A motion filed Friday by the attorney for Fox News CEO Roger Ailes, being sued by former Fox News host Gretchen Carlson for sexual harassment and retaliation, claims Carlson breached her contract by going public. The legal papers point to an arbitration provision in Carlson’s contract that requires “all claims relating to her employment be brought to arbitration,” and that allegations be “held in strict confidence.” Responded Carlson’s attorneys, “Roger Ailes is trying to force this case into a secret arbitration proceeding. Gretchen never agreed to arbitrate anything with Mr. Ailes and the contract on which he relies does not mention him and is not signed by him. Gretchen intends to fight for her right to a public jury trial, a right protected by the discrimination laws and our Constitution.” While 21st Century Fox expressed “full confidence” in Ailes and Carlson’s one-time Fox & Friends co-host Steve Doocy, also mentioned in the suit, the company said it has started an internal review of the matter.

Syfy canceled Hunters after one season. Series finale of the drama about the fight against alien terrorists, exec produced by Gale Anne Hurd (The Walking Dead), airs tonight at 12a.

NBC’s Late Night With Seth Meyers will broadcast live on Thursday, July 21, the final night of the Republican National Convention  presumably not long after the acceptance speech of Donald Trump. CBS’s Late Show has already announced it is broadcasting live on the nights of both conventions, and HBO’s Real Time With Bill Maher is planning special half-hour live episodes. Meyers told the New York Times he’d “very much like” to do a live show after the Democratic convention the following week as well. “Looking back,” said Meyers, noted for his biting comic political commentary, “we should have come up with this whole thing 12 months ago.”

The rise of SVOD is real, but live TV is very much alive, according to Chris Walters, CEO of Encompass, commenting on Nielsen’s Q1 Total Audience Report. “My belief is that live will continue to be the bulk of total viewing minutes for quite some time,” says Walters, noting that consumer behavior shifts “modestly” over time. “SVOD has a increasingly important role to play, however networks play an important role in helping viewers discover great content, aggregating/presenting content that aligns to network brands and making the most valuable content available in the most timely fashion.” Nielsen’s report notes the availability of SVOD programming is now equal to DVR penetration, with both available in 50 percent of U.S. households.

Andy Greenwald has been set to host Hacking Robot, USA’s new Mr. Robot aftershow. Season two of the USA drama launches Wednesday, July 13 at 10p.

The Paley Center for Media will hold PaleyLive LA: An Evening with Ray Donovan on Tuesday, July 26 in Beverly Hills. Stars and producers of the Showtime drama will be on hand for a screening, panel discussion and audience Q&A.

Univision filed a lawsuit against Charter on Friday, accusing the cable operator of using its recent merger with Time Warner Cable to pay lower carriage fees. “Charter insists that the contract Univision had with Time Warner is controlling, rather than its own contract with Univision,” said the net in a statement. “Quite simply, Charter promised one thing publicly in order to secure approval for its acquisition and is now privately claiming the exact opposite to Univision.”

Secrets of an ancient Roman city are revealed in Science special Lost World of Pompeii on Tuesday, July 12 at 9p. A team of archaeologists and anthropologists use X-ray technology on ancient body casts to gather information, including age, occupation and ethnic lineage.

Guests on the Tuesday, July 12 finale of NBC variety show Maya & Marty include Sean Hayes, Steve Martin and Emma Stone. Kelly Ripa will be interviewed for the “Jiminy Glick’s Celebrity Sensations” segment.

New AMC late night talker Geeking Out goes Comic-Con on Sunday, July 24 at 10p, with a special episode focused on the big event in San Diego. Kevin Smith (Comic Book Men) and Greg Grunberg (Heroes) host.

NEW & RETURNING SERIES

Exclusive: Animal Planet picked up My Cat From Hell for season eight, to premiere in 2017. The series helped Animal Planet claw its way into the top 10 in cable in June among W25-54 on Saturday nights, with season 7 averaging 1 million viewers per episode, for the most-watched season since 2013. The show saw year-over-year gains among total viewers (up 31 percent), P25-54 (up 31 percent), W25-54 (up 29 percent), W18-49 (up 22 percent), and M25-54 (up 33 percent).

Pivot picked up Please Like Me for a fourth season, launching Thursday, November 10 at 10p. Production of the new season begins this week in Melbourne, Australia.

