In state news…

BISMARCK, N.D. (AP) – More than 60 North Dakota lawmakers want to appeal a federal judge’s ruling that overturns a state law banning abortions when a fetal heartbeat can be detected.

U.S. District Judge Daniel Hovland ruled last month that the law is “invalid and unconstitutional.”

In a letter obtained by The Associated Press, Republican Rep. Bette Grande urged Attorney General Wayne Stenehjem to appeal Hovland’s ruling. The letter was signed by 61 GOP lawmakers and two Democrats.

The state’s only abortion clinic in Fargo filed a lawsuit in July against the measure that would ban abortions before many women know they’re pregnant.

Grande says most North Dakotans support the law, which was among four anti-abortion bills Republican Gov. Jack Dalrymple signed into law last year with overwhelming support from the state’s GOP-led Legislature.

BISMARCK, N.D. (AP) – Bismarck police have a suspect in custody after a report of an armed man at a pharmacy.

Officers responded to The Medicine Shoppe about 10:15 a.m. Thursday after calls about a man threatening an employee with a knife. The man fled on foot into a nearby apartment building but was arrested after leaving the building.

It was not immediately clear if the suspect took anything from the drug store.

MINOT, N.D. (AP) – The North Dakota Health Department says one more person has been linked to the hepatitis C outbreak at a nursing home in the Minot area.

State epidemiologist Tracy Miller says the case count is now at 45, all being current or former residents of ManorCare.

At least 500 people have been tested since last year. State officials continue to contact individuals that could have been exposed to the virus and urge them to undergo testing.

ManorCare Health Services-Minot offers long-term care services, but most of its patients come directly from a hospital for rehabilitation before returning home.

Miller says the cases have been associated with receiving phlebotomy, podiatry and toenail care services at the facility.

Hepatitis C is a viral infection that can cause serious liver damage or even death.

WILLISTON, N.D. (AP) – The country’s largest labor federation says North Dakota’s death rate in the oil, gas and mining sector was more than six times the national average in 2012.

AFL-CIO says North Dakota had 104 deaths per 100,000 workers in the oil, gas and mining industry that year. The national rate for the industry was 15.9 deaths per 100,000.

North Dakota’s construction fatality rate was nearly 10 times the national rate for that industry, at 97.4 deaths per 100,000 workers.

AFL-CIO says North Dakota also had the highest overall worker fatality rate in the nation in 2012, with 17.7 deaths per 100,000 workers. The national rate was 3.4 deaths per 100,000.

The sharp growth in worker death rates in the state correlates with its oil boom in recent years.

MINOT, N.D. (AP) – Minot State University President David Fuller is getting ready to call it a career.

Fuller is retiring at the end of June. The school held a retirement party for him last week, and he will oversee his final graduation ceremony on Friday.

Fuller was named the school’s eighth president in 2004. He says it’s been a fun 10 years and he’s proud of where he leaves the school. He also says he’s confident that the school will be in good hands with incoming president Steven Shirley, the current president at Valley City State.

Fuller says he plans to work on various projects in his retirement, including research and writing, and working with groups that help animals and homeless people.

FARGO, N.D. (AP) – North Dakota’s winter wheat crop is expected to be up dramatically over last year.

The Agriculture department pegs this year’s crop at 33.1 million bushels, more than double last year’s crop, thanks mostly to a big jump in acres. The North Dakota Wheat Commission says a large number of prevented planting acres in spring 2013 and favorable fall planting conditions were reasons for the jump in acres.

Spring wheat is North Dakota’s staple crop. Farmers are expected to plant 5.9 million acres of spring wheat this year. They’re expected to harvest about 720,000 acres of winter wheat.

MANKATO, Minn. (AP) – A former Minnesota Gophers quarterback is charged with assault, for allegedly kicking another man in the head after an altercation in downtown Mankato, leaving him gravely injured.

Philip Robert Nelson is charged with one count of first-degree assault and one count of third-degree assault.

Authorities say he kicked 24-year-old Isaac Dallas Kolstad in the head early Sunday as bars were closing in Mankato.

The kick came after Kolstad had been punched and knocked to the ground by another man, who remains at-large.

Kolstad is a former linebacker at Minnesota State, Mankato. He is in critical condition. According to the criminal complaint, doctors are not sure he will survive.

Police released surveillance video of events surrounding the altercation and they are asking for the public’s help.

In world and national news…

WASHINGTON (AP) – The White House says the United States does not recognize the results of a twin sovereignty referendum in eastern Ukraine. Spokesman Jay Carney says it is also “disappointing” that Russia did not use its influence to stop the vote from happening. Russian President Vladimir Putin had previously said the referendum should be postponed, but the pro-Russian insurgents in eastern Ukraine still moved forward with the votes. The insurgents said voters overwhelmingly backed sovereignty. But no international election monitors were there.

LAGOS, Nigeria (AP) – Some of the Nigerian schoolgirls who were kidnapped last month by Islamic extremists have apparently been seen today in a video released by the Boko Haram (BOH’-koh hah-RAHM’) terrorist network. The girls appear frightened, and sit huddled together, wearing gray Muslim veils. They are seen chanting verses from the Quran in Arabic. Some Christians among them say they have converted to Islam. In the video, a leader of the group warns that the girls won’t be seen again unless authorities release members of the group who are being held in prison.

LITTLE ROCK, Ark. (AP) – Dozens of gay couples — including some who waited in line overnight — have been getting marriage licenses from county clerks in Arkansas Monday. They’ve been wasting no time, because lawyers for the state are asking its highest court to suspend a judge’s order allowing the marriages to take place. The judge Friday tossed out a state ban on same-sex weddings.

WASHINGTON (AP) – The nation’s budget deficit remains on track to finish the year at its lowest level in six years. The Treasury Department says the government ran a big surplus in April, thanks to a flood of tax payments. Through the first seven months of the budget year, the deficit totals $306 billion. That’s down 37 percent from the same period last year.

TOPEKA, Kan. (AP) – A state elections board in Kansas is rejecting a claim that U.S. Sen. Pat Roberts is not truly a Kansas resident, allowing the three-term Republican to seek re-election this year. Four northeast Kansas residents had objected to the ballot listing, arguing that Roberts lives in Alexandria, Virginia, and not Dodge City, Kansas. Roberts owns a home in Alexandria but is registered to vote at the Dodge City address of a couple who supports him and rents him a room and bathroom. He and his wife also own a duplex unit in Dodge City but rent it out.
