Jamestown (CSi) The Jamestown City Park Board has unanimously approved plans for a petition drive to place a one percent city sales tax before the voters, possibly in April of 2015.
The tax would be used for construction of the Two Rivers Activity Center and requires a simple majority to pass.
The ballot measure calls for a yes or no vote on the 1 percent sales tax that would remain in place until the debt associated with the construction of the TRAC building is retired or until June 30, 2040, whichever comes first.
If constructed, the TRAC building would be located near Jamestown High School.
Parks and Recreation Department Director Doug Hogan says, the draft petition would be submitted to the city of Jamestown for review next week.
Then, the city has 10 days to review the petition and if approved volunteers can start gathering the signatures. 15 percent of the votes cast in the last presidential election are required, or 1,053 signatures.
Hogan adds that the Parks and Recreation Department will cover the estimated $10,000 cost of the special election.
Hogan said the department is planning on starting a capital fundraising drive.
Final costs of the project could be determined by the amount of capital raised during the drive plus the $28.5 million the Parks and Recreation Department would be able to borrow if the sales tax is approved.
Parks and Recreation would own and operate the recreation center and employ about 50 additional people to operate the center. Other participating groups include Jamestown Public Schools, James River Family Fitness, Jamestown Tennis Association and the Jamestown Gymnastics Club.
FARGO, N.D. (AP) – A federal appeals court says three Jamestown Police officers who shot a Jamestown man after he came out of his apartment carrying a shotgun did not use excessive force.
Michael Partlow was hospitalized for about three weeks following the September 2010 incident. Partlow later filed suit against the officers, who appealed after a federal judge failed to dismiss the complaint.
A three-judge panel of the 8th U.S. Circuit Court of Appeals ruled in a 2-1 decision that the officers should not face legal action.
Partlow said in his suit that he was bending down to place the gun on the ground when the officers opened fire. The appeals court said that even if the officers were mistaken about Partlow pointing the gun at them, their reaction was “objectively reasonable.”
The case has been remanded to the U.S. District Court for further proceedings.
Jamestown (CSi) The Salvation Army has options to donate through gift giving.
On Tuesday’s Wayne Byers Show on CSi Cable 2, the Salvation Army’s Planned Giving Division, Director, Faye Miller, said gifts may include giving to an endowment fund, or through a charitable gift annuity.
She travels North Dakota and Minnesota explaining certain types of gifts and funding options through the Salvation Army Gift Giving Division.
She pointed out that individuals may also remember the Salvation Army in their wills.
She pointed out that making a qualifying gift to the Salvation Army Endowment Fund, realizes a 40 percent North Dakota income tax credit to offset 2014 taxes.
She added that the credit is available to both individuals and businesses with the minimum qualifying gift at $5,000, which may be in lump sum form, or aggregated over the tax year.
The maximum credit for a single tax year is $10,000 for and individual $20,000 for a married couple and $10,000 for business entities. There are provisions for carryover.
She noted also, the North Dakota tax credit in connection with a Salvation Army Charitable Gift Annuity.
Also it’s possible to receive a 40 percent North Dakota tax credit, plus, receive payments for life with a Salvation Army Charitable Gift Annuity.
Gift of stock is also a giving option, and when transferred directly means avoiding as much as 24 percent in capital gains tax.
Also, use appreciated securities or mutual funds to fund the charitable gift annuity, or endowment with additional benefits.
She also pointed out that December 31st is the deadline to make arrangements for 2014.