Botched spin-off Botched By Nature follows plastic surgeons Dr. Terry Dubrow and Dr. Paul Nassif as they travel the country seeking to transform the lives of people with abnormalities. First of eight hour-long episodes launches Wednesday, August 3 at 9p, followed by aftershow Botched Post Op.

Season two of Nicktoons competition series Soccer Superstar launches Friday, July 15 at 10p. The series, hosted by gold medalist Heather Mitts, is part of the NickSports TV block.

AT&T Audience Network grabbed a third season of Kingdom. Gritty mixed martial arts drama airs Wednesdays at 9p.

BBC America drama Ripper Street is back for season four on Thursday, July 28 at 10p. Bloody drama picks up in the summer of 1897, with Queen Victoria celebrating her diamond jubilee while Edmund Reid (Matthew Macfadyen) discovers an old friend is about to hang for a brutal murder.

Three night event docu-series My Last Days, about people facing a terminal illness, will air on CW Wednesday, August 17-Friday, August 19 at 9p. “My Last Days is an inspirational look at what happens when we detach from the material things of the world and live fully in the moment,” said Justin Baldoni, filmmaker and star of Jane the Virgin.

Chrisley Knows Best landed a 12-episode fifth season order, and had an additional six eps tacked onto season four, for 26 total. The first half of season four, which wrapped June 14, boasted best-yet delivery among A18-49 (1.4 million, up 3 percent versus last season), A25-54 (1.5 million, up 3 percent), and total viewers (2.6 million, tying season 3). Back half of season 4 launches in the fall.

ADVERTISING AND BRANDS

History and YETI, manufacturer of outdoor lifestyle products, are partnering for an outdoor adventure block, running Saturdays from 11a-2p through July 30. Programming includes four short-form YETI films during encore episodes of Alone, Mountain Men and IRT. “Wild History” airs with limited commercial interruptions. “Our goal with branded content is to tell character driven stories about people who live a life built around their passions,” says Scott Ballew, executive producer at YETI. “Finding innovative and authentic ways to distribute these stories is a fun challenge and we’re thrilled to test the waters of TV with History by buying media where media hasn’t historically been for sale.”

General Mills is going all mobile to promote its new Tiny Toast cereal to young adults. Ads in the campaign, developed with agency Walrus, will run across youth-oriented channels; fans can follow the brand across social media using @TinyToastMedia. “It’s a very whimsical product,” said General Mills CEO Ken Powell during an investor call, “very whimsical name, whimsical marketing and it fits the niche for teens.” It’s the company’s first new cereal brand since 2001.

CASTING

Harold Perrineau (Lost) and Jenn Lyon (Justified) have been cast in TNT dramedy pilot Claws, set in a nail salon. They join previously announced Niecy Nash (The Soul Man).

Musician/actress Ariana Grande has joined the cast of NBC’s Hairspray Live!, as Penny Pingleton. Live musical will air Wednesday, December 7 at 8p.

Newcomer Emily Rudd, Skyler Maxon (Faking It), Keenan Tracey (Bates Motel) and Maria Dizzia (Orange Is the New Black) are onboard drama pilot Sea Change (wt), about a girl on a journey to reunite with her estranged mother. Filming for the Lifetime show is taking place in Nova Scotia through August.

Adrian Martinez (Focus) landed a series regular role on NBC spin-off, The Blacklist: Redemption. Drama stars Famke Janssen and Ryan Eggold.

Colin Cunningham (Falling Skies) booked a series regular role in Syfy’s straight-to-series drama Blood Drive. Production is scheduled to begin next month.

Richard Cabral returns to ABC anthology series American Crime, set for season three in North Carolina and focused on labor issues, economic divides and individual rights. Felicity Huffman and Regina King will also be back.

DIGITAL DOINGS

truTV and Hulu struck a deal that will grant Hulu SVOD rights to the first five seasons of sketch series Billy on the Street. It’s the first truTV series licensed to the platform, and builds on an existing partnership between Hulu and truTV parent Turner.

HGTV and Food Network launched exclusive apps for Amazon’s Fire TV that offer viewers a simplified watch-and-shop experience. Now through August, viewers can download free shopping-enabled Fire TV apps to watch original digital home and food lifestyle programming and seamlessly shop for products related to topics mentioned in the shows. “In the industry, we see many efforts to help consumers buy what they see and shop a second screen as result of TV viewing, but this is a huge jump in making it one seamless experience,” said Beth Lawrence, EVP of digital ad sales for Scripps Networks Interactive.

