as technical glitches in the sign-up process are ironed out. “We look forward to bringing film fans a premium service with beautifully curated content and the largest streaming library of world-renowned arthouse, indie, cult and foreign films,” said the company in a statement.
CBS has inked a deal to supply content to Google’s skinny bundle TV service, Unplugged. The agreement includes CBS’s broadcast feed, Pop and CBS Sports Network, but not the CW, co-owned by CBS and Warner Bros.
Multiplatform DanceOn, Mommy & Me Entertainment and go90 are teaming for reality series Raising Heaven, following six-year-old YouTube star Heaven King and her mother. Series premieres Monday, October 24, with a new episode available to stream every Monday on go90.
Jodie Foster will direct and Rosemarie DeWitt will star in an a fourth season episode of Netflix anthology series Black Mirror, slated to return next year.
Seeso renewed Harmonquest for a second season, debuting in 2017. “A lot of people worked very hard on season one of HarmonQuest and I love seeing them rewarded for that because, well, that’s basic behavioral conditioning,” said series creator Dan Harmon.

Presidential candidate Donald Trump will outspend Hillary Clinton in campaign ads for the first time this week. The GOP hopeful will pony up almost $11.7 million in 11 states, versus $10.5 million for Clinton in 7 states. Swing state Florida will gobble over $3.3 million of Trump’s war chest and $3.1 million of Clinton’s.

Liberty Global struck a deal to buy Polish cable operator Multimedia Polska for $760 million. “The acquisition will significantly increase our scale in Poland, where we are already the largest cable operator,” said Liberty Global CEO Mike Fries. “It will also enhance our ability to invest in cutting-edge products and services for Polish consumers and businesses that will help drive organic growth across our enlarged footprint of over four million premises.”
FremantleMedia International extended its Chinese VOD platform Youku for another three years. U.S. content includes America’s Got Talent and Project Runway. “While local content is a big thing in China, Youku has managed to build a loyal base of video enthusiasts,” said Ganesh Rajaram, FMI’s VP, Asia.
Mattel animated American Girl series WellieWishers has been picked up by its first European broadcaster, Sony-owned Tiny Pop, and has greenlit a second season of the show. WellieWishers just launched on Amazon Prime Video in the U.S.
4K Media partner SIC-K in Portugal has picked up Yu-Gi-Oh! Zexal seasons 2 and 3 and Yu-Gi-Oh! Arc-V seasons 1 and 2, while Canada’s Teletoon has begun broadcasting season 2 of Arc-V.
Entertainment One pre-school series Ben & Holly’s Little Kingdom will debut on Canada’s Treehouse on Monday, October 24 at 8a.
Breakthrough Entertainment kids show Bruno and Boots has two sequels currently in production: Bruno & Boots: This Can’t Be Happening at Macdonald Hall and Bruno & Boots: The Wizzle War.
Interactive studio-based format, Who’s Asking? has been picked up in the Czech Republic, Croatia, Slovenia and Slovakia by multi-territory production company Global Business Mapping. The game show is produced by United Studios of Israel and distributed by Armoza Formats.

Its second week in the Tuesday-at-9p slot, NBC’s This is Us earned 2.6 among A18-49 and 9.7 million viewers, ahead of lead-in The Voice in the demo (2.5 and 10.5 million total viewers).
Fox newcomer Lethal Weapon rose over 3 million from its Live+SD ratings to hit .9 million vlewers in Live+7 numbers, and gain 53 percent among A18-49, to 2.6/10. Fellow frosh Pitch rose 60 percent in Live+7 to 1.6/5, and added 2 million viewers, to 5.6 million.
New off-net syndication entry Last Man Standing was steady week to week at a 1.5 in its third outing, the session ending October 9.This put it in a sixth-place tie among sitcoms with sophomore 2 Broke Girls.
The season 7 premiere of Discovery’s Gold Rush ranked as the #1 show on all of TV on Friday night among M18-49 and M18-34. It was also cable’s #1 telecast across all 25-54, 18-49 and 18-34 demos. The series scored a 2.12 P25-54 rating with 4.0 M total viewers P2+ on Friday, October 14 in Live+3.
Food Network’s Halloween Baking Championship on Monday scored a .6 P25-54 (570,000 IMP), a gain of 65 percent versus year-ago and ranking #9 in the timeslot across all cable.Overall, Food Network’s Monday night was up 36 percent YOY, with season two of Halloween Baking Championship up 56 percent over season one.
The third episode of this season’s Saturday Night Live averaged 7.016 million viewers, up 22 percent over last season’s October originals average. Among A18-49 the NBC late nighter drew a 1.98 rating in Live+SD, the best third season episode since 2013.
Bravo’s The Real Housewives of OC was the most watched (P2+) episode of the season to-date, earning 1.8 million P18-49 (up 6 percent versus the prior week’s episode), 2 million P25-54 (up 3 percent) and 3.2 million total viewers (up 7 percent) in Live+3. The net’s Below Deck ranked as the highest rated episode in series history among all key demos , delivering 1.38 million P18-49 (up 9 percent versus the prior week’s episode), 1.55 million P25-54 (up 3 percent) and 2.47 million total viewers (up 5 percent).
Oxygen’s Bad Girls Club was the most watched episode of the season to date among total viewers, delivering 894,000 total viewers (up 4 percent from the prior week) in Live+3.