Valley City (VCSU/CSi) Valley City State University will host a reception for its new president, Tisa A. Mason, Ed.D., from 4–6 p.m., Wednesday, Jan. 7, 2015, in the Student Center Skoal Room on the VCSU campus.
Open to the public, the reception will provide members of the greater Valley City community with an opportunity to meet President Mason and her husband, Mr. Bill Mason. Refreshments will be served.
President Mason comes to Valley City from Hays, Kan., where she served as vice president for student affairs at Fort Hays State University. She previously served as dean of student life at the University of Wisconsin–Whitewater in Whitewater, Wis., and as executive director of the Sigma Kappa Sorority and Foundation in Indianapolis, Ind.
She holds a Doctor of Education degree in higher education from the College of William and Mary in Williamsburg, Va.; a Master of Science in Education from Eastern Illinois University in Charleston, Ill., and a Bachelor of Arts degree in sociology/anthropology from Transylvania University in Lexington, Ky.
BISMARCK, N.D. (AP) – North Dakota’s Historical Society has drafted an agreement to finalize the purchase of the boyhood home of famous band leader Lawrence Welk.
State Historical Society Director Claudia Berg says the group’s board is slated to vote on the agreement next month. The group voted to buy the Strasburg homestead from Welk’s nieces about a year ago. But a final sale price was not negotiated.
The Legislature last year included $100,000 in the Historical Society’s budget for the purchase but lawmakers stipulated that repairs must first be made.
Berg says most of the work has been done. She says all other repairs to the site must be made by spring.
Berg says some of the $100,000 payment will be held until all work is completed.
BISMARCK, N.D. (AP) – Warrants have been issued in North Dakota for four people accused of forging checks worth more than $23,000.
The complaint against the individuals states that during August and September, 26-year-old Rusty Crowe and 24-year-old Patrick Crowe used several people to knowingly cash forged checks from Cyclone Drilling and the Three Affiliated Tribes. The checks were cashed at a Bismarck area grocery store.
The complaint states the Mandaree men paid a nominal sum to the people cashing the checks. The warrants for the men have been issued for leading a criminal association charge, a felony punishable by up to 10 years in prison.
Warrants were also issued for 23-year-old Megan Marie Hale, of Newtown, and 19-year-old Shelton Lane Price, of Bismarck. They are facing counterfeiting charges.
FARGO, N.D. (AP) – Fargo police are looking for help in identifying a man considered to be a “person of interest” in a rape investigation.
The case involves a man who last weekend walked into an unlocked apartment occupied by three North Dakota State University students. KFGO radio reports that the suspect sexually assaulted one woman and attempted to assault another woman. One of the victims broke free during a struggle and ran to a neighbor’s apartment.
Police have released the image of a man who showed up on a trail camera during an investigation into window peeping last April. No further details were released.
WILLISTON, N.D. (AP) – One of two men accused in an oil patch drug case involving methamphetamine, heroin, cocaine and marijuana has pleaded not guilty to eight counts.
32-year-old Jose Villalpando is charged with four counts of delivery of a controlled substance and four counts of possession of a controlled substance.
Authorities say a search warrant in the case led to 9 ounces of meth, 8.8 ounces of heroin, 6 pounds of marijuana and about an ounce of cocaine.
Villalpando has said through an interpreter that the drugs belonged to Porifirio Jimenez, who is also charged in the case. Jimenez is scheduled for a preliminary hearing on Jan. 15.
Villalpando and Jimenez are each being held on $2 million bond.
WAHPETON, N.D. (AP) – An Idaho man convicted of killing a man outside of a strip club in Williston has been sentenced to life in prison without the possibility of parole. Jonathan Horvath was found guilty of murder, two counts of terrorizing and one count of reckless endangerment in the March 2013 death of Derrick Spiegel. Authorities said Spiegel was killed on a sidewalk outside a strip club following an argument.
BISMARCK, N.D. (AP) – North Dakota health officials have identified another case of hepatitis C in Minot. That makes 51 cases of the viral infection that can cause serious liver damage. Most patients have been former or current residents of ManorCare nursing home. But officials say this latest case isn’t connected to ManorCare.
BISMARCK, N.D. (AP) – North Dakota officials are reporting widespread cases of the flu.
The state Department of Health says there were 332 cases of laboratory-confirmed influenza as of the middle of December. Several community outbreaks have been reported in recent weeks.
Health officials say the flu activity has started earlier than normal and it’s important for people to get flu shots as soon as possible.
BISMARCK, N.D. (AP) – North Dakota’s population has reached an all-time high.
The U.S. Census Bureau on Tuesday said the state has 739,482 residents. That’s an increase of more than 15,000 residents from last year’s count.
In the early 2000s, North Dakota was one of only a few states with a declining population. The state began to reverse that trend in 2004 because of the oil boom and the population has grown every year since.
Gov. Jack Dalrymple says the state’s economic growth during the past decade “continues to keep North Dakotans home.” He adds that the state is attracting new residents who want good jobs, a stable economy and a quality of life that is second to none.”
The state has added about 94,000 residents since 2004.
BISMARCK, N.D. (AP) – A proposed bill that was requested by the North Dakota Board of Higher Education would exempt contact information for college students from the state’s open records law.
The move was prompted after a Bismarck-based advertising agency that handles much of the marketing state Republican Party requested the information for about 48,000 students during the campaign season.
Democratic leaders complained about the request and asked Attorney General Wayne Stenehjem to block the release. Stenehjem declined and said the directory is considered a public record.
The bill would keep email, home and mailing addresses, as well as phone numbers, from being subjected to open records laws.
Pat Finken, president of Odney Advertising, which originally asked for the information, did not immediately return a phone message.
BISMARCK, N.D. (AP) – A new website has been unveiled by North Dakota state treasurer’s office.
The site’s home page displays the current operating fund balance, as well as kinks to daily deposits, withdrawals and balances dating back six years.
There’s also a search function for revenue distributions to counties, tribes, cities, school districts and townships.
State Treasurer Kelly Schmidt says the new website “raises the level of awareness” of state funds and balances.
BISMARCK, N.D. (AP) – The Air Force has opened a new recruiting office in Bismarck.
The previous office was closed for about a year after the building was damaged by fire.
Tech. Sgt. Ralph Smith is the Bismarck recruiter. He says the Air Force hasn’t had much of a presence in North Dakota so he hopes the new office will increase interest in the armed forces.
The Air Force also has recruiting offices in Fargo, Minot and Grand Forks.