GLOBAL GOINGS ON

Turner struck a syndication agreement with Australia’s Nine for Adult Swim content. Nine’s 9GO! will host a weekly one-hour, Adult Swim-branded block of programs starting July 10.

RATINGS

While CBS won the night on Thursday among A18-49, helped with a 1.9/7 for Big Brother at 9p, Telemundo was first in all of broadcast at 10p hour with 1.0/4 for El Senor de los Cielos.

Food Network posted a .6 rating on Tuesday for both A25-54, up 14 percent year-over-year (530,000 impressions) and A25-34, up 17 percent (160,000 impressions), ranking 6th and 3rd, respectively, across ad-supported cable.The most recent episode on Food Network Star on Sunday earned a .7 A25-54 (660,000 impressions) and ranked 3rd in its 9p timeslot across all ad-supported cable; to date this season the series has been seen by nearly 27 million P2+ viewers.

Animal Planet had a 7 percent boost in total viewers and was up 16 percent in W25-54 in June 2016 versus June 2015.

Galavision boasts it was the leading entertainment cable network in primetime among Hispanics A18-34 and A18-49 regardless of language in June. “Our strategy of delivering the laugh-out-loud comedies and hard-hitting dramas that we know our audience craves is delivering results,” said Ramsey Elia, VP of programming, Galavision and Cable Networks, Univision Communications Inc. “We deliver programs that are engaging and relevant to their lives.”

Bravo’s The Real Housewives of Orange County on June 27 grew from its season premiere among P25-54 and total viewers, delivering 1.5 million P18-49, 1.7 million P25-54 and 2.8 million total viewers (Live+3). The next night, Below Deck Mediterranean delivered 1 million P18-49 (up 17 percent versus the week prior), 1.2 million P25-54 (up 13 percent) and 1.9 million total viewers (up 13 percent).

The season two premiere of Bounce TV’s In the Cut on July 5 reached 636,000 P2+ in two telecasts, an increase over the season one premiere average. The 9p telecast was up 34 percent in delivery of W25-54, up 49 percent in W18-49 and up 17 percent in W2+ versus the season one finale. The show’s median age dropped from 45 to 33.

Travel Channel’s “Dive Into Summer” event, launched Sunday, June 19, is going swimmingly so far. With Top Secret Swimming Holes, Xtreme Waterparks and Island Explorers already on the air, the event time period has rated 58 percent higher among P25-54 viewers than it did last year. So far, Sunday, July 3 marked the highest-rated week of the stunt.

TV One had its most watched June primetime performance among key demos (P2+, P25-54, W25-54) ever. Led by feature film Love Under New Management: The Miki Howard Story, docu-series Rickey Smiley For Real and signature series Unsung, the net reached 23 million unique total viewers 2+ last month  up 10 percent versus June 2015. In addition, TV One also achieved its #3 most watched 2Q primetime performance in network history and was the #6 ad-supported cable network in primetime among AA P25-54.

EXECUTIVE MOVES

Steven A. LoCascio has been promoted Chief Operating Officer and Stephen Hackett has been upped to President of Sales for CBS Television Distribution. LoCasio had been Executive Vice President and CFO, while Hackett had been EVP and National Sales Manager. Hackett succeeds Joe DiSalvo, who will transition to an advisor role with the company.

Andrew O’Connell has been named Vice President of Development and Production at Discovery Channel US. O’Connell joins Discovery from ITV.

Michael V. Marinello joins Turner as Senior Vice President, Corporate Communications. Most recently, Marinello was Global Head of Communications, Technology, Brand and Sustainability for Bloomberg LP.

Starz elevated Alison Hoffman from Executive Vice President of Marketing to the newly-created position of Chief Marketing Officer.

Steve Leroy has been appointed Senior Vice President, Public and Regulatory Affairs for Discovery Networks International. Leroy arrives from Anheuser-Busch InBev, where he was Vice President, Legal & Corporate Affairs in Europe.

Andrew Lombardi has been named Director of Global Digital Media at CSI Sports.
Previously, Lombardi helped build proprietary producer and distribution systems of online sports videos at Cinesport.

Maria Grasso joins Skydance Television as President of production studio Tiny Pyro. Grasso is exiting One-Two Punch Productions, the company she co-created with Deborah Spera.

EXECUTIVE MOVES

Actor John McMartin died July 6. He was 86. In addition to numerous Broadway and film roles, including Sweet Charity, McMartin made frequent appearances on television, including guesting on Unbreakable Kimmy Schmidt last year.
