POSITION DETAILS

Reporting to the Chief Diversity Officer and Special Advisor to the President (CDO), the Deputy Director of Diversity and Title IX Compliance will assist in implementing the CUNY affirmative action, equal employment opportunity (EEO), Title IX, Enough is Enough, and diversity policies at the Borough of Manhattan Community College by ensuring compliance with relevant federal, state, and local statutes.

The Deputy Director of Diversity and Title IX Compliance also supports College compliance with laws and rules relating to sexual misconduct on campus (primarily Title IX of the Education Amendments of 1972, as well as the Violence Against Women Act, and the Clery Act) and works closely across the college community to foster a safe and supportive environment, conducive to academic pursuit and healthy personal development of all persons.

The Deputy Director of Diversity and Title IX Compliance is responsible for but not limited to:

* Managing the Title IX Enough is Enough compliance program:

* Maintaining and monitoring data related to the status and outcome of complaints and investigations;

* Evaluating investigative practices and recommending improvements;

* Assisting in preparing periodic and annual reports and in communicating with senior management.

* Implementing an education program covering relevant local, state, and federal laws, CUNY and campus policies and procedures, and approaches to preventing and responding to reports of sexual misconduct.

* Conducting investigations resulting from reports of sexual misconduct involving any member of the college community:

* Evaluating inquiries and referring those which are not appropriate for investigation to other units;

* Using investigation protocols to plan each investigation, conduct interviews, collect relevant information, and document and issue findings;

* Advising the Reporting Party, Accused Party, or others as appropriate on the reporting process, case disposition, and about support resources available at the college and in the community.

* Collaborating with others across campus (particularly Student Affairs and Public Safety) to conduct training, prevention, and education efforts and to periodically review climate and culture.

* Maintaining and communicating public information on the College's response to sexual misconduct (such as the Title IX web site) and on support resources in the college and in the community for those seeking assistance.

Under the supervision of the CDO, the Deputy Director of Diversity and Title IX Compliance will also:

* Promoting the effective implementation of the internal non-discrimination policy by conducting intake interviews, conducting investigations, and assisting the CDO with the resolution of complaints asserted under Title VI, VII, IX, Section 504, federal/state/local non-discrimination laws, the ADA, CUNY policy, and under any other law that prohibits discrimination based on a protected status.

* Assisting with the preparation of affirmative action plans.

* Working to implement best practices to promote compliance in recruitment, retention and equal employment opportunity.

* Developing and providing training to faculty, staff, and students regarding EEO laws and policies, sexual harassment laws and policies, affirmative action, and related best practices.

* Partnering with search committees and other personnel involved in the search process to ensure good faith efforts are made to recruit diverse applicant pools.

* Performing related duties at the request of the CDO to advance the mission of the Office of Compliance and Diversity.

QUALIFICATIONS

Bachelor's degree and eight years' related experience required.

OTHER QUALIFICATIONS
J.D. or advanced degree in higher education administration or related field preferred. Eight years of progressively responsible experience in a legal, student conduct, student life, human resources, or similar field. Experience working on compliance with Title IX regulatory requirements in a higher education environment will be considered highly valuable. Investigatory experience, excellent verbal written communication skills, as well as strong presentation, interpersonal skills, and an ability to work collaboratively with various campus representatives are also highly valued.

In addition, preferred candidate will have experience in the following:

* Clear understanding of Title IX /Enough is Enough developments, regulatory and enforcement guidance, and legislative initiatives.

* Demonstrated understanding and sensitivity regarding experiences and expressions of trauma caused by sexual violence and harassment.

* Strong presentation skills with an emphasis on education and training for a variety of constituencies.

* Strong analytical, organizational, and communication skills (verbal and written).

* Willingness to work collaboratively with key constituent groups and community partners.

* Ability to perform in a time-sensitive environment and work independently.

* Strong interpersonal and listening skills.

* Demonstrated ability to adhere to privacy regulations and to maintain confidentiality as needed.

* Ability to thrive in a fast paced and deadline driven environment without sacrificing thoroughness and attention to detail.

* Conducting complex investigations into allegations of unlawful discrimination and harassment.

* Broad and detailed knowledge of non-discrimination laws, including Title VI, VII, IX, Section 504, Violence Against Women Act, the Clery Act, federal/state/local non-discrimination laws, federal/state/local disability laws, and related regulations.

* Ability to provide policy guidance as a subject matter expert in the field.

CUNY TITLE OVERVIEW

Conducts comprehensive investigations of human resources concerns and complaints and assures issues are properly reported, answered and remediated.

* Conducts in-depth investigations and fact-finding interviews using appropriate action plans, investigation methods and interview techniques

* Writes investigative reports documenting methods, findings, evidence, conclusions and recommendations

* Manages a caseload of assigned investigations

* Develops, implements, and oversees multi-faceted training and related programs on effectively conducting and documenting investigations

* May conduct investigations in conjunction with a college or University-level office

* Performs related duties as assigned.
