So you think you should get a refund?

Here's why you won't get one.

Firstly, when you purchase an item on Home, you get a screen like this (link for mobile users http://i.imgur.com/nPE5RdQ.jpg ) -



So there it says in short, you are agreeing to the terms and conditions of PlayStation Network when you purchase the item.

I wonder what those terms and conditions are...

Firstly, we'll look at what the terms and conditions are for PlayStation Home -

"Thank you for your interest in PlayStation®Home. PlayStation Home may not be available, or may not be supported, in some countries and some languages.  Participation in PlayStation Home is subject to the terms of this agreement (“Terms of Use”) which forms a binding contract between you and Sony Computer Entertainment Europe Limited of 10 Great Marlborough Street, London, W1F 7LP (“us”, “we”).  The Sony Entertainment Network (SEN) Terms of Service and User Agreement (“Terms of Service”) also apply.  The Terms of Service and information about PlayStation Home availability are available at www.eu.playstation.com/legal."

Let's just show you what you only need to know right now, which is part 7 of the above terms and conditions link.

"7.  Whilst using PlayStation Home you may have the opportunity to purchase items from an online store, using your SEN wallet.  All purchases are made from Sony Network Entertainment Europe Limited under the Terms of Service.  Please check usage rights and age ratings for each purchase as these may differ from item to item."

All purchases are basically under the terms and conditions of Sony Entertainment Network, so let's see what SEN's terms are, shall we?

Again, we want to look at part 7, about purchasing products from SEN.

It's quite long, and I won't waste your time, so here it is, in plain English -

"(xii)You purchase a licence to use the products as described in these terms of service and do not take ownership of them."

You do NOT own these items, you have a licence to use them.

Don't know what that means exactly?

You are only renting that purchase for as long as you have allowed access to it.

"BUT I DIDN'T WANT HOME TO CLOSE DOWN SO I STILL WANT ACCESS"

10. We reserve the right to suspend or cancel PlayStation Home or your access to it at any time in our absolute discretion. If we believe that you are in breach of any of these Terms of Use, the Terms of Service or any other relevant terms, we may terminate your participation in PlayStation Home and/or your SEN account without paying any compensation to you.

If you have a PlayStation Network account, this is EXACTLY what you agreed to, so you have no legal leg to stand on here. You said "yes I agree with this" when you accepted these terms and conditions.

Using PlayStation Home extends terms and conditions even further, as they have even more terms and conditions.

If you still believe you should get a refund, you are simply in denial.
