“Megadeth Couche-Tard” CONTEST

Contest Rules

1.
The “Megadeth Couche-Tard” Contest is held by Sleeman Breweries Ltd. (the “Contest Organizer”). The Contest runs in approximately 585 participating COUCHE-TARD stores in Quebec (each, “Participating Store”) from September 21, 2016 at 8:00 am (ET) until December 6, 2016 at 11:59 pm (ET) or until prizes last, whichever comes first (the “Contest Period”).

2.
Prizes.  Two (2) prizes are available to be won, each consisting of a guitar signed by Dave Mustaine. The approximate value of each of the prizes is $499. The prize may differ from the picture appearing on the Contest’s promotional material.  There is a limit of one (1) prize per person during the Contest Period.

3.
Eligibility.  The Contest is open to Quebec residents 18 years of age or older. Are excluded: Employees, representatives and agents of the Contest Organizers, of any company, corporation, trust or other legal entity controlled by or affiliated to them, of Participating Stores, their advertising and promotional agencies, suppliers of material or services related to the Contest, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any individuals with whom such employees, representatives and agents are domiciled.

4.
Participation method with purchase of two (2) Unibroue 750 mL bottles.

4.1
any person who wishes to participate in the Contest and who satisfies the conditions set out above (each, a “Participant”) may buy one case of two (2) 750ml bottles of Unibroue beer from an Establishment, which will be scanned at the Establishment’s customer service counter, and the computer that scans the purchase will randomly determine whether the scan is a winning scan.

4.2
If the scan is a winning scan, a Ballot will be provided to the Participant. Each Participant may be declared the winner of a Prize instantly.  The instructions to claim the Prize are found at article 6 of these Rules.

5.
No purchase entry.

5.1
To participate in the Contest without purchasing a case of Unibroue beer according the method set out above, any Participant may mail a legible, handwritten, original letter of at least one hundred and fifty (150) words explaining why he or she would like to win the Prize, accompanied by his or her name, address (including city or town and postal code), age and telephone number (with area code), to “Meagadeth Couche-Tard CONTEST” c/o Sleeman Unibroue, 1100, 50e Avenue, Lachine Qc H8T 2V3. Upon validation of the letter, a UPC Code will be sent to the Participant which may be presented by the Participant at an Establishment.  The Code may be scanned at the Establishment’s customer service counter, and the computer that scans the Code will randomly determine whether the scan is a winning scan.

5.2
If the scan is a winning scan, a Ballot will be provided to the Participant. The instructions to claim the Prize are found at article 6 of these Rules.

5.3
Any Participant may submit one (1) letter per day during the Contest Period, with different text for each letter. Letters may be submitted until December 6th 2016.  There is no maximum number of Ballots that may be entered during the Contest Period, as long as the conditions set out in this section 5 are satisfied for each Coupon.

6.
Awarding Prizes.

6.1
The Participant must send an email to concours@sleeman.ca, stating that he or she has a winning Ballot for the Contest. He or she must then keep the winning Ballot and follow the instructions to satisfy these Rules, in particular by signing the declaration form and correctly responding to a mathematical skill-testing question.  All Prize claims are subject to verification by the Sponsor. All Prizes must be claimed on or by March 7th, 2017. Winners will then be informed of the date and the manner they will receive their Prize. The number of Prizes available to be won will diminish as Prizes are attributed.

6.2
If the selected Participant (i) does not comply with these Contest rules; (iii) has not provided the correct answer to the skill-testing question; or (iv) does not claim the Prize according to section 6.1, or (iii) refuses the Prize, then the selected Participant may not be declared a winner.

7.
Acceptance of Prize. The Prize must be accepted as awarded and is not be subject to transfer, exchange or substitution for an award of cash or otherwise, except that the Sponsor reserves the right to substitute the Prize, in whole or in part, for another prize of equivalent or greater value if the Prize is not available for any reason whatsoever.

8.
Odds of winning.  The odds of winning depend on the number of eligible entries received.

9.
Release. All Ballots are the property of the Sponsor and will in no event be returned to Participants.  Each Participant grants to the Sponsor the right to use his or her name, city or town of residence, photo or image (the “Attributes”) for publicity purposes, in any format or medium, without compensation or prior notice. Each Participant hereby waives moral rights with respect to any materials used for these purposes and incorporating the Attributes.

10.
Coupons.  Neither the Organizer, its representatives, nor the Establishments will be held responsible for any Coupon or letter that is lost, stolen or damaged.