He’ll begin his new job in early January.
Jamestown (CSi) Jamestown Speedway has released the 2015 schedule, with more racing action planned over 2014, with 21 events planned in the new year. The season starts May 9th.
Returning is the two-night Labor Day races. Races are scheduled each Saturday until a week off on August 8th.
Specials are planned for each of the four classes of competition each week.
Highlights include… a Street Stock Spectacular is scheduled for June 27, followed by an A-Mod Showdown on July 11 and a Midwest Mod Festival on July 25.
The Advantage RV’s Modified Tour returns on May 23, and the Northern Late Model Racing Association is planned for two nights.
The NLRA Late Models will be in Jamestown on June 13 and August 1st.
Not being held in 2015 is the Northern Outlaw Sprint Association event, because the NOSA Sprints were unable to be added due to scheduling conflicts.

TCU’s Gary Patterson is The Associated Press college football coach of the year.
Patterson is just the second two-time winner of the AP coach of the year, joining Nick Saban (2003 with LSU and 2008 with Alabama). The AP coach of the year has been awarded since 1998. Patterson, in his 14th season at TCU, was coach of the year in 2009.
Patterson received 27 of 54 votes from the AP poll media panel. Urban Meyer of Ohio State was the runner-up with 14 votes. Mississippi State’s Dan Mullen received six votes. Alabama’s Nick Saban and Arizona’s Rich Rodriguez drew two votes each. Florida State’s Jimbo Fisher, Baylor’s Art Briles and Memphis’ Justin Fuente had one each.
Patterson guided the sixth-ranked Horned Frogs to an 11-1 record after going 4-8 in 2013.
TALLAHASSEE, Fla. (AP) – Florida State coach Jimbo Fisher has been rewarded with a contract extension to keep him with the program through the 2022 season. The ‘Noles are 58-10 since Fisher replaced Bobby Bowden before the 2010 season.
WASHINGTON (AP) – Virginia Tech football coach Frank Beamer has been cleared by his doctors to work the Military Bowl on Saturday when his team plays Cincinnati. The 68-year-old Beamer is still recovering from throat surgery shortly after the end of the regular season.

NEW YORK (AP) – The AFC West champion Denver Broncos led the NFL with nine players selected for the Pro Bowl. Quarterback Peyton Manning was picked for the 14th time and is joined by Ryan Clady (KLAY’-dee), Chris Harris, Von Miller, Aqib Talib (ah-KEEB’ tah-LEEB’), Demaryius Thomas, Julius Thomas, T.J. Ward and DeMarcus Ware. The NFC East champion Dallas Cowboys were second with six players chosen, including Tony Romo, DeMarco Murray and Dez Bryant.
UNDATED (AP) – The division-deciding games at Green Bay and Atlanta will be played late Sunday afternoon. The NFL has moved the Lions-Packers game for the NFC North championship to 4:25 p.m. EST, to be broadcast on Fox. It also put the Panthers-Falcons game in that time slot, but switched networks for that NFC South showdown to CBS.

The 33-year old right-hander helped Boston win the 2013 World Series and was traded to San Francisco on July 26. After beginning 1-9 with Boston, Peavy went 6-4 with a 2.17 ERA in 12 starts for San Francisco.

BERKELEY, Mo. (AP) – Photos show authorities scuffling with at least a few protesters at the scene where a suburban St. Louis police officer shot and killed a man who pointed a gun at him at a gas station last night. Across the street, another gas station’s glass doors were shattered. Police say a crowd of about 100 people gathered at the scene early today and some taunted officers in Berkeley, Missouri, a few miles from Ferguson, where a white police officer fatally shot black 18-year-old Michael Brown in August.
NEW YORK (AP) – A published report says a New York City man has been released without bail after being charged with posting a threat against police hours after two officers were killed by another man who had signaled his planned attack online. The New York Post reports that 18-year-old Devon Coley was arraigned Monday on a charge of making a terroristic threat.
JACKSONVILLE, Fla. (AP) – Police in Florida say a drive-by shooting apparently targeted a group of firefighters in Jacksonville. Authorities say one firefighter was hit in the arm by a ricochet as the group was putting fuel in a fire truck behind their station. Police say a vehicle drove by and someone fired five or six shots.
AMMAN, Jordan (AP) – Jordan’s military says it will hold the Islamic State group and its supporters responsible for the safety of a pilot captured after his plane crashed during a mission over Syria. Activists said earlier that IS fighters shot down the Jordanian warplane. It was the first warplane by the U.S.-led coalition to be shot down.
MOSCOW (AP) – Russia is accusing NATO of being behind Ukraine’s decision to drop its nonaligned status. Russia also criticized the alliance for expanding its military presence near Russian borders. Ukraine’s parliament abandoned the nonaligned position yesterday, possibly paving the way for a bid to join NATO. Deputy Russian Defense Minister Anatoly Antonov says NATO wants to turn Ukraine into a “forward line for confronting Russia.”
