On pause since its Supreme Court defeat in June, Aereo is working to make the case that it should be classified as a pay TV service. In a blog post Monday, CEO Chet Kanojia said the company filed an ex-parte notice disclosing conversations with the FCC supporting a category of online video services that deliver linear channels of video programming within the regulator’s definition of Multichannel Video Programming Distributor. “We believe that clarifying the MVPD definition to narrowly include linear online video services like Aereo’s would have clear benefits to consumers, creators and distributors alike,” wrote Kanojia.

Executive Director David White signed on for four more years with SAG-AFTRA. “It’s an honor to represent SAG-AFTRA members and I look forward to continuing the great work we have accomplished to date,” said White.

PRODUCTION & DEVELOPMENT

Online video network Maker Studios, purchased by Disney for up to $950 million in May, will produce a Halloween-themed show for Disney Channel and a prank special for Disney XD, co-hosted by Maker video creators and Disney Channel stars. And that’s just for starters. “The Maker content catalog is primed for television – with hundreds of thousands of videos created around trends and themes,” said Gabriel Lewis, EVP of development and strategy at Maker.

Maker’s also partnering with Millennial-focused Fusion, for a Maker branded block of TV programming featuring themed content beginning with a “best of 2014” special. Fusion is a joint venture between Disney/ABC and Univision Communications.

Reelz and Muse Entertainment are following up 2011’s The Kennedys with four-hour mini-series The Kennedys – After Camelot. Katie Holmes (Dawson’s Creek) will reprise her role as First Lady Jackie Kennedy, as well as direct one of the episodes and serve as exec producer. Mini is slated for a 2016 premiere on Reelz and Canada’s Corus Entertainment.

Actor/writer Wilson Bethel joins the cast of upcoming ABC limited series The Astronaut Wives Club, written and exec produced by Josh Schwartz and Stephanie Savage. The pair exec produce CW’s Hart of Dixie, where Bethel plays Wade. Hyphenate Bethel also struck a blind script deal with Warner Bros. TV for a CW drama project.

A+E Networks Asia and Ideate Media have launched a regional production partnership to kick start content development in Asia. Programming will target both regional and global audiences. “As A+E Networks Asia expands into broader, mass markets, the importance of regionally-produced content is becoming more prevalent,” said Sean Cohan, EVP, international, A+E Networks.

Ben Affleck and Matt Damon are developing a futuristic thriller for Syfy, according to the Hollywood Reporter. Incorporated comes from their Pearl Street Films and CBS Television Studios; Ted Humphrey (The Good Wife) will act as showrunner and exec produce.

ABC’s Once Upon a Time was down 16 percent in viewers (7.7 million) and 21 percent in the demo (2.6/7) versus the Sunday prior, according to fast nationals. The net’s Resurrection, facing the double whammy of football and the season premiere of AMC’s Walking Dead, was down 18 percent in total viewers, to 5.5 million, and 30 percent among A18-49, to 1.4/4. Still, points out ABC, with a 1.6/4 rating, it was the only broadcast net up year to year on Sunday in A18-49.

A Live+7 lift helped CBS grow 2 percent in viewers for premiere week (13.5 million) versus last year, with the playback added, and was even in A18-49 (3.1). NBC held 2013’s  3.7 rating in the demo with its L+7 boost, and was up 6 percent in viewers, to 12.1 million. ABC had mixed news: down 6 percent in the demo to 2.9, but up 4 percent in viewers (10.3 million); Fox was down 4 percent to 2.7 in A18-49 and down 9 percent in viewers (6.8 million) versus last year.