GENERAL CONDITIONS

11.
Verification. Entry Forms, Prize claiming Forms and e-mail communications with selected Entrants are subject to verification by the Contest Organizers. Any form or e-mail communication which is, as the case may be, incomplete, illegible, fraudulent, registered, received or submitted late, not bearing the correct answer to the mathematical skill-testing question or otherwise noncompliant shall be rejected and will not entitle to an entry or to a prize, as the case may be.

12.
Disqualification. The Contest Organizers reserve the right to disqualify a person or to cancel one or several entries of a person who participates or tries to participate in this Contest by using methods that do not comply with these Contest Rules or that are unfair to other Entrants (e.g. entries exceeding the authorized limit). Such a person may be reported to the appropriate legal authorities

Conduct of the Contest. Any attempt to deliberately damage the Contest Website and/or any related website or to sabotage the legitimate conduct of this Contest constitutes a violation of civil and criminal laws. Should there be any such attempts, the Contest Organizers reserve the right to reject the Entrant’s entries and obtain legal or equitable relief under applicable laws.

14.
Substitution of prize. In the event where it would be impossible, difficult and/or more costly for the Contest Organizers to award a prize as described in these Contest Rules, they reserve the right to award a prize of the same kind and of equivalent value or, at their sole discretion, the cash value of a prize as indicated in the Contest Rules.

15.
Liability limit: use of the prize. By entering the Contest, any Entrant selected for a prize releases and holds harmless the Contest Organizers, any company, corporation, trust or other legal entity controlled by or affiliated to them, their advertising and promotional agencies, their employees, representatives and mandatories (the “Released Parties”) from and against any damage resulting from the acceptance or use of a prize.

16.
Liability limit: conduct of the Contest. The Released Parties disclaim all liability for any malfunctioning of any computer component, software or communications line; loss or lack of a communications network; or any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network that may limit or prevent any Entrant’s participation in the Contest. The Released Parties also disclaim all liability for any damages or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any web page or software or by the transmission of any information related to participation in the Contest.

17.
Malfunctions: awarding of instant prizes. If the number of instant winning entries is potentially higher than the number of instant prizes indicated in these Contest rules, due to a human error or to electronic or other faultiness, or a virus or computer bug, the Contest Organizers reserve the right to suspend the awarding of the instant prizes, in whole or in part. If the number of winning entries is actually higher than the number of instant prizes indicated above, prizes not already delivered by mail will be awarded by random draw among all instant winning entries for which no prize has already been delivered.

18.
Contest modification. The Contest Organizers reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this Contest in whole or in part, should human intervention or an event take place that could alter or affect the administration, security, impartiality or conduct of the Contest as provided in these Contest Rules, subject to approval by the Régie des alcools, des courses et des jeux du Québec, if required.

19.
Termination of the participation in the Contest. In the event that the participation in the Contest must be terminated in whole or in part before the closing date provided in these Contest Rules, prizes not awarded will be cancelled.

20.
Prize limit. In no event shall the Contest Organizers be required to award more prizes or to award a prize otherwise than in compliance with these Contest Rules.

21.
Liability limit: participation in the Contest. Persons who enter or try to enter this Contest release the Released Parties from any liability for damage these said persons may incur as a result of their entry or their attempt to enter the Contest

22.
Authorization. By entering this Contest, any Entrant selected for a prize authorizes the Contest Organizers and their representatives to use his/her name, photo, likeness, voice, place of residence and/or statement regarding a prize for publicity purposes, without any form of compensation.

23.
Communication with Entrants. No communication or correspondence related to this Contest shall be exchanged with Entrants except as provided for in these Contest Rules or at the Contest Organizers’ initiative.

24.
Personal information. Entrants’ personal information collected for the purpose of the Contest will only be used to administer and promote the Contest. No commercial or other communications unrelated to the Contest will be sent to Entrants unless they have otherwise agreed to receive such communications.

25.
Entrant identification. For the purpose of these Contest Rules, the Entrant is the person whose name appears on the Entry Form and it is to this person to whom the prize will be awarded if he/she is selected and declared a winner.

26.
Contest Organizers’ decision. Any decision by the Contest Organizers or their representatives regarding this Contest is final and without appeal, subject to a ruling by the Régie des alcools, des courses et des jeux on any issue under its jurisdiction.

27.
Litigation. Any litigation respecting the conduct or organisation of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie for the purpose of helping the parties reach a settlement.

29.
Unenforceability. If a section of the Contest Rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.

30.
Language. In case of any discrepancy between the French and English versions of these Contest Rules, the French version shall prevail.
