POSITION DETAILS

The Lehman College campus is located in Bronx, New York and is a Senior College within the City University of New York (CUNY) system. Lehman is the only four-year public college in the Bronx and is recognized as a Hispanic Serving Institution.

As a member of the executive team, reporting to senior executive management, the Administrator oversees one or more College administrative functions to meet strategic goals and provide responsive, cost-effective, and high-quality services and programs. He/she plans, implements, and manages key programs with responsibility for budget, personnel, and daily operations and coordinates and participates in key College- and University-wide committees and advisory groups.

The Executive Counsel to the President/Labor Designee (Special Counsel) is the legal advisor to the President and reports directly to the President. He/she provides guidance on a range of legal, contractual, and administrative matters including but not limited to: litigation, employment and labor law, compliance and contractual agreements, governance, fundraising, and immigration matters, including H-1B visa and permanent residence processes. The Executive Counsel serves as hearing officer for disciplinary and grievance proceedings and represents the College at higher levels of the disciplinary and grievance processes under the Professional Staff Congress/CUNY Agreement. The Executive Counsel also serves as the College's liaison to the University's Office of Legal Affairs and serves as the campus Ethics Officer, Secretary to the College Personnel and Budget Committee, Secretary to the College Senate, Records Access Officer and is a member of the Behavioral Intervention Team (BIT.) As a member of the President's Cabinet he/she contributes to the achievement of college goals and objectives by providing proactive and strategic guidance.

Responsibilities include, but are not limited to, the following:

* Consultation, coaching, and guidance to executive staff, managers, and department chairs to heighten their understanding of and compliance with the PSC/CUNY Agreement, CUNY and College policies and procedures, federal, state and local law, and higher education regulations.

* Responsible for the administration and interpretation of the University Bylaws, University and College policies and procedures, College governance documents, and the PSC/CUNY collective bargaining agreement.

* Handles employee grievances and disciplinary proceedings and serves as appeals agent for the student disciplinary process; advocates the College's position at appeal hearings.

* Works with union representatives and management to address labor issues.

* Works with attorneys in CUNY's Office of the General Counsel and Office of Human Resource Management and acts as the College's representative at arbitration.

* Investigates complaints from outside agencies.

* Responds to requests for records, files and documents required at legal inquiries and proceedings.

* Reviews and responds to subpoenas and requests for information under the Freedom of Information Law (FOIL) and under the Family Educational Rights and Privacy Act (FERPA.)

* Provides ongoing legal counsel and advice to College staff in areas related to contract and commercial matters involving College and College affiliated entities and prepares contracts and affiliation agreements entered into by the College.

* Assists the Office of General Counsel and the NYS Attorney General's Office in proceedings before federal and state courts and administrative agencies.

* Ensures College compliance with federal, state and local laws and regulations.

* Recommends institutional policies and collaborates with University and College officials to develop and/or revise policies and procedures to insure compliance and currency.

* Performs other related duties as assigned by the President.

QUALIFICATIONS

This position is in CUNY's Executive Compensation Plan. All executive positions require a minimum of a Bachelor's degree and eight years' related experience.

Candidates must have a JD, be admitted to the N.Y. State Bar, and have at least eight years of related experience. The successful candidate will have excellent communication, interpersonal, conflict resolution, and organizational skills as well as excellent judgment. A background in employment/labor law as well as higher education experience highly desirable.
