Bismarck (CSi) District 29 Democratic Representative Jessica Haak, and District 29 Democratic State Senator, John Grabinger are co-sponsoring House Bill HB 1321, to offer more protection for victims of stalking.

Haak testified Wednesday before the state house Judiciary Committee.

North Dakota has no current protections for unauthorized GPS and electronic device tracking as related to stalking.

The bill adds unauthorized GPS and electronic device tracking as a crime under North Dakota’s current anti-stalking law.

If passed, this bill would ensure law enforcement and prosecutors have the

power to intervene in domestic violence cases as well as prosecute.

The bill is in honor of Jacqueline Wisniewski of New York, whose surgeon ex-boyfriend stalked and killed her in 2012 after placing a GPS device in her car and purse.

Co-sponsors of the bill include Representatives Roger Brabandt, R-Minot; Lois Delmore, D-Grand Forks; Mary Johnson, R-Fargo; Lawrence Klemin, R-Bismarck; and Sens. Kelly Armstrong, R-Dickinson, and John Grabinger, D-Jamestown.

WEST FARGO, N.D. (AP) – Authorities have suspended the water search again for a snowmobiler who is believed to have gone through the ice on the Sheyenne River at West Fargo.

Thirty-four-year-old Cole Schwindt, of Moorhead, Minnesota, has been missing since Dec. 2. Divers later found his snowmobile submerged in the river, and police say he is believed drowned.

West Fargo police said Wednesday that they drilled a pattern of holes in the river ice this week in hopes that rescue dogs could pick up Schwindt’s scene. But the search has been put on hold due to thick ice and low water conditions. Officials said they don’t expect more searches until conditions change.

Searches have been conducted using boats, dogs, divers and electronic equipment.

KEANE, N.D. (AP) – Two teenagers are dead after a car and a semitrailer collided in the western North Dakota oil patch.

The Highway Patrol says the vehicles crashed on state Highway 23 north of Keane about 8:30 p.m. Wednesday, after the car spun out of control on a curve.

The 16-year-old boy driving the car and an 18-year-old male passenger died. The patrol did not immediately identify them.

The driver of the semi was not hurt.

ROSS, N.D. (AP) – An Alabama man was killed in western North Dakota when his car collided head-on with a tractor-trailer 10 miles southwest of Ross.

The Highway Patrol says it happened Tuesday afternoon on Highway 1804 when the semi had finished going through a curve in the road and the car crossed into the oncoming lane.

The accident killed 32-year-old Miguel Parrilla-Guadalupe, of Huntsville, Alabama. The truck driver wasn’t injured.

FARGO, N.D. (AP) – A Fargo attorney who won a court battle over a confiscated pay loader is criticizing legislation that would allow police officers rather than a judge decide what happens to allegedly stolen property. The proposal by Representative Kim Koppelman of West Fargo would repeal two sections of state law that require police to hold confiscated property until a judge decides what to do with it. Fargo attorney Mark Friese says he doesn’t think it’s a good idea to take the courts out of the process.

HILLSBORO, N.D. (AP) – A Minnesota man has been sentenced to spend 15 years in prison for a traffic crash that killed two sisters in eastern North Dakota.

James Yahnke (YAWNK’-ee), of Nielsville, Minnesota, pleaded guilty in December to vehicular homicide in the May 2014 deaths of 23-year-old Mercedes Rowley, of Sharon, North Dakota, and 21-year-old Teja (TAY’-tah) Beyer, of Red Lake Falls, Minnesota.

Yahnke was accused of being drunk and speeding on a Traill County road north of Hillsboro and losing control of the car, leading to the crash. The two women were passengers in the vehicle. They were thrown from the car and pronounced dead at the scene.

Yahnke will be on probation for 10 years following his prison time.

FARGO, N.D. (AP) – A North Dakota woman accused of dealing methamphetamine has pleaded guilty in federal court.

Kathryn Lorsung is charged with conspiracy to possess with intent to distribute a controlled substance. Authorities say the conspiracy involved drugs distributed in North Dakota and Arizona.

The 53-year-old Lorsung faces life in prison without a parole.

Sentencing is scheduled for April 20.

GRAND FORKS, N.D. (AP) – A Michigan man convicted of fatally stabbing his friend in a North Dakota oil patch crew camp is appealing his murder conviction.

Thirty-three-year-old Ryan Anderson is appealing his conviction in the death of 32-year-old Christopher King. Both men came from Iron River, Michigan.

A jury in August found Anderson guilty of killing King in March 2013. Anderson was sentenced this month to 20 years in prison.

Anderson has maintained his innocence, saying he stabbed King to death in self-defense. Authorities say the attack was part of an alcohol-fueled dispute at a crew camp between Ray and Tioga, northeast of Williston.

Anderson’s trial was moved to Grand Forks after his attorney successfully argued he couldn’t get a fair trial in Williams County.

WILLISTON, N.D. (AP) – A man accused of having a cellphone while incarcerated at the Williams County Correctional Center and posting photos of himself to Facebook has been charged with five other crimes. Kevyn Johannesson is accused of stealing an all-terrain vehicle, a gun, tools and other items from a garage in Williams County. He’s scheduled to appear in court at the end of April.

WILLISTON, N.D. (AP) – The North Dakota Department of Health says almost 21,000 gallons of oil and more than 19,000 gallons of brine have spilled near Williston.

Oasis Petroleum says it has recovered more than 20,000 gallons of oil from the site of the spill. It says that all but about 42 gallons of the brine that spilled have been recovered. The company says the spill was caused by a tank overflow.

The state’s health department and the Oil and Gas Division are responding to the incident.

BISMARCK, N.D. (AP) – North Dakota’s House has killed legislation that would amend the state’s 24/7 sobriety program to include ignition interlock devices.

The measure was defeated 76-16 on Wednesday.

Ignition interlock devices usually require drivers to blow into a tube to prove they are not intoxicated before they can start the engine.

Minot Republican Rep. Andrew Maragos sponsored the bill that would have allowed someone convicted of drunken driving to use the devices instead of taking twice-daily alcohol tests, or having to wear an ankle bracelet.

Maragos says he sponsored the in part to accommodate a constituent whose conviction in another state requires him to use an ignition interlock.

BISMARCK, N.D. (AP) – Local officials say a proposal to bill counties if they send too many prisoners to state lockups doesn’t address North Dakota’s rising population and crime rates.

State’s attorneys and law enforcement officers also say the proposal could pit counties against one another, and put prosecutors and judges in difficult positions when it comes to giving offenders proper sentences.

Lawmakers are considering a proposal to set a county-by-county allocation at state prison facilities using a formula based on population. Counties that exceed their quota would be billed.

State Representatives Chet Pollert and Jon Nelson say the state prison system is full, and there has to be a better solution than building more facilities.

But North Dakota Association of Counties spokesman Aaron Birst says the quota proposal “is quite offensive to county government.”

MINOT, N.D. (AP) – The North Dakota State Fair Association is renewing its effort to remove a museum from the State Fairgrounds in Minot.

The association is asking a judge to declare that it can legally evict the Ward County Historical Society because the society has no real interest in the fairgrounds property where the Pioneer Village Museum sits.

The association wants the museum off the grounds so it can use the property for other purposes.

The historical society believes that a contract drawn up in 1966 gives it the right to remain on the land.

A  hearing date was not immediately set.

The dispute also has reached the state Legislature. Three lawmakers have introduced a bill that would allow the Pioneer Village to remain on the fairgrounds.
